TOWN OF HIGHLAND BEACH
TOWN COMMISSION
SPECIAL MEETING MINUTES
May 27, 1997 2:15 P.M.
Mayor Arlin G. Voress called the Special Meeting to order
in Commission Chambers at 2:15 P.M.
Deputy Town Clerk Jane Dillon called the roll. The Mayor,
Vice Mayor John F. Rand and Commissioners David Augenstein
and Michael W. Hill were present. Commissioner Thomas J.
Reid was absent.
Town Attorney Thomas E. Sliney and Town Manager Mary Ann
Mariano were also present, as were members of the general
public.
The following issue was heard:
REQUEST FOR LETTER OF NO OBJECTION TO THE DEP
FOR PROPOSED EAST SIDE DEVELOPMENT OF LOTS 69E
& 70E BY THE OMEGA GROUP (PROPERTY FORMERLY
KNOWN AS HIDDEN HARBOR.)
Mr. Frank Zammiello, representing the Omega Group discussed
with the Commission two draft versions of a letter to be
sent to Mr. Barry Manson-Hiung at the Department of
Environmental Protection, stating the proposed development
of subject property.
The Commission reviewed the plans for the development which
showed a sales office consisting of three stories, of which
would contain models of units to be built on the West
development. It was stated that this facility would
eventually serve as a beach club for ocean access only, as
there would be no pool on this site. Mr. Zamello stated
that the plans will be submitted to the Building Official
within three weeks. He also stated that a Unity of Title
will be filed confirming the East and West developments.

With all questions from the Commission being answered
satisfactorily, Motion was made by VICE MAYOR RAND/MAYOR
VORESS as follows:
THE TOWN COMMISSION OF HIGHLAND BEACH ACCEPTS
VERSION A LETTER ADDRESSED TO MR. BARRY MANSON-RING
AT THE DEPARTMENT OF ENVIRONMENTAL PROTECTION,
REGARDING THE PROPOSED HIDDEN HARBOR DEVELOPMENT
PROJECT IN HIGHLAND BEACH, BY THE OMEGA GROUP, WITH A
NOTATION THAT A UNITY OF TITLE WILL BE FILED AND
RECORDED ON MAY 28. (Letter attached hereto and made
a part of these minutes.)
Rollcall met with unanimous vote.
The second item to be heard was as follows:
REVIEW AN ADDENDUM TO THE INTERLOCAL BULK WATER
AGREEMENT WITH THE CITY OF DELRAY BEACH AND CONSIDER
APPROVAL OF SAME.
• Ms. Mariano spoke on the changes the Addendum stated, with
the Mayor clarifying that the Town has received everything
asked for and at the Delray Commission Meeting the
Addendum had been approved.
Vice Mayor Rand asked for an explanation of the 25%
surcharge for Delray Beach non-residential users, as stated
on page 2 of the Addendum, and if this surcharge is paid by
other non-users other than Highland Beach. Ms. Mariano
clarified that there are many commercial business and
residents outside Delray proper which utilize Delray water
and pay the surcharge also.
Upon MOTION by VICE MAYOR RAND/COMMISSIONER AUGENSTEIN the
Town Commission accepts the Agreement and Addendum with
Mayor Voress being authorized to sign both documents.
Motion passed with unanimous vote.
With no further business to come before the Commission at
this time, MOTION to adjourn was made by VICE MAYOR
RAND/COMMISSIONER AUGENSTEIN at 2:40 P.M.

RE: Proposed Hidden Harbor Development Project, Highland Beach,
Palm Beach County, Florida
Dear Mr. Manson-Ring:
. The Town of Highland Beach has reviewed the development proposed by the
Hidden Harbor Development for the east side of A1A in the Town as submitted
to your Bureau (the "Proposed Development"). The Town has no objection to
the Proposed Development. The Town is obligated by a 1995 federal court
order and settlement stipulation to amend the Town's comprehensive plan for
the subject property. Hidden Harbor's Proposed Development is consistent
with the comprehensive plan land use designation which the Town is required
to establish for the property pursuant to the court order. In the meantime, the
subject court order and stipulation allow the property owner to proceed with the
Proposed Development prior to the adoption of the required comprehensive
plan amendment.
