Mayor Bernard Featherman called the Regular Meeting to order in Commission Chambers at 1:30 PM.
CALL TO ORDER:

6. NEW BUSINESS

7 MISCELLANEOUS — ITEMS LEFT OVER:
A) Commission to approve an extension to the Purchase Contract by Douglas and
Esther Durrett of the Town of Highland Beach owned property located in Boca Raton.
Town Attorney Glen Torcivia — At the last meeting you directed me to add some identifying language
which we picked up from the original contract. This is an amendment to the original agreement. In
addition you directed that there be a step increase of $5,000 for the first down payment, $10,000 for the
second down payment and $15,000 for the third down payment. I presented this to the buyer's attorney.
They agreed to $5,000, $5,000 and $10,000 which is included in the proposed amendment before you, as
that is what they are willing to agree to. Mr. Durrett is here today and would like to address the
Commission. To summarize my conversation with his attorney, they have a lot invested in the project and
they intend to move forward.
Doug Durrett — I would like to address the Commission and answer any question or address any concerns
you might have with our proposal. I would like to reassure you that we are moving forward with the
project. As I indicated the last time, we assembled a team, which I think is the best team, to accomplish
what we are trying to accomplish on these sites. It has been going well and we are moving as fast as
possible and have not run into any roadblocks as yet. We have formerly submitted our site plan to the
City of Boca Raton for the preliminary site plan approvals. We are close to completing our other due
diligence, our environmental studies, our surveys, topos and traffic counts. My team is optimistic that we
can get this done. When I left here last time I thought we had an agreement to the extensions that we
proposed. When I heard from Glen that this still hasn't been approved, it gave us a little concern. We
are certainly doing everything we can to be team players.
Comm. Feldman — I have no problem with the five, five and ten thousand. I feel it is a mute subject
because of the fact that whatever you are doing for the extension of 90 days, you don't have to put up the
3.5 million. However, this money goes towards the purchase price. So what difference does it make what
you put up. I wouldn't even like to see the five, five and ten thousand. What I would like to see is if this
situation is cancelled by you for any reason, you lose your deposit. Your deposit is $50,000. If something
happens at the end, we get $20,000. Mr. Durrett — We had not planned on that. Like most other things
in business, our costs have gotten pretty high on this project now. To date we have spent something north
of $80,000. We are doing things in good faith and this is costing us considerably more than we
anticipated. Unfortunately, I do have a budget and not an unlimited expense account. Comm. Feldman —
I am not saying any more funds. What I am saying is don't put in the five, five and ten thousand. You
have a deposit that is refundable in 180 days. I would like to see the deposit not returned and we all shake
hands, if that is the situation. If something goes wrong, we are left with $20,000 and you get back your
$50,000.

Comm. Stern — Is the 90 days being requested because you are being hung up by Boca, or just in general?
Mr. Durrett — Yes. There are a couple of things that caused our process to move a little slower than we
had originally anticipated. The numbers of steps we have to go through are primarily compounded by the
summer months, where the City only meets once a month. In addition to that, a lot of the subcontractors
could not get the job done as quickly as we had anticipated - environmental studies, traffic studies, topos.
Comm. Stern — I understand Boca Raton has cancelled all their meetings during the summer and will not
reconvene until August 22 Mr. Durrett - We submitted our final site plan last Tuesday and the Board
will meet this month. We should have their feedback this month. We are not holding up the process
waiting on their approvals or comments. We are proceeding to do everything that we can.
Comm. Sheridan — I believe we entered into a contract in good faith and I think so far you have shown
good faith to the best of your ability. I am not in favor of any punishing factor regarding $50,000 if you
don't get it and it is not your fault. I think we should be a little considerate that the delays are not on your
shoulders; it is because of other entities that are coming into the point. I would like to see what happens in
August and see what they come back with.
Vice Mayor Brown I was happy with the five, five and ten and I agree with Dennis. We get the money
and you get your deposit back. I hope it goes through.
Mayor Featherman — I agree with what was said and I would like to see the sale go through. I am sure
everything is being tried in good faith.
MOTION: Vice Mayor Brown moved to accept the first amendment to the Contract for Sale and
Purchase between the Town of Highland Beach and Douglas T. Durrett and Esther Durrett with a revised
date of August 5, 2013. Motion was seconded by Comm. Sheridan.

B) Commission to Declare certain Property Surplus and Authorize Disposal.
Town Manager Weiser — There is a memo in your agenda for Town owned property to be declared
surplus. There were some questions regarding how these were auctioned off. We have included, in your
packet, a copy of what the public surplus website looks like and we can answer any of your questions;
otherwise, we ask approval to declare the list of items surplus.
Town Attorney Torcivia — There were some questions about a conflict of interest for town employees
bidding on them. There have been a number of Commission ethics opinions on that topic and what they

say is "There is no prohibitive conflict of interest for a town employee to bid on a purchased town surplus
property that is auctioned off. However, if an employee was involved in the acquisition or disposition,
then a prohibitive conflict of interest may arise." If the person making the decisions and putting it on the
website has some inside information that is the concern. Normal town employee bidding on a piece of
property is no different than anybody else; especially since this is a public auction.
MOTION: Vice Mayor Brown moved to declare the property surplus and authorize disposal. Motion
was seconded by Comm. Sheridan

8 REPORTS — TOWN COMMISSION:
A) Commissioner Carl Feldman — This past week I had a very interesting meeting with the
Police Chief. There were a lot of questions presented by both myself and the Chief. It was a very
productive meeting and the Town of Highland Beach is very fortunate to have a Chief of the caliber of
Chief Hartmann.
B) Commissioner Louis P. Stern — I second what Commissioner Feldman just said. An update:
Comm. Sheridan, the Mayor and myself are on the Advisory Committee of Protect Our Beaches, and I just
bring to your attention a recent meeting that was held at the end of June, which was headed by
Congresswoman Lois Frankel and Congressman Patrick Murphy. They gathered five organizations in
charge of beach development and protection; the Army Corp of Engineer, Fish and Wildlife, Marine
Fisheries Management, Department of Environmental Protection and Department of Environmental
Resources Management. Senator Bill Nelson's office was also well represented. Maybe by our belonging
to Protect Our Beaches, it may not ever help our beach per se, but it certainly might get us an edge
towards some things we might need with the organizations that control our waterways.
C) Commissioner Dennis J. Sheridan - My feelings are the same towards our Chief. I think he is
outstanding and the job that he has done is certainly commendable. We are grateful for that. There is a
turtle walk this coming Saturday at 7:00 a.m. and people are more than welcome to park their cars at either
the Monterey House or the Penthouse Highlands and walk across on our easement to the beach. I am
happy to report that the sign has been erected at the old Azure Property at 3200 S. Ocean Blvd. It was put
up today and I spoke to the owner who indicated that things were progressing and going very well on that
property.

E) Mayor Bernard Featherman — The Mayor of Palm Beach County indicated that there was no
way we could get any funds for our beaches since it was a privately owned community and not publically
owned.
9. REPORTS — TOWN ATTORNEY:
I am looking forward to seeing everyone at the League Conference. There have been some questions
about when your spouse is accompanying you to these conferences. I will have a memo to everybody as
to whether you need to report it as a gift. Beverly told me there was a Resolution passed and I need to
look at it. Generally, if you are traveling in your car and your spouse is with you in the car; that is nothing
at all. However, if the Town paid for the registration to attend the conference, then there is the question
whether a gift has to be recorded. This question has also come up with a number of towns.
10. REPORTS — TOWN MANAGER:
Most of you feel like you are ethics out, but the Palm Beach County Commission on Ethics has their
mandatory ethics training that you have to go through every two years for all employees and elected
officials. It has been two years since we went through that training and we will be scheduling those
classes this month.
11. CONSENT AGENDA
Mayor Featherman asked if any item needed to be removed from the Consent Agenda.
Mayor Featherman — Town Clerk would you please read the items on the Consent Agenda and we will
vote for them one at a time. Town Clerk Brown — On the Consent Agenda we vote for everything with
one motion. Mayor Featherman — There may be a question on one or two of them. Town Clerk Brown —
If any Commissioner wants to remove an item from the Consent Agenda, it should be removed prior to the
reading of the Consent Agenda. Does anyone want to take anything off the Consent Agenda before we
start? Mayor Featherman — We want to take off Item E. There are additional questions that have to be
answered on that. Comm. Feldman — That wasn't supposed to be on the Consent Agenda. It was
supposed to be a separate item. Town Clerk Brown — You need to talk about that first if you are going to
take it off. Town Manager Weiser — You need a motion and a second if you want to remove this item
from the Consent Agenda and if you would like to discuss it more.
MOTION: Comm. Stern moved to remove Item No. E (Commission to authorize transfer of Town's
Dispatch/Communications Services for Police and Fire protection to the City of Delray Beach) from the
Consent Agenda and place it on Old Business for today to discuss. Motion was seconded by Comm.
Feldman
A voice vote taken. Vote passed 4 — 1, with Vice Mayor Brown voting against the motion.

Comm. Feldman — I discussed this in great detail with Chief Hartmann. I am 100% in favor of this as I
was before. The only question I have is did we do our due diligence in this matter. First, did we go to the
Federal government when there is an issue of 911? There are monies that they can put over to the towns
because of the fact that we have had unsatisfactory service. I don't think we have done that yet. Second,
have we gone back to the Palm Beach County and given them notice that we are considering this at this
time; just not cutting them dry. Have we discussed this with them and could they rectify the problem?
The third is have we done any serious negotiations on the $54,000 with Delray? What does it cost them
for a call for themselves; not based on another town? The other town that they are basing this on does not
even have a fire station or any equipment. It is all Delray's equipment and personnel. That could warrant
why they are willing to pay the $54,000. 1 am wondering if these three things should be addressed before
we give them a carte blanche to go forward. Also, in 2017 this contract comes up for the fire rescue
squad with Delray. If we want to start looking around and negotiate with the Town of Boca, we will have
to start doing that in the year 2015. So, in 2014 we would have to put out our feelers. If we did want to
switch to Boca, we would have to change the 911 also to Boca. As the Chief said, you can't be with the
police and rescue one and with the 911 with a second one. These are some of the concerns I have.
Comm. Stern — I would like to have Chief Hartmann address the concerns which Comm. Feldman has
brought to us.
Police Chief Craig Hartmann — I do not have specific details for the points that were raised today.
Town Manager Weiser — I would have to look into the 911 Federal government funding. I think what you
are talking about, and this is years ago since I have seen it, concerns specific issues. We don't have an
issue with the County service. There is nothing to correct. They provide us service. What we have is a
problem where it goes through them to another agency to our agency. Comm. Feldman — I understood
there is a problem because we have dropped calls, number one. There is a delay in getting the
information to the proper facilities in our town and I consider that a problem. Town Manager Weiser —
The delay is because we get our service through Delray Beach. Comm. Feldman — That all involved could
be enough to shake some trees and get us some funds from the Federal Government. Town Manama
Weiser — We could look into it. It is our choice to go with Delray Beach for fire service. Right now we
have it dispatched through the County. It is not going to be rectified by telling the County we do not want
you to direct the call where it needs to go. We would be the ones, through this contract, who would be
eliminating that step. Mayor Featherman — Calls go directly to Delray on the fire department information
and they control the fire department personnel, so they have that information right away. From my
understanding, the police department gets a call directly from West Palm Beach. Is that correct? Chief
Hartmann No, it is not. All our emergency calls, 911 calls and the emergency police number that the
town has (276- 2458), all of those calls go directly to the Palm Beach County Sheriff's office. The only
thing that goes to Delray Beach for their fire rescue is the fire or EMS emergency calls. What happens is
the call goes to Palm Beach. If it is a fire or rescue call it is then transferred to another communications
center which is Delray Beach. They are the ones that take it through their system with trained dispatchers
and then they dispatch their fire. The Sheriffs office dispatches to just the police. The two cities do not
communicate through the same dispatch center. It has to go through different dispatch centers to relay
messages. The proposal was to eliminate that redundancy of a call going completely someplace else, to
another entity, when it can go right here and then be dispatched to the police or fire.

Mayor Featherman — It is my understanding that there are approximately 1300 calls a year; about 525 calls
go for the fire emergency ambulance; about 199 calls go for the Fire Dept. The rest go for the Police
Dept. We have about a 400% increase in our cost and I feel we need more information. The 911 calls go
directly to the Police Dept. from West Palm Beach. Chief Hartmann — They dispatch the calls over the
radio.
Comm. Feldman — If someone calls the emergency police number, where does that go? Chief Hartmann —
There is no emergency number for the Highland Beach Police Department. What we have here in Town is
the administrative office which is opened the same hours as Town Hall. Someone could call to report an
issue and speak to a Police officer. We don't want someone calling after hours when no one is there. We
want your community to call your dispatch center because that is the one that is manned twenty -four seven
by trained people. We cannot dispatch from Highland Beach. Right now, the Delray Communications
Center picks up a call from the Palm Beach County Sheriff's office (fire, police, EMS, etc.), then sends it
to Delray. If you decide to change this, all calls will go directly to Delray. Their volume will increase
significantly and they would be responsible for dispatching directly to our police officers along with the
fire department people that are here. That communication can occur through one radio system as opposed
to two different separate entities that you now have.
Comm. Stern — I do think Comm. Feldman has brought up a couple of questions that have been bothering
me so I will go ahead and reiterate them. Does Palm Beach County know we are thinking of making a
change? Chief Hartmann — Yes, I spoke to someone in charge there. They are aware of it and it is not an
issue for them. Comm. Stern — The expense per call is way out there; yet, when someone does call Palm
Beach County, it is transferred back to Delray. Isn't it really the same person answering for the same
telephone call; so why is there such a new high expense for that same call? Chief Hartmann — The
increase of calls will come in through that center. They only get a transfer call if the fire dept. is needed;
but if you call right now and you only need the police on a police matter, that fire dept. doesn't handle that
call, doesn't dispatch the call, take the time on the board with it or enter it into their cad reporting system.
There will be additional police, 911 calls or emergency calls. That call center will take on everything that
happens here as it does with Gulf Stream or other municipalities that share in with bigger agencies over
the bridge. Comm. Stern — Maybe not commensurate with the additional amount, but we certainly are
still thinking safety first and not dollars. Comm. Feldman said we should start looking and see if Boca
could help us. I don't know that Boca is an answer now or three years from now, but it is something we
should look into. If we do transfer the center now to Delray, we would have to tell Boca, if we are
negotiating with them, that we would have to again switch to their service. Chief Hartmann — That's a
package deal. We are trying to create what is best for the residents. If they are calling into a local
dispatch communications, they are getting the more local personalized service that is here and not flooded
into the biggest dispatch center in the County. You take on everything for a community. If you don't,
you are back to square one. Comm. Stern — It boils down to we are going to make a change. If we make a
change in two or three years to another agency, I understand that, but I think we have to consider this
change now.
Comm. Sheridan — I feel the communication between these two departments on a local basis is extremely
important. Having the ability to have the fire department talk to the police or vice versa can be lifesaving.
I think that is just an excellent facet of what is available for us to pick up under this new contract.

Vice Mayor Brown — One of our residents, John Ackerman, stated that he has had several calls that were
dropped when he called 911. I also have had calls dropped when I called the direct line to the Palm Beach
County Sheriff's Office. As a Commission, it is important that we make sure we have our security and
protection in place for our residents. If this is what it takes, and we have our Town Manager and Chief of
Police both recommending this, then I think we should go for it.
Mayor Featherman — I don't think we have enough information yet. We have somebody supplying our
services for $40,000 less than what we are being quoted now. There is such a thing as loyalty to a supplier
whether it is in government or private business. West Palm Beach has been taking our calls for how many
years. Town Manager Weiser — I would say since the early 70's.
Mayor Featherman — Have we talked to them about anything where there were drops and what type of
fields they were? Chief Hartmann — I have dealt with several people in the community on different issues
over the years. Mayor Featherman — You worked for the City of Delray Police Department. Were they
giving you good service and what was your experience with the calls coming in to them? Chief Hartmann
— They are an accredited agency just like the Sheriff's office in their dispatch center. All of the City of
Delray calls, emergency and non - emergency, go into that dispatch center along with the Town of Gulf
Stream who has been doing that for a couple of decades.
Comm. Feldman — We do have a situation where we can go to the Federal Government, dropped calls, no
dispatch, etc. I think the Federal government, with the 911 situation, can do something for us if we apply
for it. Town Manager Weiser — We could look into it. Do you know what this grant is because I would
think in these types of situations there is a criteria, or every single community who uses dispatch would be
going to the Federal Government to pay for their dispatch.
Vice Mayor Brown — I think we could go ahead and press on with this and look into the federal funding
911.
MOTION: Vice Mayor Brown moved to authorize the transfer of the Town's dispatch communication
service for Police and Fire protection to Delray Beach. Motion was seconded by Comm. Sheridan with
the understanding that if Comm. Feldman or the Town Manager does succeed with something to 911 it
could be applicable to the contract.

Comm. Feldman — During the presentation by Chief Hartmann, he indicated that we had up front charges
of $25,000. Maybe they would take that off the first year of payments. Chief Hartmann — We have had
discussions, and we were going to put something in writing, that there were start-up costs that would incur
to do this. That would be part of the first year type of contract. There are additional fees that go as you
pay for the County, which we would come out of and not have to pay. Some years we are paying about
$20,000, County fee, the Sheriff s office fee; so when you break it down, it is probably a little less than
$40,000 a year total in additional costs year to year. That is if nothing changes with the Sheriffs office.
There have been negotiations with Delray. We try to understand what we are paying now; that it would be
an increase for this town and for them to look at that. This fee was established for what it would take
them to do. Comm. Feldman — Before we sign the contract, could we at least do that? Chief Hartmann —
Yes and that is what is happening now. See what costs they would cover that would be of a burden to the
town. Town Manager Weiser — You will have the contract to look at and you will have to actually
approve the contract. This might help you grasp the cost because most of you live in condos; they are not
charging us what it would cost to do it. You are buying into a pie that is already there. We are buying
into a system. We have gone back and forth with them and they have paid all the fees to establish this
system and we are buying into it. Comm. Feldman — What we voted on today is to go forward with
negotiations. Town Manager Weiser — That is correct. Vice Mayor Brown — No, we voted to authorize
transfer of Town's dispatch communication service for Police and Fire protection to the City of Delray.
This is a done deal. Town Attorney Torcivia — What Kathleen and I were both thinking was that you
authorized the transfer but now it has to be a contract. Vice Mayor Brown — There is a contract attached
to our packets. It has already been drawn up. Town Manager Weiser — You have approved signing the
contract as is. We will look into if there is any federal funding, and if that should impact our monies that
we budget, we will come back to you with that. Vice Mayor Brown — That was the only caveat in my
motion. If there is money for 911, we would look at that; not that we would renegotiate. Comm. Feldman
— What about the money the Chief was talking about? That isn't in the contract, so how is it going to be
brought up. Chief Hartmann — That was already explained to them. It will have to be in writing. They
will have to make the decision as to whether or not they will approve that for additional costs now for the
first year. Nothing of the contract will change.
