1996.03.26_TC_Minutes_Workshop,+ TOWN OF HIGHLAND BEACH MINUTES OF TOWN COMMISSION MEETING WORKSHOP MEETING Tuesdav, March 26, 1996 1.30 P M Mayor Arlin G. Voress called the Workshop Meeting to order in Commissioner Chambers at 1:30 P.M. Town Clerk Doris Trinley called the roll. The Mayor, Vice Mayor John F. Rand and Commissioners Arthur Eypel, David Augenstein and Thomas J. Reid were present. Also present were Town Attorney Thomas E. Sliney and Town Manager Mary Ann Mariano, as were members of the general public. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA The Agenda was amended to allow for the Drexel presentation to be presented immediately after Public Comments and unanimously accepted upon MOTION by VICE MAYOR RAND/COMMISSIONER AUGENSTEIN. 96.1 PUBLIC COMMENTS AND REQUESTS . Leonard Bell, President of the Library Foundation, gave a brief report of his successful progress on its behalf thus far, and requested to be placed on the agenda for the April or May Workshop Meeting, at which time he would be prepared to give a more detailed report. DREXEL PROPERTY PRESENTATION Architect Roger Fry presented a rendering of the project to be built on the Drexel property (situated between Town Hall and St.Lucy's Church). Mr. Fry stated it would be a secured (gated) rental community, consisting of two 11-story towers flanked by townhouses on AlA and the Intracoastal; there will be a total of 200 units, 40 one-bedroom and 160 two-bedroom. Building Official Edward G. Hardy advised that proposed setbacks, heights and densities were well within the parameters of the settlement agreement. Questions posed by the Commission were answered to their satisfaction, and it was the consensus to move approval of the project to the April 02, 1996 Regular Meeting Consent Agenda. (A copy of a Code category comparison submitted by representatives of the project is attached hereto and made part of these Minutes.) 96.2 BOARDS AND COMMITTEES Mayor Voress noted that Leonard Bell, who is eligible for reappointment to the Code Enforcement Board, had advised that because of his involvement in other Town-related activities, Town Commission . Workshop Meeting - Minutes March 26, 1996 Page 2 of 5 Mr. Bell would be willing to relinquish his seat. The Mayor also advised a vacancy on the Financial Advisory Board, created by Thomas J. Reid's assuming a Commission seat. Further consideration will be given to filling these appointments at the April Regular Meeting. There was no Board/Committee correspondence to address. 96.3 PROPOSED ORDINANCES AND RESOLUTIONS AN ORDINANCE AMENDING THE TOWN CODE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, CHAPTER 6, ENTITLED "BUKDINGS AND STRUCTURES," SECTION 6- 52, ENTITLED "AMENDMENTS" TO PROVIDE FOR AN AMENDMENT TO THE STANDARD BULDING CODE, SECTION 1015.1, SETTING MINIMUM GUARDRAIL HEIGHTS FOR SINGLE FAMILY .HOMES. Mayor Voress noted this proposed ordinance had been given first reading on March 5 and published on March 8 , with final reading and possible adoption scheduled for the April 02 Regular Meeting. There was no discussion. i 96.4 REVIEW SPRING EDITION OF TOWN COMMUNITY NEWSLETTER The Spring edition of the Newsletter was reviewed and amended to include an invitation to all residents to attend the various meetings; also, that Town Commission meetings are televised on Government Channel 12. At this time, Vice Mayor Rand suggested that residents be appraised of Adelphia Cable's extended scheduling coverage as discussed by their representative, Chuck Blaine, during the course of the franchise renewal process. Town Manager Mariano said she will contact Mr. Blaine in this regard. MISCELLANEOUS - ITEMS LEFT OVER The Status of Building Development in Town was accepted as information; there was no discussion. Four (4) sets of Minutes were moved to the April Regular Meeting Agenda for further consideration and possible approval: February 27, 1996 - Workshop Meeting February 27, 1996 - Special Meeting March 06, 1996 - Regular Meeting March 13, 1996 - Special Meeting/Canvassing REPORTS - TOWN COMMISSION . Town Commission Workshop Meeting - Minutes March 26, 1996 Page 3 of 5 Commissioners Arthur Eypel, David Augenstein and Thomas J. Reid had no reports. Under his report, Vice Mayor John F. Rand advised of several statistics relating to the recent municipal election, among which was that 38.3% of the Town's 3,106 registered voters cast ballots. Vice Mayor Rand offered that anything which could be done to encourage a greater percentage of voter turnout should be considered; for example, a sign placed in front of Town Hall a few days before an election as a reminder that one is scheduled. Vice Mayor Rand said he would like to see at at least a 50% turnout in the future. (A copy of the Vice Mayor's remarks are attached to and made part of these Minutes.) Mayor Arlin G. Voress reported on several issues: .It had been advised that the sale of the "Hidden Harbor" property by the Resolution Trust Corporation had been unsuccessful. The property is now under the jurisdiction of the Federal Deport Insurance Corporation (FDIC) and will most likely be back on the market through a real estate firm by the summer of this year. . .Regarding the jurisdiction of the westward movement of the Coastal Construction Control Line in Palm Beach County, The Mayor advised he had attended a meeting with the Director and Deputy Director of the Department of Environmental Protection (Virginia Weatherall and Kirby Green) held on March 13 in Tallahassee. Others in attendance were Palm Beach County Commissioner Mary McCarty, LeRoy Parley of Manalapan and other legislative representatives. Ms. Weatherall had advised that rather than a legislative bill wherein the DEP would delegate the jurisdiction of the movement of the line to the County, she would prefer to assign two (2) people, scientifically and technically oriented to work with the County to develop a new CCCL. This concept was agreed upon and following the meeting, Commissioner McCarty sent a letter to Kirby Green reiterating the terms of the agreement and proposing to proceed unless otherwise notified. .Per Attorney Kevin Ross, application for the Library Foundation's tax-exempt status has been made. .Congressman Clay Shaw has formed a House Coastal Caucus to fight President Clinton's proposed significant reduction of federal beach renourishment funds nationwide. Among others, Congressman Shaw has been joined in this effort by Senator Connie Mack and Senator Bill Bradley of New Jersey so that federal funding for such projects can be restored to the federal budget. In this regard, the Congressman has asked that municipalities endorse these efforts by adopting a an appropriate resolution and sending copies to Congress. Mayor Voress advised he will submit a proposed resolution to the Palm Beach Municipal League, who will in turn seek support from at least the 20 .coastal communities in the County. Town Commission i Workshop Meeting - Minutes March 26, 1996 Page 4 of 5 .Mayor Voress advised that while he was prepared to ask for further discussion at this meeting regarding amending the Code to include mandatory impact resistant glass and/or hurricane shutters on all new construction and major renovations as recently adopted by the County effective 10/01/96, it would be unnecessary because, thanks to research by Building Official Edward G. Hardy, it had been ascertained that the Town's Code allows for adoption by reference of such amendments to the Standard Building Code as adopted by Palm Beach County. In this regard, Town Attorney Sliney suggested that this pertinent information be appropriately displayed in the Building Department so builders/developers will be aware. (A copy of the applicable Town Code is attached hereto and made part of these Minutes.) .The Palm Beach Municipal League is working with the County Commission and the School Board to seek a better resolution regarding the generation of funds for the County's school system. Mayor Voress asked that this issue receive full tax-payer attention, as securing these funds could result in an increase in property tax taxes or a one-cent additional sales tax. .Concluding his report, Mayor Voress advised that he had again this . year asked to be a candidate for the Board of Directors of the Municipal League, District IV, which will be addressed by the League at its meeting scheduled for March 27. REPORTS - TOWN ATTORNEY Town Attorney Thomas E. Sliney had no report. REPORTS - TOWN MANAGER Town Manager Mary Ann Mariano gave an update on proposed Town Hall renovations, saying she had continued to work with Peter Ince in this regard and also was planning to meet with a "space planner" who had expertise in library and office space needs. She suggested a special workshop meeting be held on Wednesday, April 24, at 11 AM, at which time more definitive space needs and costs for the entire project will be available. Ms. Mariano next requested Building Official Hardy to address the request for a sales trailer for Byrd Beach Estates for a one-year period. The Commission then reviewed the plans with Mr. Hardy, who advised that all Code requirements had been met. It was the consensus to move this request to the April Regular Meeting Consent Agenda.
