1998.04.07_TC_Minutes_Regular TOWN OF HIGHLAND BEACH, FLORIDA MINUTES OF TOWN COMMISSION MEETING REGULAR MEETING Tuesdav, April 07, 1998 1.30 P M Mayor Arlin G. Voress called the Regular Meeting to order in Commission Chambers at 1:30 P.M. Town Clerk Doris Trinley called the roll. The Mayor, Vice Mayor Thomas J. Reid, and Commissioners David Augenstein, Michael W. Hill and John J. Sorrelli were present. Town Attorney Thomas E. Sliney and Town Manager Mary Ann Mariano were also present, as were members of the general public. After roll call, the Pledge of Allegiance was given. 1. ADOPTION OF AGENDA With no objection, the Mayor declared the Agenda accepted as presented. 2. APPROVAL OF MINUTES • Upon MOTION by COMMISSIONER AUGENSTEIN/VICE MAYOR REID, three (3) sets of Minutes were unanimously approved: February 24, 1998 - Workshop Meeting March 03, 1998 - Regular Meeting March 11, 1998 - Special/Canvassing Meeting 3. PUBLIC COMMENTS AND REQUESTS The following residents addressed the Commission: .Jose Echeverria [1112 Russell Drive] advised of turtle season and beach/ocean conditions. .Dean Luce [4511 S. Ocean Blvd.] expressed concerns regarding the possibility of installing playground equipment behind Town Hall, and was informed that no decision on what is to be installed had been made at this time. Mr. Luce also advised he had been informed by Adelphia it would be over a year before TV transmission quality would be improved. .Jack Halpern [3201 S. Ocean Blvd.] inquired if the Town might involve itself in keeping the beach free of garbage. He was advised that the Town's beaches are private and public funds could not be expended on private property; he was also invited to contact Jose Echeverria regarding the ongoing volunteer beach cleanup program. Town Commission Meeting Minutes April 07, 1998 Regular Meeting Page 2 of 3 4. REPORTS - TOWN COMMISSION Vice Mayor Thomas J. Reid had no report. Commissioner David Augenstein reported that he and Commissioner Sorrelli met this date to discuss development of the property behind Town Hall. He advised that Commissioner Sorrelli will request plans for same from three landscape firms, which action was unanimously approved upon MOTION by VICE MAYOR REID/COMMISSIONER HILL. Commissioner Michael W. Hill, furthering comments regarding the bike path made by Vice Mayor Reid at the March 31 Workshop Meeting, noted that expanding tree roots have made passage on the path in the north end of Town difficult for everyone and asked that it be repaired. Ms. Mariano said problems had been observed in other areas also, and the Building Official was in the process of getting prices for repairs. Commissioner Hill also asked for an update on the letter received from Seagate Condominium citing concerns over the condition of certain construction sites. Ms. Mariano replied that the Building Official had addressed the issues with favorable results. • Referring to remarks made by Mr. Halpern under Public Comments, Commissioner Hill asked if other oceanfront communities take responsibility for keeping their beach areas clean. Ms. Mariano answered that larger cities take care of their public beaches, but she knew of no small oceanfront communities who were responsible for private beach properties. Commissioner John J. Sorrelli had no report. Noting that each elected official is assigned an area of interest, Mayor Arlin G. Voress asked if Commissioner Sorrelli would accept matters pertaining to Building as his area, to which the Commissioner replied affirmatively. 5. REPORTS - TOWN ATTORNEY Town Attorney Thomas E. Sliney had no report. 6. REPORTS - TOWN MANAGER Town Manager Mary .Ann Mariano addressed publication of legal ads, and noted the Commission's decision to use The Sun Sentinel rather than The Boca News took place at a Commission Meeting. She further noted that although the Town Clerk had previously polled the members separately, advising of the difference in rates between the • two publications, she thought it appropriate for the members to also decide in Meeting if they desired to revert to The Boca News. Town Attorney Sliney concurred with Ms. Mariano's remarks. Concluding discussion, and upon MOTION by COMMISSIONER SORRELLI/VICE MAYOR REID, the Commission voted unanimously to use Minutes of Town Commission Meeting April 07, 1998 Recrular Meetincr Page 3 of 4 • The Boca News for legal ads, in the interest of cost and convenience. (Note to the record: example of rates for a quarter-page ad as of March 1998...The Sun Sentinel/$1300; The Boca News/$480) Ms. Mariano also referred to her invitation to the Commission to attend the April 29 Staff Meeting, and requested the members contact the front office to respond. 7. REPORTS - BOARDS AND COMMITTEES The Board Action Report for March was accepted as information, and monthly Board Meetings for April were read into the record. Harold Hagelman was appointed to the Planning Board for a three- year term upon nomination by Vice Mayor Reid/Commissioner Sorrelli, with unanimous vote. The nominations for Code Enforcement Board were Dean Luce (Commissioner Augenstein) and Horace Leng (Commissioner Hill). Vote was as follows: Commissioner Augenstein.....Dean Luce Commissioner Hill...........Horace Leng Commissioner Sorrelli.......Horace Leng • Vice Mayor Reid .............Dean Luce Mayor Voress ................Dean Luce Dean Luce was appointed to the Code Enforcement Board for a three- year term by majority vote. 9. PROPOSED ORDINANCES AND RESOLUTIONS With no discussion, the following Resolution was unanimously approved upon MOTION by VICE MAYOR REID/COMMISSIONER AUGENSTEIN: A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, SUPPORTING SENATE BILL 1478 AND HOUSE BILL 3827 PERTAINING TO THE HOMEOWNERS' INSURANCE MARKET IN FLORIDA ("HOMEOWNERS' PROTECTION ACT"). 10. REGULAR BUSINESS Items Left Over None. Consent Acrenda Upon MOTION by COMMISSIONER AUGENSTEIN/VICE MAYOR REID, the following items were unanimously approved: 1) REPAIR OF DRAINAGE ON .CERTAIN SECTIONS OF RUSSELL DRIVE (1107A-1111B) BY HARVEL UTILITY CONSTRUCTION, INC.
