Minutes of Meeting of Town Commission
WORKSHOP MEETING
Tuesday, September 27, 1994 1:30 p.m.
Mayor Arlin Voress called the Workshop Meeting of the Town Commis-
sion of the Town of Highland Beach, Florida,. to order at 1:30 p.m.
in the Commission Chambers at Town Hall. Also present were Vice
Mayor Bill Paul, Commissioners Arthur Eypel, John F. Rand, and
David Augenstein.
Also in attendance were Town Attorney Thomas E. Sliney, Town
Manager Mary Ann Mariano, Town Clerk Anne M. Kowals, CMC, Building
Official Lee Leffingwell, Ms. Jane Malfitano and Ms. Lisa Mulhall
of the Boca Junior League, Ms. Beth Dullaghan of the Realtor
Association of South Palm Beach County, Inc., and members of the
general public.
ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA
The Agenda, as submitted, received unanimous approval.
Presentation by Boca Junior League (Ms. Malfitano
• and Ms. Mulhall
Ms. Jane Malfitano of the Boca Junior League, noting more than
$125,000 was raised at the February 'Showcase Open House' in
Highland Beach, extended the League's gratitude for the Town's
support during that fund raising event. Ms. Malfitano, further
noting funds were donated to Habitat for Humanity, Children's Place
South, Sugar Sand Park, etc., stated the League, to show its appre-
ciation, is proposing to fund a project (i.e. Xeriscaping along
A-1-A) in Highland Beach. Noting Ms. Lisa Mulhall, Chairperson for
the 1996 "Showcase Open House" program, is on the Executive Board,
Ms. Malfitano advised the League's proposal will be discussed with
the membership. It was the consensus to have the Town Manager,
after arrangements are worked out with Ms. Malfitano and Ms.
Mulhall, report back to the Town Commission.
PUBLIC COMMENTS AND REQUESTS
Mr. Jose Echeverria of Russell Drive reported that, as of August,
the Highland Beach Turtle Program had a total of 695 nests and 635
false crawls. Further, Mr. Echeverria reported, on September 17,
the Highland Beach Volunteers got involved in a beach clean-up
effort which resulted in approximately 16 bags (580 lbs.) of debris
collected from the beach in Town.

93.8 Discussion re Adelphia Cable
Town Attorney Thomas Sliney informed the Commission that his
colleague, Attorney Cormac Conahan, was advised by Chuck Blaine of
Adelphia Cable that their in-house attorney will be submitting the
franchise renewal proposal to the Town the week of October 03.
During discussion, the Commission requested Adelphia be advised
that many residents are unhappy with the removal of channel 4 (NBC
of Miami) and suggested that channel 6, which has poor reception
and is a duplicate of channel 10, be removed and channel 4 be
reinstated.
It was noted information of meetings regarding the cable franchise
renewal process will be placed in the November Town Newsletter and
on government channel 12.
94.2 BOARDS AND COI~iITTEES
Mayor Voress, noting Code Enforcement Board Member Arthur Hamerman
is eligible for reappointment upon expiration of his term this
• month, stated this matter will be addressed at the October Regular
Meeting of the Town Commission.
The Mayor noted no correspondence was received from any Boards and
Committees.
94.3 PROPOSED ORDINANCES AND RESOLUTIONS
1. AN ORDINANCE AMENDING THE TOWN CODE OF THE TOWN OF
HIGHLAND BEACH, FLORIDA, CHAPTER 23 ENTITLED "SIGNS AND
ADVERTISING" BY REPEALING SAID CHAPTER IN ITS ENTIRETY
AND SUBSTITUTING IN LIEU THEREOF NEW CHAPTER 23 ENTITLED
"SIGNS AND ADVERTISING".
Mayor Voress stated the proposed ordinance received first reading
on September 06, 1994, and was published on September 16, 1994.
During discussion, Ms. Beth Dullaghan, Director of Governmental
Affairs of the Realtor Association of South Palm Beach County,
noted the Association's concerns regarding the size, language, and
color restrictions. The Town's proposed sign code amendments con-
flict with the Florida Real Estate Commission (FREC) requirements
relating to language on real estate signs, and, as such, would put
realtors in violation of the FREC regulations.
Following substantial discussion, it was the consensus to return
this matter to the Community Appearance Board for reconsideration;
it was suggested in-put be solicited from the Realtor Association

of South Palm Beach County, Inc. during the deliberations which
will be followed by the CAB submitting their recommendations to the
Town Commission.
94.7 Discussion re Library Foundation
Town Attorney Sliney, noting he forwarded a memo along with
Commissioner Rand's comments of August 30, 1994, regarding the
'Library Foundation' to his colleague for review, stated no
response has, to date, been received from said colleague, Attorney
Peter K. Bradley.
MISCELLANEOUS - ITEMS LEFT OVER
Status of Building Development in Town
Members received and reviewed the Status of Building Development in
Town, a report submitted by the Building Department. The Building
Official, responding to an inquiry by the Vice Mayor, advised that
• the new owner of the property on the West side of A-1-A at the
North end of Town (Mr. Kalman), obtained approval of plans from the
appropriate Advisory Boards for placement of an antique gazebo and
relandscaping of the property.
Minutes for approval at October 1994 Regular Meeting
It was the consensus to move the August 30, September 02, and
September 06, Meeting Minutes to the October Regular Meeting for
consideration.

Vice Mayor Bill Paul
Vice Mayor Bill Paul had no report this date.
Commissioner Arthur Eypel
Commissioner Arthur Eypel, under his report, reminded the public
that the American Heart Association 'Heart Walk' is scheduled for
Saturday, October O1. The Commissioner, urging residents to
participate, noted he can be reached at Town Hall or home for
information regarding this worthy fund raising event.

Commissioner John F. Rand had no report at this time.
Commissioner David Augenstein
Commissioner David Augenstein had no report today.
Mayor Arlin Voress
Mayor Arlin Voress, under his report, extended congrtulations to
Board of Adjustment Chairman Harold Cohen who was appointed a
permanent member of the Palm Beach County Board of Adjustment.
Mayor Arlin Voress, noting that the primary run-off election is set
for Tuesday, October 04, in the Town Hall Chambers where polls will
be open from 7:00 a.m. through 7:00 p.m., urged residents to cast
a vote for the candidate of their choice.
The Mayor noted that, due to the run-off election, the Regular Town
Commission Meeting will take place on Wednesday, October 05, 1994,
• at 1:30 p.m.
REPORTS - TOWN ATTORNEY
Town Attorney Thomas Sliney had no report at this meeting.
REPORTS - TOWN MANAGER
Town Manager Mary Ann Mariano, noting a request for an amendment to
our Comprehensive Plan was received, advised the Commission that
the Town Attorney and she are working with our Planning Consultant
to prepare a procedure and fee schedule for this matter. This
issue will be an Agenda Item for the October 05, Regular Meeting.
ADJOURNMENT
There being no further business to come before the Town Commission
at this time, Mayor Voress, upon proper MOTION, adjourned the
Workshop Meeting at 2:10 p.m.
