TOWN OF HIGHLAND BEACH
MINUTES OF TOWN COMMISSION MEETING
SPECIAL MEETING
Friday, January 31, 1997 9.30 A M
Mayor Arlin G. Voress called the Special Meeting to order in
Commission Chambers at 9:30 A.M., stating its purpose was to
discuss development of a policy and procedures to avoid and
discourage sexual harassment for the Town of Highland Beach.
Town Clerk Doris Trinley called the roll. The Mayor, Vice Mayor
John F. Rand, and Commissioners Arthur Eypel, David Augenstein and
Thomas J. Reid were present.
Mayor Voress acknowledged Larry Gorman, Esq., of Hodgson, Russ,
Andrews, Woods & Goodyear, who was sitting as Town Attorney for
this meeting, and advised that Mr. Corman would lead discussion and
review of a previously transmitted proposed policy.
Town Manager Mary Ann Mariano was also present, as were members of
the general public.
Attorney Gorman first gave some background material, which
highlighted the advantages for such a policy to be adopted by the
Town. He then led the Commission members through a page-by-page
review of a proposed policy for the Town, answering questions to
their satisfaction. Several amendments were agreed to, including
the addition of "elected and/or appointed officials" under
individuals covered by the policy, and that the policy itself
should be made part of the Town's "Personnel Rules and
Regulations."
Town Manager Mariano expressed concerns regarding "Sanctions" under
Section VI, in that it did not address sanctions which might be
applicable to "elected and/or appointed officials." It was agreed
that Attorney Gorman would amend the section to include appropriate
language addressing this aspect, with Ms. Mariano saying that such
action would satisfy her concerns.
Also, Ms. Mariano asked for clarification of the following: that as
soon as the policy was adopted, any complaints that come in on or
after that date will be handled through the policy. The question
was clarified to her satisfaction that any complaints would be
handled through the policy after it was implemented.
Concluding discussion, the following MOTIONS were made:
(1) TO ADOPT THE PROPOSED POLICY WITH THE
AGREED UPON AMENDMENTS (COMMISSIONER
EYPEL/COMMISSIONER AUGENSTEIN with unanimous
favorable roll call vote).

(2) THAT THE ADOPTED POLICY BE MADE PART OF
THE TOWN'S "PERSONNEL RULES AND REGULATIONS"
(VICE MAYOR RAND/COMMISSIONER REID with
unanimous favorable vote).
(3) THAT THE MAYOR, TOWN MANAGER AND ATTORNEY
CORMAN MEET TO DETERMINE HOW THE CRITERIA TO
DEVELOP THE APPOINTMENT OF MEMBERS TO THE
POLICY AND APPEALS COMMITTEES WILL BE
ACCOMPLISHED; ALSO, THAT THE COMMISSION
MEMBERS WILL APPROVE OF THE DECISIONS MADE BY
THE MAYOR, TOWN MANAGER, AND ATTORNEY CORMAN
IN THIS REGARD (COMMISSIONER REID/COMMISSIONER
EYPEL with unanimous favorable vote).
There being no further business to come before the Commission at
this time, Mayor Voress adjourned the Special Meeting at 11:45 A.M.
upon MOTION by COMMISSIONER REID/COMMISSIONER AUGENSTEIN.

RE: YOUR MEMO OF JANUARY 17, 1997
• This is in response to your January 17, 1997, memo. In response to your
clarification I would state that while you did have prior complaints regarding Vice Mayor Rand's
conduct, it is my recollection that those complaints were based on policy or procedural issues
which did not involve or implicate the type of inappropriate conduct which you complained about
on January 2, 1997.
In any event, I share your desire to bring this matter to a satisfactory conclusion
at the earliest possible date and look forward to working with you to accomplish that goal.
