2014.01.28_TC_Minutes_Workshop TOWN OF HIGHLAND BEACH MINUTES OF TOWN COMMISSION MEETING WORKSHOP MEETING Tuesday, January 28, 2014 1:30 PM Mayor Bernard Featherman called the Workshop Meeting to order in Commission Chambers at 1:30 PM. CALL TO ORDER: Roll Call: Members present: Mayor Bernard Featherman; Vice Mayor Ron Brown; Commissioner Dennis J. Sheridan; Commissioner Louis P. Stern; and Commissioner Carl Feldman. Also present: Town Attorney Glen Torcivia; Town Manager Kathleen Dailey Weiser; Town Clerk Beverly Brown; Finance Director Cale Curtis; Public Works Director Edward Soper; Police Chief Craig Hartmann; Assistant to the Manager Zoie Burgess; and members of the public. Pledge of Allegiance: The Pledge of Allegiance was given, followed by a minute of silence. Civility Pledge: The Civility Pledge was recited by the Town Clerk. 1. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA; Mayor Featherman asked for any additions or deletions. Receiving none, the agenda was accepted as submitted. 2. PUBLIC COMMENTS AND REQUESTS; Rhoda Zelniker, 3912 S. Ocean Blvd — I want to personally thank Zoie Burgess for helping my husband and I resolve a Comcast issue. We have 220 residents in our Condo and we have not been receiving Channel 99, which televises our town meetings and lists local town events. After many attempts to resolve this issue with Comcast, Zoie gave us the telephone number of Comcast executive support. After numerous calls to Comcast from Zoie and me, Channel 99 miraculously appeared. Mike Ferrara, 4748 S. Ocean Blvd — I have an extensive background in law, accounting, banking, mortgage, etc. and am setting this forth, because over the next few months, I will be expressing opinions and observations about activities. Ocean Blvd. Ms. Andrews stated she has already served one term on the Beaches & Shores Advisory Board and is extremely interested in the beaches and would enjoy serving another term. Ira Oaklander — 1000 Russell Drive Mr. Oaklander stated that he also has served on the Beaches & Shores Advisory Board and looks forward to serving another three years. I respect this committee in what we have done and are trying to do to keep our beaches cleaner and safer for this Town. Consensus was to place these two reappointments on the February 4, 2014 Consent Agenda. • Board of Adjustment & Appeals — Two Appointments Talent Bank Application Joel Leinson — 3740 S. Ocean Blvd. Gave a brief description of his background. As a contractor for over 40 years, he felt that the experience he has gained in that industry allows him to serve on this board. William Weitz -1135 Boca Cove Lane Stated he is a retired Lieutenant Colonel and Forensic Psychologist by profession. While serving in the military, he was responsible for all aspects involved in establishing facilities in different communities. He would like to be involved in our community and help in any way possible. Town Attorney Torcivia — The Supervisor of Elections will be changing the rules and wants to be sure that when the Canvassing Board meets, it will be with the Supervisor, the Clerk and one member of this Board. Previously, the Commission approved having the option of one member of this Board and she insisted that it be mandatory, not an option. Consensus was to schedule Ordinance No. 14-0010 for a First Reading at the regular meeting on February 4, 2014. Town Commission Workshop Minutes January 28, 2014 Page 4 of 12 Town Attorney Torcivia — This ordinance changes the part of the Code that the people within 1,000 feet be notified, to only people within 300 feet be notified, of any owners of property abutting the canal. Consensus was to schedule Ordinance No. 14 -002 O for a First Reading at the regular meeting on February 4, 2014. C) RESOLUTION NO. 14-001 R A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA REPEALING RESOLUTION NO. 484 ESTABLISHING A MAXIMUM WEIGHT LOAD FOR THE BEL LIDO BRIDGE (BRIDGE NO. 935900) Town Clerk Brown read Resolution No. 14-001 R into the record. Vice Mayor Brown — I received the report and will send it out to our residents in Bel Lido to let them know why it was changed. The other Commissioners stated they have also received the report. Consensus was to place Resolution No. 14 -001 R on the Consent Agenda for the regular meeting on February 4, 2014. D) RESOLUTION NO. 14-002 R A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, PROVIDING THAT PURSUANT TO SECTION 1.06( OF THE TOWN OF HIGHLAND BEACH CHARTER, THE TOWN COMMISSION SHALL CONTINUE TO SERVE AS THE TOWN'S CANVASSING BOARD DURING THE MARCH 11, 2014 ELECTION AND SHALL AUTHORIZE THE TOWN CLERK TO BE PRESENT AT THE PALM BEACH COUNTY SUPERVISOR OF ELECTIONS FACILITY ON MARCH 11, 2014 TO DETERMINE WHETHER THERE ARE ANY QUESTIONABLE BALLOTS AND IF SO, TO TRANSPORT SUCH BALLOTS TO THE TOWN COMMISSION FOR CANVASSING AT A PUBLIC MEETING; PROVIDING THAT THE TOWN CLERK SHALL BE RESPONSIBLE FOR THE HANDLING AND SAFEKEEPING OF THE BALLOTS; PROVIDING FOR SEVERABILITY, CONFLICTS AND AN EFFECTIVE DATE. Town Clerk Brown read Resolution No. 14 -002 R into the record. Town Attorney Torcivia — Until the ordinance is adopted, you have to keep passing these resolutions authorizing the Clerk to go to the Supervisor of Elections' Office to bring the ballots back. If the Ordinance that was just read into the record passes on the first and second reading and the election, then this will be the last year that you do this resolution. If it doesn't pass, then we will have to negotiate some more with the Supervisor of Elections. NEW BUSINESS: A) Commission to Authorize the expenditure of $23,867.00 from Account #402- 535.000- 546.200 Renewals and Replacements for the replacement of a Submersible Pump for Lift Station #3. Town Manager Weiser — The submersible pump for Lift Station #3 has broken down and we don't have a replacement. This is a sole source purchased from the company of Xyiem Water Solutions at a cost of $23,867.00. We have that in the sewer fund and ask your approval. Comm. Feldman — I know we need a new pump; but can we rebuild this pump and keep it as a spare. Public Works Director Ed Soper — That will be evaluated once we remove the pump and send it back to the factory. Comm. Feldman — We had to borrow one from the company since we didn't have a spare. It's not the price, it's the availability. If they weren't able to loan us one, we would have had big problems. I feel it is critical that we have a spare. Consensus was to place this item on the Consent Agenda for the regular meeting on February 4, 2014. B) Commission to Authorize the Mayor to sign a two -year contract with Sunshine Cleaning Systems, Inc. for custodial services, funding budgeted in Account #519.000- 534.200. Town Manager Weiser — This is our contract for cleaning Town Hall and the Public Works facility. We have been pleased with this company, have the ability to renew this for two years and are asking for your authorization to do so. Comm. Feldman — The amount in this contract is $60,000. It does not spell out just what they will be doing other than clean the rugs and windows. Can we have them do more? We used to have our own maintenance people who did this work. I think we still should have our own people do this work. Under the approved Town Commission Purchasing Policy of August 2, 2011, this falls into the $2500 to $10,000 area, which states we must obtain three competitive bids. Have we gone out for three bids? Town Manager Weiser — You don't need to do that when you are renewing a contract. Comm. Feldman — Why wouldn't we do it anyway, just to be sure? Town Manager Weiser — It is a policy decision if you want to. Comm. Feldman — I would feel more comfortable doing that, getting two more bids or hire our own people. Comm. Stern — It is not as complex as it should be. I don't think we could hire our own people for $60,000. The three bids is not a bad idea and I would not oppose it, if that is what the rest of the Commission would like to do. However, $60,000 does sound fair as an outside service, not as an in- house situation. Comm. Sheridan — I agree with both Commissioners. I see no harm in getting another bid, but I don't see we are going to do much better than the $60,000 we are paying these people. You would have to Town Commission Workshop Minutes January 28, 2014 Page 6 of 12 hire more than one person. Town Manager Weiser — We did have other contracts that we were not happy with. It is not always the lowest bid that is the best service. We are happy with this company. Vice Mayor Brown — Everyone seems happy with this company. I think the place always looks nice. Town Manager Weiser — I am recommending a two year contract because we have been very happy with this company. After the two years we will then go out for a new bid. Vice Mayor Brown — I am happy with that. Mayor Featherman — I agree with Commissioner Feldman and we should put it out for bid again. Consensus was to put this item on next week's agenda, under Old Business, for further discussion. C) Commission to Authorize the Mayor to sign a contract for Construction Manager at Risk (CMAR) with BSA Corporation. Town Manager Weiser — Following the authorization given at the Commission meeting on December P, staff began to negotiate and continues to negotiate with BSA Corporation on the development of a guaranteed maximum price for Construction Manager at Risk Services. BSA Corporation has reviewed the plans and made some changes. They are in the process of putting together the final price and we hope to have that to you by Tuesday. In the meantime, construction plans were finalized and you have had the chance to look at them. BSA Corporation is in the audience, as well as the architect. You have been given a copy of the contract for construction for Risk Manager at Risk Services with BSA. The contract was prepared by our Town Attorney and he can answer any questions you might have. Comm. Feldman — We had a meeting with Zoie, Chief Hartmann and the architect. I am concerned that certain people in the Town have not seen this proposal; Public Works Department, Bill Moore, Public Works Director Ed Soper and our Building Inspector Mike Desorcy. I think these plans should be looked at by them. I spoke with Barry Donaldson, a Board member and a professional architect, and he said he would look over the plans. In looking at the contract, I noticed there weren't any contract fees in there. There also was nothing in there for an asbestos inspection; storage of building materials, parking for the construction workers and the restrooms that will be out of order here in the Town Hall. I think these should be looked into carefully. Comm. Stern — He makes some very valid points. However, I was very comfortable meeting with Bill Branning. In looking over the contract, having read the contract; I think it is time to move forward. Between now and the time the construction would start which would be a month or six weeks out, and after we approve everything if it comes in within budget, then prior to that, we will still need to have the departments that you refer to look at the plans and approve them. I see nothing wrong with moving forward and not slowing down at this point. Comm. Sheridan — I read the contract which is being prepared by our Attorney, he is certainly looking out for our rights. I feel very comfortable with going ahead with this at this time. I have no opposition to having Barry or anyone else in the Town look at these plans at any time. If they have any comments or suggests, we will welcome them. Town Commission Workshop Minutes January 28, 2014 Page 7 of 12 Vice Mayor Brown — I also read the contract and had a meeting with Bill Branning. I disagree with Commissioner Feldman. We are not jumping into anything. Anyone in the Town is certainly welcome to look at these plans and make inputs. However, once we decide on the Risk Manager, then he negotiates with the subcontractor and that is what we are trying to do. We can't get any costs until we take that step. To stop that step now, in my opinion, is unacceptable. I specifically asked about restrooms and storage. He has plans for that and I feel he has planned very well. Mayor Featherman — I looked at the plans for the first time yesterday. I need more time to go over the contract. I would like to reserve my comments and hold back the signing of this contract until I do so. Comm. Feldman — On the contract, there was no compensation for BSA. Are they getting a separate compensation or are they part of the $850,000? Town Manager Weiser — That is being developed and will be presented to you on Tuesday. I want you to know that the department heads who are involved in this project have seen the plans. Town Attorney Torcivia — This is the base of the contract. The business guts of the contract is the little part which we haven't seen yet,; because that is what is still to be negotiated, the price. What that guaranteed maximum price is going to be will hopefully be presented by Tuesday and have an attachment to it. It will talk about when the date of substantial completion is and when is the date of final completion, because those are penalties if they don't make those dates. It is $500 a day if you don't make substantial completion and $250 a day if you don't make final completion. That last negotiating point has not been finished yet. You have the 100 pages but you still don't have the 2 or 3 pages which are the dollar amount. If we can reach an agreement by Tuesday, you will have it then. Consensus was to place this item on next week's agenda under Old Business for further discussion. D) Request from State Representative Bill Hager — Sober Houses Mayor Bernard Featherman — I spoke with Representative Hager's office and asked them how that commits us in signing a contract like this. They need a place in the 37 towns and cities in Palm Beach County that are affected by this. We are not affected, but they want to show unanimity of all of us signing together, so we can place these homes under regulations, rather than haphazard homes that are placed. He has a bill in process whereby it has to be signed by the Governor. Those homes that are set up will have to come under regulations to do the job for helping people with either alcohol or drug problems. Should I sign the form that was sent to me or should I not? Comm. Stern — What exposure do we have in signing this letter? Town Attorney Torcivia — It is really expressing your support. The question is, do you support the regulation of these houses? Representative Hager and State Senator Clemens have legislation. Delray Beach is one of the leaders in trying to promote that legislation. You can or cannot join that effort, depending on what you think the risks are in these kinds of houses happening in Highland Beach. They pop up everywhere. Comm. Stern — I think supporting his letter is fine, but I don't think we want to support a Sober House in the Town of Highland Beach. Town Attorney Torcivia — What they are actually asking is to regulate the houses that are out there. There are tons of litigations about Sober Houses and the American Disabilities Act, and how far a town can go with regulating people with disabilities, if you consider drug abuse or alcohol abuse a disability. Town Commission Workshop Minutes January 28, 2014 Page 8 of 12 Comm. Feldman — Are we under any financial obligation if we sign this letter? Town Attorney Torcivia — No you are not. Vice Mayor Brown — We say there are no Sober Houses here right now, but there are a lot of spec homes going up. Someone could buy one of these homes and turn one into this. I think, as a Commission, we need to support this and get legislation in the works to be able to control it. Consensus was to place this item on the Consent Agenda for regular meeting on February 4, 2014. E) Request from Beaches & Shores Advisory Board that the Town Commission send a letter to residents and condo associations regarding beach cleaning. Town Manager Weiser — At the Beaches & Shores Advisory Board meeting on January 14 their Board wanted to recommend to you that you send a letter reminding all the beachfront owners to keep their beachfront clean. They would also like a copy of the town ordinance attached that requires them to do so. Their Chair has drafted a nice letter to send out and they would encourage you to do so. We are putting an article in the Highlander to remind people, but they would like that one -on -one contact with each of the beach property owners. Comm. Feldman — I think the Beaches & Shores Board is doing a great job and I think the Town could back them up in another way. There have been complaints about the beach rakers leaving trash where the next person didn't pay for the beach raking. Is there anyway the Town could contact the beach rakers and give them some guidelines from the Public Works Dept. to what they should be doing? Town Manager Weiser — If we have their names we would be glad to send them the ordinance reminding them. The purpose of this letter is for those people who don't have beach cleaning services. Comm. Sheridan — There are federal regulations that these beach rakers must abide by. The Chairman, at that particular Beaches and Shores meeting, mentioned that they are totally aware of what there regulations are and what they must conform to. Vice Mayor Brown — A few years ago we put a referendum out to the town residents for a special use tax to pull the beach cleaning hiring to the Town. That failed because nobody wanted to pay extra taxes to clean up the beach. I hesitate to try, as a Commission, to go out and legally engage somebody that a private citizen went out and hired. That is well beyond our purview to do that. If we want to do it as a Town, then we as a Commission need to do it as a Town of Highland Beach, not as ten separate owners on the beach with ten that don't want it. Comm. Feldman — There are just a few private homes that don't hire the beach raker. The Condos on the beach do hire them. I think if we talk to them and tell them the problems that are brought to this Commission, maybe they would help us out. Town Commission Workshop Minutes January 28, 2014 Page 9 of 12 Comm. Stern — Bringing it back to the question of the day, should this letter be sent. I think it is a very well written letter and I compliment the Beaches & Shores for putting it together. I recommend highly that this letter be sent to the homeowners as a reminder. Vice Mayor Brown — I like the Highlander and getting information out to everybody through our normal means, not sending a letter to all homeowners on the beach. Mayor Featherman — There are at least ten to fifteen homeowners that are not cleaning the beach in front of their homes. I think we should send a letter and let them know in a friendly way that they have to do it. We have a Code Enforcer that could check these homes and see if they are in violation of the Code. Comm. Feldman — I think sending a letter to these people on the Town's letterhead asking them to conform is more effective and not a burden on the Town. Comm. Sheridan — I believe the Beaches & Shores wanted the letter to go out to all homeowners including the Condo Association Management Companies. Consensus was to place this item on next week's agenda under Old Business for discussion. 7. MISCELLANEOUS — ITEMS LEFT OVER: B) Minutes: January 7, 2014 — Regular Meeting Vice Mayor Brown stated he had one correction and would meet with the Clerk. Consensus was to include minutes on the February 4, 2014 Consent Agenda. 8. REPORTS — TOWN COMMISSION: A) Commissioner Carl Feldman — I have been saying for some time that the citizens of Highland Beach should be heard and once they are heard many times something happens. We heard Rhoda Zelniker say that her Condo is now getting Channel 99. This took place with the help and support of Zoie Burgess and the Town. Are there any other condos that are not getting Channel 99? If so they can contact someone like Rhoda Zelniker or Zoie Burgess to get this resolved. The whole town including the private homes should get Channel 99. B) Commissioner Louis Stern - Not everyone has Comcast. We have AT &T U Verse, have been working with Zoie and we cannot get Channel 99. They have public access that does a few of our northern towns but does not come down this far. No matter how hard we have tried, we cannot get AT &T U Verse to cooperate with our area. The I -95 construction at Spanish River Blvd. has been started. It will be a few years before it is completed but it will be a wonderful access for us on Spanish River Blvd. The Holiday Inn name will disappear on Town Commission Workshop Minutes January 28, 2014 Page 10 of 12 Saturday, February 1 The Holiday Inn is still owned by the same people but they have given up the franchise. The hotel will be called The Delray Sands Resort at Highland Beach. Valet parking will be required at a cost of $5.00. Any overnight guests will pay $20.00 parking. C) Commissioner Dennis Sheridan — I would like to rebut Mr. Rodis' comment made last week regarding the Charter Review Board. This Charter Review Board consisted of about eight or nine people that were selected from various areas of our Town who had a lot of knowledge as to what was going on. They had many years of experience. They met four to five times and brought it to the Commission on several occasions of which we reviewed it, and sent it back. These meetings were opened to the public and there were not two residents at any of these meetings. We then went on further and published two public meetings, of which nobody attended. It is not a question of picking nine people of this town; but it was brought to this Commission who has been elected by the Town to represent them and that is where the decision was made. D) Vice Mayor Ron Brown - Everyone needs to come out and speak their opinions at public meetings. Regarding the Delray Sands Resort, it is actually $3.00 during breakfast and lunch for valet parking; $4.00 during dinner and $5.00 if you have a group, because they will have to bring other people in. I have talked to several people about bikes. Some people from the north have told me that they turned their town (specifically Block Island) into a town friendly, bike friendly town community. It is great to see people riding bicycles and I think we should get a mindset of a biker friendly town. They are out there exercising and enjoying our beautiful community. That is why they ride A IA. E) Mayor Bernard Featherman — I recently spoke with the Town Manager regarding having more parking spaces and having an architect come in to see if it is possible to put a second tier on our building. I would like to see if we could authorize, as Commissioners, the Town Manager to see if we can get some advice on the possibility of doing something on this parking. Comm. Feldman — It is very difficult to build something on what we have now, that is not cost prohibitive, to get another ten to fifteen cars in there. There are other things we could do without putting up another structure. I don't think it is a good idea. Comm. Stern — I think it is a great idea to hire someone to give us some advice. If it makes sense, I would go along with that. More important, I think we could find more additional parking by someone who could reduce the size of the spots from 10' x 20' to 9' x 18', and put some diagonals in at the same time. Comm. Sheridan — Depending on the cost of the study, I have no objection. I think it is a good idea. Vice Mayor Brown — I think we need to look into it. Consensus was to place this item on next week's agenda under "Misc. Items Left Over" for further discussion. Mayor Featherman stated he recently participated in the following: 1) Represented Highland Beach in the motor parade at the South Florida Expo; 2) Received an Award of Appreciation for serving as Chairman of one of the four subcommittees on the Reentry Task Force of the Palm Beach Criminal Justice Commission; 3) Became the 2014 President Elect of their Sunset Rotary Club. REPORTS — TOWN ATTORNEY GLEN TORCIVIA: No Report. 10. REPORTS — TOWN MANAGER KATHLEEN DAILEY WEISER: Town Manager Weiser had no report. Commissioner Feldman — Have you heard anything new on the 3200 property. They now have a website stating the fact that they are going to have 22 units in the building. Have they applied for a building permit? Town Manager Weiser — They have not applied for a building permit. I have it by verbal notification that the property has been sold to the Seagate Corporation, the same corporation that has the Seagate in Delray Beach. They are planning on keeping to the schedule that they have which you previously approved. I am still waiting to get something in writing. 11. PUBLIC COMMENTS AND REQUESTS RELATED TO ITEMS DISCUSSED AT MEETING Allen Teller, 4210 S. Ocean Blvd —My question is regarding the 300 foot notification. Bel Lido has two ponds. If a person is on the other side of that pond which would be more than 300 feet away, but still in view of the structure, will they be notified or not. Town Attorney Torcivia — If it measures more than 300 feet then they will not be notified. Allen Teller — I think that people who purchased homes on the other side of the pond and, if a structure is going in that is visible to these homes, I don't think it is fair that they do not have the right to comment on it. Vice Mayor Brown — Everybody is welcomed to come to those meetings. The meetings are posted and also published on our website. Allen Teller — I feel that 300 feet is not enough and the distance should be measured to determine what is fair. Vice Mayor Brown — I will look into this. Town Manager Weiser — I have seen in other cities where they say the letter does not have to be registered mail. Specifically, when a body of water makes it so there either not contiguous or more than 300 feet, they would be notified, but not by registered mail. The other is that if a body of water is what separates it from being contiguous, or being 300 feet and in the direct site line, we would still notify you. Mike Ferrara — 4748 S. Ocean Blvd — Having heard Commissioner Feldman's comment regarding the $500,000 and the million dollars on the Charter Review, I requested from the Clerk the details that went into the amendment of the Charter. It was the Town Attorney's position that very few towns in the State provide any limitations. This particular phase had extensive pros and cons. I am suggesting that it wasn't something done lightly, but done with great deliberation and much dispute. Decisions have to be made by the people sitting up there. I have sat in all positions, including attorney, and if the residents do not come to the meetings or read the paper, it is a failure on the public's part.
