Voress called the Workshop Meeting to order in Commission Chambers at 1:30 P.M. Town Clerk Doris Trinley called the roll. The Mayor, Vice Mayor Thomas J. Reid, and Commissioners David Augenstein, Michael W. Hill and John J. Sorrelli were present. Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano were also present, as were members of the general public. After roll call, the Pledge of Allegiance was given. With no objection, the Agenda was accepted as presented. 98.1 PUBLIC COMMENTS AND REQUESTS Jose Echeverria, Turtle Program Coordinator, advised turtle season officially begins April 1, and noted that volunteers for the program are always welcome. Immediately following Public Comments and Requests, Talent Bank Applicant Albert McNamara was interviewed by the Commission. 98.2 BOARDS AND COMMITTEES Mayor Voress noted two Board vacancies: one (1) each on the Planning Board and Code Enforcement Board. ADELPHIA PRESENTATION OF DIGITAL TV AND INTERNET CAPABILITIES Mark Alford, South County General Manager, demonstrated Adelphia's digital TV; Sharon Copeland, "Powerlink" Coordinator, gave a demonstration of Adelphia's Internet capabilities. Both answered questions and provided literature for interested parties. 98.3 PROPOSED ORDINANCES AND RESOLUTIONS There were no proposed ordinances or resolutions to consider. 98.4 REVIEW OF COMMUNITY NEWSLETTER [SPRING EDITION] The Spring Edition of the Community Newsletter was reviewed and minor changes were made. It was the consensus that it be printed and distributed. . Reid thanked those who voted for him in the March 10 vice mayoral election and also those who campaigned on his behalf. Commissioner David Augenstein reported on a gazebo and play station he had ordered for the area behind Town Hall. It was the consensus that the Commissioner request a landscaper to prepare a general design plan for the property, to include placement of the items such as reported on. At Commissioner Augenstein's request, Commissioner Sorrelli will join in this effort. Commissioner Michael W. Hill responded to a recent article in The • Sun Sentinel, and clarified for the record that he had contributed to the campaigns of both vice mayoral candidates, Christopher T. Martin and Thomas J. Reid; the newspaper article had noted Commissioner Hill's contribution to Mr. Martin's campaign only. Commissioner John J. Sorrelli had no report. Mayor Arlin G. Voress thanked those residents who took part in the March 18 dedication ceremony for the Town Hall complex. The Mayor also thanked Town Manager Mary Ann Mariano for coordinating the event. Mayor Voress further reported on a request from State Treasurer Bill Nelson asking support of SB1478 and HB3827 ("Homeowners' Protection Act") regarding the insurance industry. The Mayor briefly described some of the benefits of such legislature, including a 15% rate roll back and protection against unfair cancellation. It was the consensus to have a favorable resolution prepared for adoption at the April 7, 1998 Regular Meeting. REPORTS - TOWN ATTORNEY Town Attorney Thomas E. Sliney had no report. Town Manager Mary Ann Mariano reported a severe drainage problem on some portions of Russell Drive; Mr. Regg Wagner of 1111-A Russell Drive corroborated the Town Manager's remarks. Earl Harvel of Harvel Utility Construction also confirmed the problem and advised r U Minutes of Town Commission Meeting March 31, 1998 Workshop Meeting Page 3 of 3 how it could be corrected. It was the consensus to accept Ms. Mariano's recommendation that Harvel's proposal in the amount of $13,500 be approved, and the item was moved to the April 7, 1998 Regular Meeting Consent Agenda. Ms. Mariano next reported on CH2M HILL's task order No. 7, necessitated by a Department of Environmental Protection requirement that the Town make corrections to the underground diesel tank at the water treatment plant, which is used to fuel the plant's emergency generator. The task order, in the amount of $3,712, provides for an environmental assessment to determine if any contamination exists; it was the consensus to accept Ms. Mariano's recommendation that the order be approved, and it was moved to the April 7, 1998 Regular Meeting Consent Agenda. The Town Manager's report also include acknowledgement of a letter from Seagate Condominium regarding construction parking, which Ms. Mariano said will be addressed; a request from a group associated with the National Day of Prayer organization to gather at Town Hall on May 7, which she has granted; and a letter from Palm Beach County Commissioner Mary McCarty advising that the Department of Transportation's plans for bike lanes along AlA continue to be in effect. Of the Highland House Homeowners Asso. (1107A-1111-B Russell Drive) began discussions with Jim Duvall, former Building Official regarding the drainage problem at that location. I have attached Mr. Wagner's October 21, 1996 letter to Mr. DuVali elaborating on this issue, as well as a February 10, 1998 letter addressed to me. Mr. Wagner, Earl Harvel and I have met several times to seek the various alternatives to correct this problem. Upon investigation, it was found that the drainage problem is due to the grade of Russell Drive at this specific location and is not caused by runoff from the private property which runoff is adequately addressed through the rear of the property into the ICWW. Current Information: Harvel Utility Construction, Inc., the Town's Utility Contractor, submitted its findings as well as a proposal to correct this drainage problem at an approximate cost of $11,65222 (copies attached). Staff Recommendation: Staff recommends approval of the Harvel proposal for an amount not to exceed $;to alleviate the subject drainage problem. Mr. (3 ~ Wagner and Mr. Harvel will be available at the Workshop Meeting to address this issue and answer any questions. If appropriate, this item may be placed on the April 7,1998 Regular Meeting for consideration and approval. As you requested I am enclosing six eight by ten photographs taken of the property after a rain. Four of the photographs demonstrate the accumulation of rain water in front of the property with no place to drain to. Two of the photographs show the mess remaining in front of the property after the water has finally evaporated after several days. I have lived in this property since 1987 and I have never noticed the drainage to be this inadequate until lately, The problem started just after the last time the street was resurfaced by the city. After a rain, water drains in front of our property from the street crown, from the street just east of and from the street just west of us. There is one large drain situated just off th.e street on the west side of our property; however, the elevation of the street at this point is higher than the elevations in front of most of our property, The water has no way of reaching this drain at present. One block directly to the north of us, the property at 1109through 1115 Bel Air Drive had a very similar drainage problem, I was informed by those property owners that the city installed drains approximately a year ago at the city's expense. We, the six property owners at Highland House, would aapreciate you looking into this matter at your earliest convenience and advising us of what can be done to correct this problem. Our association .first wrote to Mr. James Duvall, Building Official, on October 21, 1996. Mr. Duvall was kind enough to meet with me at the • property and discuss the problem. He indicated that the situation of the flooding would be corrected. After time went on and nothing was happening, I contacted you, Ms. Mariano. You scheduled an appointment for me at the property with Mr. Earl Harvel. Mr. Harvel later took. some elevations of the street and the property. He indicated that he would draft a plan to correct the. poor drainage. Time went on and still nothing happened. T know you are aware that I have met with you and Mr. Harvel several times after all this to resolve the matter. The problem is that the street drains not only from .its crown, but from the west side of the property and also the east side of the property onto our driveways. In other words, the street dips where our property is located. Water accumulates as much as three to four inches high, and remains for several days at times. There is a drain from the street to the canal in the rear of our property; however, the elevation of this drain is higher than the flooded area. This is a real nuisance when it rains, as the residents cannot get to the mail boxes, and the postman complains. Our roof water from rain drains into the canal located in the rear of our property. It appears to us that its the city's responsibility to drain rain water off their own property. Considering the amount of taxes we pay, it seems like the city could correct this problem at no major expense. page 2 u At our last meeting you indicated that you would bring this matter to the attention of the commissioners at the meeting scheduled for the last Tuesday in the month of March. I definitely plan to attend this meeting, and if you need any additional photographs showing the drainage problem, please advise me. Per your request I checked the storm drainage on the north side of Russell Drive and found the following. There are (2) catch basins one at 470' west of South Ocean Blvd. and another at 780' both seem to be in good condition. After shooting elevations along the north edge of the pavement it was found that there are (2) areas of major standing water le#t after it rains. The first area is at the intersection of Russell Drive and South Ocean Blvd. most of this water seems to be coming from the South Ocean Blvd. right-of-way. The state should be contacted to help with this problem. The second area is in front of 1107 -1109 Russell Drive this area is from the catch basin at 470' east for 200'. The water is trapped in this area due to low street elevations. Three methods were considered to solve this problem. (1) Overlay Pavement -This was rejected because unless the whole street was reshaped, it would trap water east of the existing low area. The following proposal is to install 160' of 8" C900 PVC from the driveway at 1109 B to the catch basin on the west property line of i i07 A. Due to the vegetation and existing utilities on the shoulder of the road this line will be installed under the pavement. While the line will have little cover under the pavemen if quality materials are used the town could expect many years of service from it. Catch basins will need to be installed in at least t locations if a small amount of the planted areas can be reshaped to promote drainage, if this is not possible then it may take six. AGENDA REPORT FORM TO: MAYOR AND TOWN COMMISSION FROM: MARY ANN MARIANO, TOWN MANAGER DATE: MARCH 26,1998 RE: CH2MHILL TASK ORDER NO.7 WORKSHOP MEETING OF MARCH 31, 1998 Agenda Item No. Town Managers Resort Background: Upon routine inspection conducted by the Florida Department of Environmental Protection, the Town is being required to make corrections to the underground diesel storage tank at the water treatment plant used to fuel the plant's emergency generator. Investigation and research was undertaken by the Town's engineers, CH2MHII..L, to determine the most cost effective and efficient method by which to meet DEP compliance. The DEP Inspection Report, the findings of • CH2MHILL and a memo from Jack Lee, Utilities Director are attached. Current Information: Task Order No. 7 has been submitted by CH211~.L to conduct the necessary Environmental Assessment in order to determine if any contamination exists (attached). If such contamination exists, the Town is eligible for site cleanup under the State Insurance Program with a $10,000 deductible. If no contamination exists, the tank still requires replacement at an estimated cost of $50,000. Either amount will be requested as an allocation in the 1998/99 FY Budget. This scheduling will allow compliance with the 12/31/98 deadline set by the DEP. Staff Recommendation: Staff recommends approval of Task Order No. 7 in order to allow CH2N)HII..L to conduct an Environmental Assessment of the Emergency Generator Diesel Fuel Underground Storage Tank at a cost of $3,712. If not, fines up to $10,000 per day nosy be levied by the state or federal government. • Compliance for an Sutder~~ storage tanks includes overspill containment, ar a double-walled, b'berglass, or fiberglass coated tank, or cathodic protection The piping Must bedouble-walled if underground (sir-$1e-H'alled if above ground). • According to Mark, the 1981 installed tank at Highland Beach maybe, at best, an asphalt coated steel or fiberglass coated steel (if a light blue color, than it is fiberglass coated}, Qne of the first things the City may want to do is determine the tank material. It is very important to note t if contamination from the tank is present, that it be discovered and reported bye`~998. If reported before that date, then the cleanup is • covered under FFISPA with a $10,000 deductible. If not, the cleanup is on the City's di~ane. 'There are two paths that the City can take on this tank. The first path assumes that the City wants to keep the e o t • If an underground tank is desired, then some kind of containment or protection is needed for the tank (as outlined above) depending on its material, or complete replacemer-t may be necessary. In addition, the tank would need to be tightness tested beginning in 1998 and continuing every year for the life of the tank. Monitoring (wells) would also be needed, and would have to be sampled to keep the tank under compliance. Of course, the piping would need to be replaced with double-walled piping. The second path is the replacement of the underground tank with an above-around tom. The above-ground tank would need some secondary containment (curbed concrete pad under it). Tiowever, the monitoring wells and tightness testing would not be necessary for the above-ground tank. only routine inventory control would need to be tracked. Based on this information, it appears that an above-ground storage tank is the route tv take, especially if they are considering changing to a smaller tank anyway. It is important, however, that the City take quick and discover if there is any existing contamination, It would not benefit the City to be digging up the old tank after~e 1998, only to discover contamination that needed to be remediated. jj.eC . Monthly results of the SIR must be submitted to FPLIPA, Inc. by the SIR company. 3. All locations with existing contamination must have a mekns of leak detection that ~ will defied new discharges. Listed below are the Florida pEP Requirements: a. If contamination from the tank is present and is reported before December 1998, then cleanup is covered under FPLII'A with a $10,000 deductible. After December 1998, the cleanup is at the towns expense. We have an ideal location at the plant to install a new above ground tank, which according to our engineers, is the least expensive option. Please note: We did not find out about this requirement until December 9, 1997. I have attached additional information for your review. The anticipated cost of this project is close to $50,000. Task Order No. ~ March 19, 1998 Limited Environmental Assessment Activities at the WWTP Emergency Generator Diesel Fuel Underground Storage Tank Objective The Town of Highland Beach (TOWN) has requested the services of CH2M HILL (ENGINEER) to provide technical services for implementation of a limited Environmental Assessment at the TOWN WWTP Emergency Generator Diesel Fuel Underground Storage Tank (UST). These services are necessary in order to determine if petroleum contamination in the soil and /or groundwater exists as a result of overfilling, overspills and /or leaks from the UST. If contamination is discovered during the limited assessment activities, a discharge notification form (DRF) will be submitted to the State as a claim under the State cleanup program. State insurance coverage was verified (Facility ID # 509102593) through Florida Petroleum Liability Insurance Program Administrators, Inc. (FPLIl'A). However, FPLIl'A representatives did indicate that the policy needs to be renewed by Mazch 31,1998. • FPLII'A acknowledged that an application for renewal was completed and submitted by TOWN but renewal payment is still pending. Since TOWN is already eligible under the state insurance program, a DRF claim would serve as notice that site cleanup will be necessary. A confirmation letter from the State will be submitted to TOWN acknowledging that site cleanup will eventually be conducted by the State. The State confirmation letter would be received before UST removal and replacement activities begin. No activity by TOWN with regard to site cleanup would be required. The services to be provided of the work will include the following: • Monitor well Installation • Soil Borings • Soil Monitoring • Laboratory Analysis A detailed scope of work is included in the proposal attached. Scope of Services The ENGINEER will provide specific services to the TOWN in accordance with the following task descriptions. oFg/98079001 S/SET518.DOC ~•_ ~. Task 1 -Conduct Limited Contamination Assessment The limited contamination assessment activities will include the following services: 1) Total of two shallow depth monitor wells will be installed downgradient of the UST location. The depth to water at this site is approximately 10 feet bls. Therefore, the well will be installed to a total depth of approximately 18 feet with the screened interval from 8 to 18 feet bls. The well construction shall be PVC with a 10-foot screen slotted to 0.02 inches (20 slot). The wells will be installed flush to grade. 2) Four soil borings will be conducted around the vicinity of the UST. Two soil borings will be conducted during the installation of the monitor wells. Two additional soil borings will be conducted around the UST. Soil samples will be collected at 2 foot intervals to the water table interface using asplit-spoon sampler. 3) Soil samples will be monitored with an Organic Vapor Analyzer (OVA) during the split- spoon sampling activities. 4) Two laboratory soil samples will be collected at the interval showing the highest OVA reading or at one foot above the water table interface. Laboratory analysis will include EPA Method 8100 and FL-PRO. 5) Two laboratory groundwater samples will be collected from the monitor wells and analyzed for EPA Method 610 only. 6) Three hand auger soil samples will be collected to the depth of the integral piping along the length of the integral piping. Hand auger soil samples will be monitored using an OVA. TasK 2 -Prepare Letter Report A brief letter report will be prepared summarizing the results and conclusions of the limited assessment activities. The report will include a concentration table summarizing the laboratory results, site map, and appendices containing detailed laboratory data and field logs. Should the TOWN elect to perform the Work under this task order, the ENGINEER will provide such services only upon separate written Notice To Proceed from the TOWN. The total compensation for all services rendered under this task will not exceed $2,757 for expenses and $955 for salary costs. It is agreed to by the ENGINEER and the TOWN that the guaranteed maximum compensation will be reduced by those portions of the amounts stated above which are not authorized by a Notice To Proceed. Assumptions The scope of work prepared is based on the following assumptions: • Drilling and laboratory services expenses will include a 10% markup. • TOWN will review drawings of the UST construction and utility corridors with the ENGINEER to confirm underground utility locations before field activities begin. oFB/980790015/S ET518. Director DATE: March 10, 1998 RE: State Road A-1-A Bicycle Facilities There has been much discussion and concern recently regarding bicycle facilities on State Road A-1- A in the south and central portions of Palm Beach County. Several municipalities have indicated . opposition to bicycle paths and lanes through their jurisdiction. Some municipalities are pursuing designation of A-1-A as a scenic highway through special legislation. The MPO has adopted a Long Range Bikeway Facilities Concept Plan that set forth a series of bicycle corridors constituting a large grid for bicyclists in Palm Beach County. The Plan identified the oceanfront as the primary bicycling venue in the county with facilities to provide access to the oceanfront azea. FDOT has also established A-1-A as the number one priority for constructing a continuous bicycle facility, based on existing bicycle traffic and popularity. The staff requested information from the Department of Transportation relative to requirements for bicycle lanes, impact on adjacent landscaping and effects of scenic highway designation. The attached response from FDOT addresses these issues. FDOT standazds provide for afive-foot paved shoulder to be constructed within the roadway clear zone. Since this area is to be free of obstacles, the addition of bicycle lanes should not impact current landscaping. The A-1-A right-of--way will accommodate the roadway, paved shoulders and the cleaz zone. Florida Statutes currently provide for designation of scenic highways. The intent of the Florida Scenic Highway Program is to preserve, maintain and protect cultural, historic and scenic routes on the State Highway System for vehiculaz, bicycle and pedestrian travel. This letter is in response to your letter of February 5, 1998 regazding future improvements to State Road A-1-A in the Town of Ocean Ridge. • Current Florida Department of Transportation standards call for the construction of 1.5 meter (5 foot) paved shoulder along all state roads having a rural typical section whenever they aze resurfaced or reconstructed. Design standards call for any vegetation or structures to be outside the clear zone azea. ~ Bicycle shoulders can be constructed within the clear zone and aze not as wide as the cleaz zone. Therefore, bicycle shoulders by themselves will not impact any landscaping nor increase the cleaz zone width. The current mitimum right-of -way along A-1-A in Ocean Ridge is 50 feet, which will accommodate a two lane road, 1.5 meter (5 foot) paved shoulders on each side, maintain the existing sidewalk, and provide the required cleaz zone. The design of the resurfacing project in this azea has not begun and no plans are available at this time. State Road A-1-A is the District's number one priority for construction of a continuous bicycle facility based on the popularity of this route with bicyclists, as evidenced by the~existing bicycle traffic. The provision of safe facilities for all users of the State Highway system, motorists, bicyclists and pedestrians, is the Department's most important goal. The Department has and will continue to actively coordinate with the towns and cities along A-1-A to achieve the best balance between the goals of safety and that of preserving the quality of the scenic environment. Beginning in 1993, the Department implemented the Florida Scenic Highway Program under Florida Statute 335.093, which is intended to preserve, maintain, and protect a part of Florida's cultural, historical, and scenic routes on the State Highway System for vehicular, bicycle, and pedestrian travel. This designation is arrived at through community-based consensus and partnerships, and would still allow the Department of Transportation to make needed improvements to the roadway in accordance with the Corridor Management Plan. Prior to the implementation of the Florida Scenic Highways Program, several routes were designated by the Florida Legislature as State Historic Highways. These routes were selected on a case by case basis and evaluated independently without unified criteria. The legislative bill must list the properties, view, trees, etc., that are being protected. A list of restrictions must be specified in the bill and also the permissible activities. Depending on how the bill is written, it could prevent needed roadway improvements from occurring. The Florida Scenic Highway Program was created to replace this prior method of individual designation with a consistent, statewide program to manage Florida's intrinsic resources.
