Voress called the Regular Meeting to order in Commission Chambers at 1:30 P.M. Town Clerk Doris Trinley called the roll. The Mayor, Vice Mayor John F. Rand, and Commissioners Arthur Eypel, David Augenstein and Thomas J. Reid were present. Town Attorney Thomas E. Sliney and Town Manager Mary Ann Mariano were also present, as were members of the general public. Following roll call, the Pledge of Allegiance was given. ADOPTION OF AGENDA With no objection, the Agenda was accepted as presented. APPROVAL OF MINUTES • The following sets of Minutes were unanimously approved upon MOTION by COMMISSIONER AUGENSTEIN/COMMISSIONER REID: October 29, 1996 - Workshop Meeting October 29, 1996 - Pub.Hrg./Spec.Mtg.(3:00 P.M.) November 06, 1996 - Regular Meeting PUBLIC COMMENTS AND RE4UESTS Leonard Bell, 2727 South Ocean Boulevard, asked whether the Yacht Club at Highland Beach project was going to be sales or rentals. As President of the Highland Beach Library he also extended gratitude to Felix Goldenson for Mr. Goldenson's service to the Highland Beach Library Foundation. Mr Bell also requested that the Commission explain the distinction between the Library Foundation and the Friends of the Library for the record. It was agreed that that Mr. Bell's remarks would be addressed under individual reports. REPORTS - TOWN COMMISSION Acknowledging major computer problems which necessitated the purchase of new equipment and programs for the Finance Department, Vice Mayor John F. Rand nonetheless expressed frustration in the ongoing delay of availability of pertinent financial information, and asked Town Manager Mariano for an explanation. Ms. Mariano responded, noting the Finance Department was staffed with rather recently hired personnel who, in addition to learning the new . ~ ... • Town Commission Minutes - Regular Meeting December 03, 1996 Page 2 of 4 computer equipment and programs, were working on closing the books for the 1995/1996 fiscal year in preparation for audit; all of these factors had contributed to the overall delay in transmitting financial information to appropriate interested parties. Ms. Mariano did say that there was no problem in accessing State Pooled Investment information for the Vice Mayor' s review, and the Finance Department would be advised that this was to be transmitted to him on a regular basis, as had been done in the past. Commissioner Arthur Eypel also referred to the Yacht Club at Highland Beach project, saying that while fully appreciating owners' rights, he would like a definitive answer as to whether the units would be offered for "sale" or "rent." Attorney Sliney then gave a overview of the property's history through its Settlement of Litigation to its present ownership, noting that the developer's submitted plans conformed with the Town's zoning code for land use, i.e., "multi-family residential;" therefore, it was irrelevant whether the units would be for sale or rent. However, it was agreed by Mr. Sliney, Mayor Voress and Town Manager Mariano that since their meeting with the developer several weeks ago, at which time they had been advised that the units would • be built for sale, they had heard nothing to the contrary. Commissioner David Augenstein had no report. Commissioner Thomas J. Reid had no report. In response to Mr. Bell's earlier request, Mayor Arlin G.Voress distinguished between the Library Foundation and the Friends of the Library, saying that the Foundation was established to solicit capital contributions to the planned Library expansion/renovation; the Friends of the Library was a separate entity whose purpose was to subsidize Library needs on an ongoing basis. Mayor Voress also reported that, at the insistence of the Palm Beach County Municipal League, on which he serves as a Director, the School Board had presented a draft of a 7-year plan, consistent with the proposed 7-year one-cent sales tax regarding the building of new schools and the refurbishing of existing schools. The Mayor said the draft includes (1) the criteria the School Board will use to determine where school facilities should be located, (2) a summary statement of a detailed 7-year plan for building new facilities and (3) a detailed capital improvement plan priority list. Mayor Voress advised the public is invited to give its input and said the draft is available at Town Hall for review. The Mayor also alerted that in 1997 the State of Florida will • initiate a serious "Drive Smart, Florida" campaign against drunk driving whose theme will be "Booze It and Lose It;" he suggested ~ v ~ ~' • Town Commission Regular Meeting - Minutes December 03, 1996 Paae 3 of 4 that everyone should be aware of the growing intolerance toward drunk driving in both the private and public sectors. REPORTS - TOWN ATTORNEY Town Attorney Thomas E. Sliney had no report. REPORTS - TOWN MANAGER Town Manager Mary Ann Mariano advised that Palm Beach County Commissioner Mary McCarty's annual Holiday Party will be held at her South County headquarters on December 19 at 2:30 PM. At this time Vice Mayor Rand suggested that Commissioner McCarty be invited to address the Commission in the near future; Mayor Voress said he would arrange a date in this regard. BOARDS AND COMMITTEES The Board Action Report for November was accepted as information. There were no Board vacancies or correspondence to consider. • PROPOSED ORDINANCES AND RESOLUTIONS AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING THE TOWN CODE, CHAPTER 22 ENTITLED "SEWERS," SECTION 22-2 ENTITLED "SEWER SERVICE CHARGES," AND CHAPTER 29 ENTITLED "WATER SYSTEM," SECTION 29-10 ENTITLED "CHARGE FOR WATER SERVICE." This proposed ordinance was given final reading (first reading 11/06/96; published 11/20/96); it was then adopted unanimously by roll call vote following MOTION by VICE MAYOR RAND/COMMISSIONER REID. REGULAR BUSINESS Items Left Over None.
