1997.06.03_TC_Minutes_Regular4 ~ ~. ~ L ~ TOWN OF HIGHLAND BEACH MINUTES OF TOWN COMMISSION MEETING REGULAR MEETING Tuesday, June 03, 1997 1.30 P M Mayor Arlin G. Voress called the Regular Meeting to order in Commission Chambers at 1:30 P.M. Tawn Clerk Doris Trinley called the roll. The Mayor, Vice Mayor John F. Rand, and Commissioners David Augenstein, Thomas J. Reid and Michael W. Hill were present. Town Attorney Thomas E. Sliney and Town Manager Mary Ann Mariano were also present, as were members of the general public. ADOPTION OF AGENDA Hearing no objection, Mayor Voress declared the Agenda accepted as presented. APPROVAL OF MINUTES • Upon MOTION by COMMISSIONER REID/COMMISSIONER AUGENSTEIN. the following sets of Minutes were unanimously approved: April 29, 1997 - Workshop Meeting April 29, 1997 - Special Meeting May 06, 1997 - Regular Meeting PUBLIC COMMENTS AND REQUESTS Leonard Bell, 2727 S. Ocean Blvd., as.President of the Library Foundation, gave an update on monies received by the Foundation to date. Mr. Bell, as a Planning Board member, then reiterated previously expressed concerns regarding unsightly conditions existing on two (2) properties at the north end of Town, west side, and was advised that the Town Attorney will draft an ordinance to address like situations in the future. (See April 29, 1997 Workshop Minutes.) REPORTS TOWN COMMISSION Vice Mayor John F. Rand had no report, except to reiterate his wish to have a telephone representative address the Commission regarding the whole of Highland Beach having toll call privileges that only some residents now enjoy. Ms. Mariano replied that a phone representative had been invited to today's meeting, but had failed to appear; she said she would follow up on this matter. ~" ~rl'~""-.Lc.e~s of Town Commission Regular Meeting June 03 . 1997 Page Z of 4 Commissioner David Augenstein gave an update on the landscaping plans for the renovation/expansion project. Upon MOTION by COMMISSIONER REID/COMMISSIONER HILL, a $2500 expenditure to have a concept drawn for phase II of the landscaping plans was unanimously approved. Referring to Talent Bank Applications, Commissioner Thomas J. Reid noted that longevity on the list-would seem to preclude appropriate experience for boards requested by applicants; he asked for copies of existing applications for review. Regarding his inquiry as to what type of barrier would separate the north end of the Yacht Club of Highland Beach project from St. Lucy's rectory and church, Commissioner Reid was referred to developer Robert Hall of the Related Group. Commissioner Reid commended the Town Attorney for information he had provided regarding Town Officers and their functions and duties as noted in various sections of Town Code. He further requested that Attorney Sliney provide the same information regarding Commissioner members and Board members, all with a view toward the eventual compilation of a Job Description Manual. This discussion also included review of Town Manager Mariano's memo to the Commission regarding departmental responsibilities, which she read intcs the " record. During discussion, Ms. Mariano stated that she believed these requests were getting into the administration of the Town and she requested that the record reflect this belief. Town Attorney Sliney asked to comment on Ms. Mariano's remarks, saying it seemed to him that while the Town Commission can set policy, he didn't think they "fleshed" things out; so he wouldn't expect that the Town Commission would be doing job descriptions, as that would be the responsibility of the Town Manager. Therefore, Mr. Sliney stated that if from a policy standpoint the Town Commission wanted job descriptions, it would seem to him that's not an administrative point of view, it's a policy point of view. In conclusion, regarding the Commission's request that she provide staff job descriptions, Ms. Mariano agreed to do so, with the Commission's understanding that such project could not be undertaken until the renovation/expansion was completed. There was no objection. (A copy each of Mr. Sliney's and Ms.Mariano's memorandum referred to herein is attached to and made part of these Minutes.) Commissioner Michael W. Hill requested that the Mayor comment on the May 30, 1997 Palm Beach Post article which featured the Town; Mayor Voress-complied with Commissioner Hill's request, following which Commissioner Reid added his remarks. (A verbatim transcript of both Mayor Voress'. and Commissioner Raid's remarks are attached to, and made part of these Minutes.) Mayor Arlin G. Voress had no report. REPORTS - TOWN ATTORNEY own Attorney Thomas E. Sliney reserved his report until first reading of a roposed ordinance regarding telecommunications. ,,. Town Commission Minutes - June 03, 1997 Regular Meeting Page 3 of 4 REPORTS - TOWN MANAGER Town Manager Mary Ann Mariano reported the assessed value of the Town had increased 2.3% as of June 1, 1997 to $722,367,439, up from $706,852,443 last year. The increased valuation figure will be used for the, upcoming budget year. Addressing previous complaints brought forward by Planning Board members Leonard Bell and Alfred Bresnahan about separate unsightly conditions existing on two properties on the north end of Town (See Public Comments), the Town Manager reported she had contacted neighboring municipalities to determine how such situations were handled. Ms. Mariano said only the Town of Palm Beach had an ordinance in place that addressed construction "timetables," and she was advised it was used as a kind of "leverage" for compliance. As previously discussed, it was again noted that Attorney Sliney will draft a proposed ordinance in this regard. REPORTS - BOARDS AND COMMITTEES The Board Action Report was accepted as information, and Board Meetings for June were read into the record. • Board Vacancies were filled by unanimous favorable vote: Miriam Zwick was reappointed to the Community Appearance Board. (Vice Mayor Rand/Commissioner Hill) John DeMarco was reappointed to the Financial Advisory Board. (Vice Mayor Rand/Commissioner Reid) PROPOSED ORDINANCES AND RESOLUTIONS AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH FLORIDA, ADDING ARTICLE XI "TELECOMMUNICATIONS TOWERS AND ANTENNA SITING" TO CHAPTER 6 "BUILDINGS AND STRUCTURES" OF THE CODE OF ORDINANCES OF THE TOWN OF HIGHLAND BEACH, FLORIDA (First Reading) This proposed ordinance was reviewed with the Commission by Attorneys Cormac Conahan and Thomas Sliney, with questions answered to the Commission's satisfaction.
