REGULAR MEETING

Mayor Bernard Featherman called the Regular Meeting to order in Commission Chambers at 1:30 PM.
CALL TO ORDER:
Roll Call: Members present: Mayor Bernard Featherman; Commissioner Doris M. Trinley; Commissioner
Dennis J. Sheridan; and Commissioner Louis P. Stern. Vice Mayor Ron Brown was absent. Also present:
Town Attorney Glen J. Torcivia; Town Manager Kathleen D. Weiser; Town Clerk Beverly M. Brown; Public
Works Director Jack Lee; Finance Director Cale Curtis; Assistant to the Town Manager Zoie Burgess; and
members of the public.
Pledge of Allegiance: The Pledge of Allegiance was given, followed by a minute of silence.
Civility Pledge: The Civility Pledge was recited by the Town Clerk.
1. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA
Mayor Featherman asked for any additions or deletions.
Commissioner Sheridan — Would like to add Resolution 13 -002 R, a revision to Resolution 11 -006 R
Financial Advisory Board to the agenda.
Town Clerk Brown — Would like to add Resolution 13 -001 R Canvassing Board to the agenda.
MOTION: Comm. Stern moved to accept the Agenda as amended. Motion seconded by Comm. Trinley.
A voice vote was taken with all in favor.
2. PUBLIC COMMENTS AND REQUESTS
Carl Feldman, 3210 S. Ocean Blvd — The most pressing matter that we have before us is the walkways.
People have fallen on multiple occasions and there are legal implications. I know the Town is insured but, if
you Commissioners neglect your fiduciary responsibility, you can be sued as well as the Town. We have

some residents in the auditorium today that have fallen on the walkway and will tell their story. I hope this
will jar you Commissioners into action.
Rhoda Zelniker, 3912 S. Ocean Blvd — My husband Marvin and I are full time residents at Regency
Highland. I am currently a member of the Board of Directors of the Regency Highland Condo Association
and I am here today to represent the 220 unit owners. We have chosen all of you to represent us. Our safety
and well -being must be your top priority. Highland Beach is a wonderful place to call home, but there is
some trouble in paradise. People are getting hurt on our broken sidewalks. A few years ago I went for a walk
and tripped on a patch of uneven sidewalk and broke my right elbow. I toughed it out, but why should this
have happened? Last week my neighbor across the hall fell on our sidewalk and broke her arm in three
places. Replacement of our sidewalk must be your priority. I understand that last summer $75,000 was
allocated for the repair of our sidewalk. I walk the walk every day, and no repairs or replacements have been
started. We, the people of Highland Beach, need a new sidewalk. A repair patch job will not solve the
problem. If we have money for questionable building projects, we should have the money for hazardous
sidewalk conditions. Why put residents at risk when there is an obvious remedy. Please give us a new
sidewalk.
Jim Jiovanazzo, 3700 S. Ocean Blvd — I too have been walking the sidewalks for thirteen years and I do three
miles every morning. Not only are there cracks, but also for an example at Coronado the northern portion
from their driveway the walk path, it is at an angle. It makes it difficult to maintain your balance at times,
particular for us seniors. That has to be taken into consideration. An engineer told me it is possible to have
one of those heavy steam rollers that rolls down, particularly with asphalt, and flattens everything out with the
heat that it has and the pressure. If this is the case, this might be a good possibility for correcting the crevices
that exist on our sidewalks.
Robert Klupt, 3912 S. Ocean Blvd — I want to compliment some of the comments that have already been
made. Apparently the Commission is on notice already of the dangerous conditions and has been on notice
for quite some time. That constitutes negligence on its face. If this continues unattended and people
continue to report broken bones and being injured in more serious ways, I would suggest that this type of
behavior can leave the realm of sovereign immunity and enter into direct accountability because you can rise
to the level of willful and wanton behavior by continuing to ignore it. Particularly if you fund other projects
that don't touch on people's safety and allow this dangerous condition to continue unattended to.
June Wendell, 3912 S. Ocean Blvd — I have walked for years and bike ride on the sidewalk and find that I am
always watching the grass on the side that you can dip or trip into. It seems that all these years nothing has
been done. I think if you walked, your children or your grandchildren walked and they broke a bone and went
to a hospital, how would you all feel. I really feel something should be done.

Commissioner Sheridan — I would like to ask the Town Commission to make some very brief adjustments
to Resolution ' No. 11 -006 R. There are two issues I have and would like to distribute them to the
Commission, at this time, so you can look it. Basically, it only says at the bottom, the Financial Advisory
Board shall elect a Chairman and shall formulate its rules and regulations for the conduct of its business,
which business shall include the following and I inserted: "when directed by the Commission ".
The second change that I have made is I have inserted: "At the direction of the Commission, review and
make recommendations on Town Financial Policies regarding financial, purchasing, investment, budget
and insurance ".
So the only change is that "when directed by the Commission ", and the other is "at the direction of the
Commission ".

COUNTY SUPERVISOR OF ELECTIONS' FACILITY ON MARCH 12, 2013 TO DETERMINE

6. NEW BUSINESS
A) Discussion and Review of BIDS received regarding Walk Path Resurfacing.
Town Manager Weiser — I am going to give a little bit of history because there seems to be some
misinformation floating around from what I am hearing from people. The Mayor and Commissioners put
$75,000 in this year's budget to do repairs of the walk path. That budget goes into effect on October 1; and
that is when that money is available. The Public Works employees came to us and said instead of doing
patchwork we should look at taking out the roots too. Why don't we get a quote because, maybe in doing
that, we could do the entire surface for a little bit more money? We put that bid out on the street, as we are
required to do, and those bids just came back. Instead of being roughly $75,000 to do the patchwork the bid
came in at $115,000. The bid for the entire walk path at $178,000. So, a total to do the root system and the
entire walk path is close to $300,000 which is not what we have budgeted. The Commission is going ahead
and looking at the different bids but they would like to take a look at doing the patchwork now and then
budgeting for the larger project which would probably take place in the near future. That is where we are.
Mayor and Commissioners, we had two bids for the walk path overlay. The tree root removal amount came
in at $115,000 and the entire length of the walk path, the one inch overlay came in at the low bid at
$178,801 for a total cost of $293,908. To do what was originally intended in the budget with the repairs and
removing the roots and leveling out that portion of the walk path would be $115,107. If we do not require a
Bond from Kilbourne & Sons, which is the low bidder, it would save us a little bit of money and that
estimate comes in $109,500. That would be our recommendation. You would need to approve that
expenditure, since it is higher than we budgeted, through the Contingency Fund for the higher amount to do
the repairs.
Comm. Stern — The one question that I may have is what is the length of repair from the Town? Is it the
entire length; is it from Coronado south; what is this $109,000 representing? Manager Weiser — There are
different areas. I am going to let Jack Lee our Public Works Director come up and talk to you about that;
but basically there was, I believe, 12 different areas that would be repaired.
Public Works Director Jack Lee — There is approximately 4500 linear feet that has the roots protruding
through the asphalt and is in very bad condition. Several months ago I asked my Utility Maintenance
Supervisor to go out, walk the path, and figure out the worst areas where the roots are; and that was what we
originally budget the $75,000 for. I think I have always been adamant about my desire to replace the walk
path; at some point, it is going to have to be done. By doing the patch and repair, taking the roots out and
repaving that portion, it would take out most of the trip hazards. At the same time the contractor is taking
those areas of the root problems out, we would take some asphalt from the company and I would get my
men to go out and fill in any holes or cracks that we didn't address when we were taking the roots out. I
can't justify spending $300,000 on a one inch overlay that I think might give you three years versus if you
take and rip out the walk path. I think in June of 2012 I gave the Town Manager a list of options. I think
there were four options; two of them were asphalt the repair and taking out the roots, and the repair and
maintenance of those areas. The other one was for the complete replacement of the walk path, and I am
guessing it was $390,000 to take it out completely and replace it with another asphalt walk path. We had a

third option of replacing it with a six inch thick concrete, and then the other one was stamp concrete. My
recommendation is to do the patch and repair, take out a majority of the trip hazards right now; then
possibly when you do the streetscape project, maybe in two years, you can budget to completely replace the
walk path. Comm. Stern — In other words, we would get a good two to three years out of the repair now.
PWD Lee — The roots from the trees are causing a lot of the problems. Although, as a gentleman stated
earlier, a lot of the walk path is not even. You have edges on the side of the walk path that are crumbling.
This, I believe, would mitigate the chances of somebody falling from a tree root and/or a trip hazard. It is
my understanding that funds were not available to do the complete walk path at this time; so we are just
trying to address the problem areas. Mayor Featherman — I have minutes and notes from June 7` where
they discussed a budget of $75,000 and Chair Gitner asked if the walkway is repaired, how much time will
there be before further deterioration. One of the people said it could be functional for a decade. However,
in hearing what our folks here have said today, we do have to make repairs quickly because there is a
chance that someone could fall and sue us. I think it behooves us to take your recommendation to get
repairs done immediately; and if we have to wait two, three or four years to replace it, then we should do it.
Comm. Sheridan — If the Commission approves this today, how quick is Kilbourne & Sons ready to go.
PWD Lee — It will be four to six weeks. The contractor has a couple of other projects going on right now.
Comm. Stern — Is this the full length that we are actually going to repair? PWD Lee — No, it is a patch job.
Comm. Stern — Are we going to eliminate hazards full length? PWD Lee — Yes
Manager Weiser — For the benefit of the audience, you keep hearing the word streetscape. This
Commission has put in their Strategic Plan, as one of their highest priorities, that they would like to hire an
architect and do an entire streetscape plan for the walk path. Kind of like a linear park where you would
have lighting, entry ways, a decorative walkway and seating. Again, you would need to hire an architect to
make the plans for that and the price tag is much higher. They will be discussing, probably this spring,
about when they want to do that.
Mayor Featherman — When we talked about this, six or seven months ago, we were talking about one
million dollars to do this and it may run considerably more. I would like to see us get this repaired
immediately rather than wait because, if they put it out for bids again, it will be another six months.
Comm. Stem — Where would the shortfall of $34,000 come from? Manager Weiser — It is in our reserve for
contingencies.
MOTION: Commissioner Stern moved to accept the proposal of Kilbourne & Sons for $109,500 to do the
overlay bid repair, waive the requirement for a bid bond, and start immediately. The motion was seconded
by Comm. Sheridan

7. MISCELLANEOUS — ITEMS LEFT OVER:
A) Commission to authorize Town Manager to sign a Contract with Coastal Engineering
Consulting Services of Boca Raton in the amount of $15,158.00, and authorize funding
from the Reserve for Contingency Account.
Town Manager Weiser — The Town put out a RFQ for coastal engineering services to do a feasibility study
that would include different alternatives for beach nourishment and the cost of those alternatives, so we
have some kind of idea as to what is the best alternative and what the cost would be. The residents would
know what the cost would be if they would want to do some re- nourishment study. We have chosen the
firm of Coastal Planning and Engineering who most closely met the requirements we are looking for. We
negotiated a contract in the amount of $15,158. You have this in your packet which was developed under a
very tight time frame, and I would like to compliment the attorneys on both sides of the table. It includes
their scope of services, their contract and our addendum. Our attorney needs to make a couple of changes to
our addendum and I will have him address them. I will need your approval for this contract and your
authorization to take these funds from the Reserve for Contingency Fund. Town Attorney Torcivia — There
are two small changes. In the RFP it said they would provide the Town with certified copies of their
Certificate of Insurance. The company doesn't give certified copies; they just give Certificates of Insurance.
We recommend that the word "certified" be deleted. On their liability insurance, they don't have the ability
to name the Town as an additional insured. It really is not necessary; so if you are okay with that, it will be
deleted too.
MOTION: Comm. Sheridan moved to authorize the Town Manager to sign a contract with Coastal
Engineering Consulting Services in the amount of $15, 158.00 as amended, with funding coming from the
Reserve for Contingency Account. Motion was seconded by Comm. Stern.

8. REPORTS — TOWN COMMISSION:
A) Commissioner Louis P. Stern — Last week, during our workshop, we were told that the bikes come
through Town in packs and it is a hassle for us. It's interesting; on television I have watched a number of
stories from the other side where they are showing people that have been injured by cars that don't heed the
three feet. There is a whole new campaign going on in that direction that it really is not the bikes fault; it is
the vehicle's fault. We have a catch 22 here and we are doing the best we can. I do hope the Police are
giving the tickets that we instructed them to do when they come through in packs.

The second item is that a town calendar was created for Highland Beach this year and, in order to get the
quantity price, we probably printed more than we should have. We have a few boxes left and we would like
to, with the permission of the Commission, contribute to the board's luncheon one for each person who
attends, and that would be on February 22 °d . On March 27 we are hosting the League of Cities Luncheon
for all the communities in Palm Beach County and there will be approximately 125 people at St. Lucy's
Church for that event. I am thinking it would be nice if we gave each of these people one of our town
calendars. That will still leave us with a few, and again with the Town Commission's permission, we would
contact the Holiday Inn to see if they would be kind enough to put one in each room; either they would stay
in the room or someone would take a souvenir home. Hopefully you will give us permission to do that and
we can instruct staff to take care of it.
Consensus was to distribute the calendars as suggested by Commissioner Stern.
B) Commissioner Dennis J. Sheridan — A brief update on our cell site. We have a cell site on the top of
our water tower and it is a Sprint cell site. Sprint was requesting to put additional equipment there with no
advantage to the Town nor offer of any financial incentive. I have been involved with cell sites in my own
building here and any time they put a new piece of equipment up there we get a piece of the action. We
engaged a fellow to represent us and we have finally settled with Sprint and they will pay us an additional
four hundred ($400) dollars a month. We were receiving an increase of fifteen percent (15 %) every five
years. Now it is three percent (3 %) annually.
C) Commissioner Doris J. Trinley —No report, but congratulations to Commissioner Sheridan for a job
well done with the cell tower.
D) Vice Mayor Ron Brown — Absent.
E) Mayor Bernard Featherman — I would like to congratulate the Police Department for bringing in
someone who will make us even firmer as an accreditation of the Police Department for our State. We
talked about the bikers today and I hope the Police Department tickets them aggressively if they don't stop
when people want to cross in the crosswalks. We talked about the Financial Board meeting and I expressed
how I feel that they are doing a good job. I also feel we can get more money for our people here in
Highland Beach by getting financing raises from local banks that are on the approved list. The wake zone is
something we have talked about for over ten years and have come to no decision. We are looking into this
even though it is very difficult to keep the boats from going over 25 miles per hour. Comm. Trinley — How
do you propose to go about this since it has been going on since Hector was a pup? How are you going to
deal with the Fish and Wildlife Commission because the Intracoastal Waterway and our section is already
designated a slow wake zone? Mayor Featherman — This has been going on for a long time and we know
they are in violation. Unfortunately we cannot get the two towns on either side of us to work with us
because they are going through difficult financial times. I don't have an answer but we are looking into it
and will have an answer in the future.

10. REPORTS — TOWN MANAGER:
A reminder that Town Hall will be closed on President's Day, Monday, February 18`
Good news for the Town. We have had a long standing lien on the old Musa property. We received the
lien amount this week; a check in the amount of $47,000. We do have teeth when it comes to Code
Enforcement and this week showed it to us when we got that check.
11. CONSENT AGENDA
Mayor Featherman asked if any item needed to be removed from the Consent Agenda?

12. PUBLIC COMMENTS AND REQUESTS RELATED TO ITEMS DISCUSSED AT
MEETING
Rhoda Zelniker, 3912 S. Ocean Blvd — Just for clarification, are you going to immediately patch and repair
the walkway and within a few years consider a new walkway? The only concern I have, was that the
gentleman from the Town said that a majority of the trip hazards would be corrected. In answer to
Commissioner Stern's question, he did say all of them. I would like the minutes to specify all trip hazards.

There are people in the community that could be involved in this since we walk the sidewalk all the time. I
am a biker and I was told many years ago that we do not have a legal bike lane. What we have are
shoulders. It is a very dangerous situation. Is there any thought about doing something about that in the
future. As a biker I feel it is not always the cars fault. Some of these bikers are unbelievable. They ride in
big packs.
Ann Roy, 4301 Tranquility Drive — I don't understand about finishing the sidewalk eventually. Couldn't
we save a lot of money by resurfacing the sidewalk instead of tearing it up and redoing it? Mayor
Featherman — The only trouble we have is it may cause some delay and may go several more months. The
urgency is noted here and I think we have to move on this quickly. Mrs. Roy — I agree, but my point is that
when we eventually decide to redo the whole thing why tear it up; why not just refinish it? Comm. Trinley
— I would like to remind you that part of digging up the sidewalk has to do with the roots of the trees that are
uprooting the sidewalks. They have to be removed and that is why we are not just resurfacing.
Mike Ferrara, Boca Hi lands — I would like to compliment Commissioner Sheridan on the cell situation. It
is found money. I also want to talk about the calendars. I bought the first calendar and it is a tremendous
calendar. Regarding the attendance at the meetings, this is proof of the pie. You have a problem and people
are here. That problem was the sidewalk situation. I am asking the attorney what is entailed in changing the
fiscal year so the budget can be taken up in October or November and go back to a calendar year so that you
have more people attending the budget meetings. They should be able to ask how you are setting up the
budget. The whole issue of the sidewalk and the liability of the municipality is if you did nothing. You have
done something and have been doing something. You are not neglecting it. Sidewalk falls happen all the
time; homeowners are involved in some towns because the tree is on their property and the town is holding
them responsible.
Robert Klot, 3912 S. Ocean Blvd — I would also like to thank the Mayor and Commissioners for moving
forward on this safety issue. Regarding the statement just made, when you are on notice, as long as you act
in reasonable fashion, it is not an instantaneous yes or no; it is doing something about it and doing
something about it in a reasonable length of time. I want to talk about right of way. Our property has a
double lot on the beach and there is an access walkway. A lot of people are not heeding that access and I
am referring to automobiles, not bicycles; they definitely don't. There is a spot by our building, covered
by trees, that a police car could occasionally park and perhaps accrue some income for the municipality.
There may be some people, who are unaware of the law, but the drivers are becoming belligerent and I
think a message needs to be sent in that regard. Comm. Trinley — Would you agree that the east side of
your property, where the right of way is, is very difficult to see anyone standing there because of the
vegetation? It is much easier when someone is passing from the west side to the east side to see them. I,
myself, cannot see the people waiting to come back from the beach. Mr. Kluyt — Let's approach the west
side first because when I go to the beach, which is almost every day, nobody heeds; especially at the hours
of eight and ten o'clock in the morning and four and six o'clock in the afternoon. I have been caught in the
middle of the intersection. To talk about visibility, you might have a point on the east side. Perhaps we
can get a flashing light out there or another sign to make it more prominent; because, I agree with you, that
it is an important issue. The other issue you have is because of the turtle regulations; you don't have a lot

Carol Stern —1115 Russell Dr . — I have been driving along AIA and there are a swarm of bikers.
Shouldn't these bikers have a person behind and in front guiding them or do they just go. They take up the
whole road; there is no passing them. Mayor Featherman — Bikers have the right to be on the street just
like a car. They should ride two wide only and a lot of them are going four wide. Our Police Department
is aware of this. Mrs. Stern — I am talking about the clubs going through, especially on the weekend.
There could be one hundred bikers and take up the whole road. I feel they should have a person guiding
them in front and back.
Ann Roy, 4301 Tranquility Dr . — I asked a police officer if they give out citations to the bikers. They said
they tried but couldn't because they don't carry identification on them. Couldn't we pass an ordinance that
to ride a bike in Highland Beach you have to have identification, so they could start giving tickets?

There being no further business to come before the Commission, Mayor Featherman adjourned the Regular
Meeting at 2:10 PM upon a MOTION by Commissioner Sheridan; seconded by Commissioner Stern.
