Granting of the variance will be in harmony with the general purpose and intent of the ordinance, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Chapter 30, Zoning Code /Article III; Sec. 30- 40(h): A variance, when implemented in accordance with the approval granted by the Board of Adjustment and Appeals, shall run with the land in perpetuity. Unless a lesser time is approved by the Board of Adjustment and Appeals, a variance that is not implemented shall expire eighteen (18) months following approval. Extensions of variance approvals shall not be granted by the Board of Adjustment and Appeals. The purpose of a variance is to grant a reduction in the dimensional requirements of this Chapter, including but not limited to lot width, lot depth, lot size, size or percentage of open space, building coverage, building height, building setbacks, or required number of parking spaces. (b) Board of Adjustment and Appeals. Requests for approval of some variances shall be considered only by the Board of Adjustment and Appeals. The Board of Adjustment and Appeals may approve, approve with conditions, or deny a request for a variance from the requirements of this Chapter. (c) Applications. Applications shall contain the information as may be required by and shall comply with the requirements of Article 3. (d) Public Notice. Public notice for public hearings to consider variance applications shall be � provided as required in Article 3, Section 16 of this code. (e) Consideration of Applications. As a basis for consideration of an application for variance approval, the Board of Adjustment and Appeals must determine on application is consistent with the criteria listed below. (1) Special Conditions. Special conditions and circumstances exist which are 5 peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same zoning district. j. a: (2) Hardship. The special conditions and circumstances truly represent a hardship, and are not created by any actions of the applicant. (3) Literal Interpretation. Literal interpretation of the provisions of this Chapter would.deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of this Chapter and would work unnecessary and undue hardship on the applicant. (4) Special Privileges. The grant of a variance will not confer upon the applicant any special privilege denied to any other owner of land, buildings, or structures located in the same zoning district. (5) Minimum Variance. The variance granted is the minimum variance that will make possible the use of the land, building, or structure. (6) Purpose and Intent. The grant of the variance will be in harmony with the general intent and purpose of this Chapter. (7) Financial Hardship. Financial hardship is not to be considered as sufficient evidence of a hardship in granting a variance. (8) Public Welfare. The grant of the variance will not be injurious to the area involved or otherwise detrimental to the public welfare. (f) Approvals. In granting a variance, the Board of Adjustment and Appeals may approve such conditions and safeguards deemed necessary to conform to the intent and purpose of this Code. Violations of such conditions shall be deemed a violation of this Chapter. The board may also prescribe a reasonable time limit to initiate the action granted by the variance and to complete such action. Failure to initiate and complete an approved variance shall render such approval null and void, and the approval shall expire. (g) Required Vote. The vote of at least four members of the Board of Adjustment and Appeals is necessary to grant a variance from the requirements of this Chapter. (h) Run with the Land. A variance, when implemented in accordance with the approval granted by the Board of Adjustment and Appeals, shall run with the land in perpetuity. Unless a lesser time is approved by the Board of Adjustment and Appeals, a variance that is not implemented shall expire 18 months following approval. Extensions of variance approvals shall not be granted by the Board of Adjustment and Appeals. (1) Variance Null and Void. A variance granted by the Board of Adjustment and Appeal shall automatically be null and void in any of the following circumstances: (1) demolition of structure which was granted a variance; (2) removal of a structure which was granted a variance; or (3) other similar action which eliminates the reason for granting the variance. Q) Use Variances Prohibited. The Board of Adjustment and Appeals or any other body, unless specifically authorized by this Chapter, shall not grant a variance to establish or expand a use not allowed as a permitted use or special exception use in any zoning district, or a use not allowed within a residential planned unit development. (k) Other Lands and Uses. Evidence of nonconforming use of neighboring lands, structures, or buildings in the same zoning district or the permitted use of lands, structures, or buildings in other zoning diStricts shall not be considered con0dered grounds for the authorization at a vanance. (1) Variance from Development Standards Prohibited. The Board of Adjustment and Appeals, unless specifically authorized by this code, shall not grant a variance from the development standards regarding uses as set forth in Table 30 - 4. (m) Findings. (1) The Board of Adjustment and Appeals shall make findings that an application for variance approval has complied with the requirements of this Section. (2) The Board of Adjustment and Appeals shall further make a finding that the reasons set forth in the application justify the granting of the variance, and that the variance is the minimum variance that will make possible the reasonable use of the land, building, or structure. (3) The Board of Adjustment and Appeals shall further make a finding that the granting of the variance will be in harmony with the general purpose and intent of this Chapter, and will not be injurious to the neighborhood, or otherwise detrimental to the public welfare. (n) Appeals. Appeals of the decisions of the Board of Adjustment and Appeals shall be filed with the Fifteenth Circuit Court in and for Palm Beach County. Appeals shall be fled within 30 calendar days following the decision by the Board of Adjustment and Appeals. (o) Limitations. Whenever the Board of Adjustment and Appeals has acted on a request for administrative review or variance, the Board shall not consider any request for . substantially the same action for a period of one ( 1) year from the date of the initial decision. (p) Interpretations, Decisions, and Appeals. (1) Appeals of a decision, order, requirement, determination, or interpretation of the Building Official or other Town official regarding the provisions of this Chapter shall be filed with the Board of Adjustment and Appeals. (2) Appeals shall be fled on an application established by the Building Official. (3) The appeal shall be considered by the Board of Adjustment and Appeals not more than 30 days following receipt of a complete application by the Building Official. Applicant requests the Town to grant a variance from the requirement of a minimum lot width of 80 feet, and grant a variance to reduce the minimum lot width to 45 feet for two (2) zero lot line homes located within and platted within the following legally described property (hereinafter "Property"): The South 100 feet of that part of Section 4, Township 47 South, Range 43 East, lying East of the East right -of -way of State Road A1A, as the same now exists. Said lands lying and being in Palm Beach County, Florida. Parcel Control No. 23- 43- 47 -04- 000 - 006 -0240. Applicant hereby submits the following reasons and criteria for the Board's granting of the variance: 1.0 The Property is a 100 feet wide lot, which is zoned RML that allows six (6) units per acre. The acreage of the Property is .7257 acres, which would allow 4.35; or four (4) units on the Property. The property owner is desirous of lowering the density from four (4) units to that which it has determined through extensive market research through its real estate broker, and other knowledgeable professionals to a lower density of two (2) units per acre. To accomplish this, the zero lot line configuration is the most desirous method, as it affords the owners /purchasers of the two (2) properties fee simple ownership. Market research has indicated that one (1) freestanding home to support the land cost would have to be in the $15,000,000.00 to $20,000,000.00 range, which market, the owner has determined through research, could have a holding period of two (2) to four (4) years before sale of the mansion, which would have to be constructed to support land value, which is undesirous for the owner as well as the Town of Highland Beach. Having a property of that magnitude on the market vacant that long of a period of time is not desirable. Further, having a condominium form of ownership and creating a condominium building of approximately two (2) to four (4) units is also not desirable, as it is not the most saleable product pursuant to this market in accordance with the current market conditions. Based upon extensive market research and supporting information, which shall be presented to the Board, two (2) fee simple units is the most desirable and saleable project. To accomplish two (2) zero lot line homes, with a 100 foot width of the Property, the minimum lot width required pursuant to the Town of Highland Beach Codes and Ordinances of 80 feet would have to be reduced to 45 feet. Accordingly, applicant requests that the Board of Adjustments and Appeals grant the variance reducing the minimum lot width from 80 to 45 feet. 2.0 This is not a self- imposed hardship but is dictated by market conditions, and the applicant's desire to reduce the density on this Property. The applicant is legally entitled to build four (4) units upon the Property, but based upon its desire to reduce the density and limitation upon the 100 -foot width of the Property, the variance is necessitated to properly plat and divide the lot into two (2) 45 -50 foot zero lot line homes. This is not a self - imposed hardship and is not created by actions of the applicant but is created by market conditions in what is still an extremely difficult residential market and upon the applicant's desire to try to not maximize the density of the Property. 3.0 Other instances of zero lot line homes located within this zoning category of the property located in the Town of Highland Beach shall be shown to show that the Town has created this precedent in prior instances, and accordingly, the application is not asking for any other relief or variance which has not been previously granted by the Town to similarly situated property owners. 4.0 Special Conditions The extremely difficult real estate market and desire to minimize density has created special conditions and circumstances, which are peculiar to this 100 -foot wide Property and may not be applicable to other land structures, buildings or zonings. 5.0 Hardship The current real estate market conditions present a hardship not created by any actions of the applicant. 6.0 A literal interpretation of the applicable provision of the code shall deprive the applicant of rights being enjoyed by other properties in the same zoning district. The Board has granted variances for zero lot line homes in many previous instances and this request has previous precedent. 7.0 Minimum Variance The variance requested is the minimum variance that will make it possible to use the land to build a structure in a manner in which the applicant, through extensive market research, has determined is a saleable project. 8.0 The granting of the variance will be in harmony with the general intent and purpose of the code and it is consistent with past variances granted to other properties, and the Project which, as proposed, is consistent with other projects in the vicinity of the Property. 9.0 Financial Hardship Financial hardship is not present in this request for granting of a variance. 10.0 Public Welfare The grant of the variance will not be injurious to the area and otherwise detrimental to the public welfare, and, in fact, is necessitated by the applicant's desire to reduce the maximum allowed density upon the Property and to avoid having a vacant project for a prolonged period of time on the market, which inures to the benefit of the public welfare.
