TOWN OF HIGHLAND BEACH
''' MINUTES OF TOWN COMMISSION MEETING
WORKSHOP MEETING
Tuesday, October 26, 1999 1.30 P M
Mayor Thomas J. Reid called the Workshop Meeting to order in
Commission Chambers at 1:30 P.M.
Town Clerk Doris Trinley called the roll. The Mayor, Vice Mayor
Michael W. Hill and Commissioners John J. Sorrelli, Paul R. Kane
and Robert L. Lowe were present.
Town Attorney Thomas E. Sliney and Town Manager Ben Saag were also
present, as were members of the general public.
After roll call, the Pledge of Allegiance was given.
1. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA
Hearing no objection, Mayor Reid declared the Agenda accepted as
presented.
2. PUBLIC COMMENTS AND RE UESTS
Jose Echeverria (1112 Russell Dr.), Turtle Program Coordinator,
gave an update on the turtle season, which ends on 10/31/99. He
advised there were a total of 675 nests.
Marlene Heuser (4420 Tranquility Drive) complained of privately-
owned overgrown lots in Bel Lido and asked to have this situation
rectified. Town Manager Saag said that in the future the Town will
request that the lots be mowed every four (4) weeks instead of
eight ( 8 ) weeks .
Marie Coffman (1116 Highland Beach Dr.} presented a petition signed
by residents of Highland Beach Drive, protesting construction
activity in the area and claiming unkempt and unacceptable
conditions are consistently allowed by the developer. She
presented photos along with the petition (petition & photos
attached to and made part of these Minutes.)
Silvio Blaskovic and John Fish (1120 and 1102 Highland Beach Dr.
respectively) echoed Mrs. Goffman's complaints, with Mr Blaskovic
also issuing a complaint about garbage being allowed to accummulate
for long periods of time (photo attached to and made part of these
Minutes), and Mr. Fish also addressing drainage problems at the
west end of the street, suggesting the use of asphalt to raise the
surf ace .
The Commission requested Town Manager Saag to follow up on this
situation.

Before proceeding with the Agenda, Mayor Reid announced that Herb
Lewin had expressed interest in being reappointed to the Code
Enforcement Board. Also, Talent Bank Applicants Rachael Scala-
Pistone and Edward Renzulli were interviewed by the Commission.
PRESENTATIONS
Delray Beach Fire Chief Bob Rehr re Advanced Life Support (ALS)
Chief Rehr explained that while the Town's fire rescue unit had
been equipped with ALS, Delray Fire Rescue would like to similarly
equip the Town's aerial chassis truck at a cost of approximately
$17,000. After some discussion, it was agreed this would be to the
benefit of the Town's residents and the project was moved to the
Consent Agenda. (breakdown of costs attached to and made part of
these Minutes).
Architect Richard Brooks re Plans for Property Behind Town Hall
Mr. Brooks, along with architect Don Murikami, presented conceptual
plans for the property behind Town Hall. During discussion,
Commissioner Kane noted he would like to see an elevated boardwalk
to the Intracoastal and a seawall incorporated. Concluding
• discussion, it was the consensus that no decision would be made at
this time. (Copy of preliminary cost estimate attached to and made

4. PROPOSED ORDINANCES & RESOLUTIONS
AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA,
AMENDING CHAPTER 30, ENTITLED "ZONING," OF THE CODE OF
ORDINANCES: ADDING SECTION 5.19 ENTITLED "DETERMINATION
OF FINISHED FLOOR ELEVATION," AMENDING SECTION 13.7
ENTITLED "BUILDING HEIGHT," ADDING SECTION 5.20 ENTITLED
"EXCEPTIONS TO BUILDING HEIGHT," AMENDING SECTION 13
ENTITLED "DEFINITIONS" BY PROVIDING DEFINITIONS FOR
BUILDING HEIGHT EXCEPTION, HABITABLE SPACE AND USABLE
SPACE. (first reading 10/5/99; legal ads for 10/26/99
public hearing and 11/30/99 public hearing/special
meeting on 10/19/99 & 11/24/99); final reading 11/30/99)
There was no discussion of this proposed ordinance.

At this point in the proceedings, Attorney Sliney noted it was time
for the scheduled 2:30 P.M. Public Hearing; however, it was the
consensus that the Workshop be concluded first, with the Public
Hearing immediately following.
5. NEW BUSINESS
1) CH2M HILL General Services Contract
2) CH2M HILL NPDES Contract/Year 3
Town Manager Ben Saag explained these two contracts, advising that
both represented a savings over previous years. After some
discussion, it was agreed to place the contracts on the November
Regular Meeting Consent Agenda. (Copies of individual agreements
attached to and made part of these Minutes)
3) Police Consortium Interlocal Agreement
Chief Tony Cervasio advised this agreement sought to determine
those municipalities interested in being part of the consortium,
which would not only allow individual police departments the
advantage to directly access each other - without going through
sheriff department dispatch - but also provide direct access to
• other vital departments such as fire, emergency medical, etc.
Chief Cervasio noted that the radio system to accomplish this
should be available by January 2000 and, when costs have been
ascertained, each municipality will be apportioned its share by
population. At that time, the Chief advised, if the Commission
does not agree with the Town's apportionment, its participation can
be rescinded with no penalty. Some discussion followed and,
concluding that the Agreement would be of benefit to the Town, it
was moved to the November Regular Meeting Consent Agenda. (Copy of

6. MISCELLANEOUS - ITEMS LEFT OVER

Regular Meeting Consent Agenda for further consideration and
possible approval:

Commissioner Paul R. Kane advised the Town Manager that he would
like to work with Deputy Town Clerk Jane Dillon in an effort to
ensure that the time noted on the character generator (Channel 20)
is accurate at all times.
Referring to photos presented with the Highland Beach Drive
petition, Commissioner Kane also directed that the portable toilet
sitting on the street at the construction site be moved to a more
discreet position by the end of the day.
Commissioner John J. Sorrelli had no report, but directed that the
Town Manager send a letter to developer Mark Rothenberg regarding
the conditions described in the Highland Beach Drive petition.
Vice Mayor Michael W. Hill report covered several issues:
1) Per Mrs. Heuser's complaint, Vice Mayor Hill asked that the
Town Commission be informed if those responsible agreed to mow
vacant lots in Bel Lido every four (4) weeks.
2) Per the Highland Beach Drive petition, the Vice Mayor
suggested that construction sites on the side streets be held to
the same rules and regulations as those on AlA.
3) It was also the Vice Mayor's suggestion that digging out
swales and the use of paver bricks to allow for water percolation
could alleviate some of the problems previously expressed by Mr.
Fish of Highland Beach Drive. In this regard, the Town Manager
said he would request CH2M HILL to include the side streets in
their stormwater drainage study.
4) In answer to Vice Mayor Hill's question regarding the
possibility of the Department of Transportation including monies
for landscaping /beautification with the bike path project, Mayor
Reid responded that Representative Bill Andrews had intervened in
this regard and through his efforts additional monies will be
available for this purpose; on behalf of the Commission, the Mayor
expressed sincere appreciation and thanks to Representative
Andrews.
8. REPORTS - TOWN ATTORNEY
Town Attorney Thomas E. Sliney had no report.
9. REPORTS - TOWN MANAGER
Town Manager Ben Saag advised he and Chief Cervasio had looked into
several models regarding a Police Beach Vehicle, but so far none
appeared to be appropriate for the Town's use, including the model
used by Gulf Stream. Mr. Saag said more information would be
forthcoming at the November Workshop.

10. CONSENT AGENDA
None.
11. ADJOURNMENT
There being no further business to come before the Commission at
this time, Mayor Reid adjourned the meeting at 2:55 P.M. upon
MOTION by COMMISSIONER SORRELLI/COMMISSIONER KANE.
