1999.11.30_TC_Minutes_Workshop~,. . • TOWN OF HIGHLAND BEACH MINUTES OF TOWN COMMISSION MEETING WORKSHOP MEETING November 30, 1999 1.30 P M Mayor Thomas J. Reid called the Workshop Meeting to order in Commission Chambers at 1:30 P.M. Town Clerk Doris Trinley called the roll. The Mayor, Vice Mayor Michael W. Hill, and Commissioners John J. Sorrelli, Paul R. Kane and Robert L. Lowe were present. Town Attorney Thomas E. Sliney and Town Manager Ben Saag were absent; both were required to be in attendance at the Mariano v. Town of Highland Beach mediation meeting held at Mr. Sliney's Hodgson Russ offices. Members of the general public were also in attendance. After roll call, the Pledge of Allegiance was given. 1. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA • Mayor Reid advised that because Messrs. Sliney and Saag would not be in attendance, the discussion regarding the BFI Contract Extension would be deferred to the December 07 Regular Meeting. Hearing no objection, this item was deleted and the Agenda was accepted as presented. 2. PUBLIC COMMENTS AND REQUESTS Jose Echeverria (1123 Russell Drive) advised turtle season is over and thanked all volunteers who took part in the program. He also noted that the U. S . Marine Corps Program, "Toys for Tots" is now in progress, and encouraged all to take part; pick-up date is 12/17. Jean Ellis (4205 S. Ocean Blvd.) congratulated Mr. Echeverria on a job well done as director of the Town's turtle program, as did Mayor Reid, on behalf of the Commission and residents. Felix Goldenson (3224 S. Ocean Blvd.) petitioned the Commission on behalf of certain Seagate Condominium residents that the "Ramblin' Rose" party boat, which travels the Intracoastal out of Delray, be notified that the music/noise coming from the boat as it passes west of Seagate should be toned down. It was the consensus that Town Manager Saag will write a letter to the boat operators in this regard. • Following Public Comments, Talent Bank Applicant Lezley Garrett was interviewed by the Commission. • Minutes of Town Commission Workshop Meeting November 29, 1999 Paae 2 of'{ 3. BOARDS AND COMMITTEES Mayor Reid noted no correspondence was forthcoming from any of the Boards and there were no Board vacancies; monthly Board Meetings were previously listed and the Board Action Report for November would be available shortly. 4. PROPOSED ORDINANCES AND RESOLUTIONS 1) AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING CHAPTER 30, ENTITLED "ZONING," OF THE CODE OF ORDINANCES: ADDING SECTION 5.19 ENTITLED "DETERMINATION OF FINISHED FLOOR ELEVATION," AMENDING SECTION 13.7 ENTITLED "BUILDING HEIGHT," ADDING SECTION 5.20 ENTITLED "EXCEPTIONS TO BUILDING HEIGHT," AMENDING SECTION 13 ENTITLED "DEFINITIONS" BY PROVIDING DEFINITIONS FOR BUILDING HEIGHT EXCEPTION, HABITABLE SPACE AND USABLE SPACE. (first reading 10/5/99; legal ads for 10/28/99 public hearing and 11/30 public hearing/special meeting on 10/19/99 & 11/24/99; final reading 11/30/99) Mayor Reid advised this ordinance would be considered for adoption at a special meeting, following a public hearing, scheduled to • begin at 2:30 P.M. today. 2) AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING THE TOWN CODE, CHAPTER 22 ENTITLED "SEWERS," SECTION 22-2 ENTITLED "SEWER SERVICE CHARGES." (first reading 11/2/99; published 11/19/99; final reading 11/30/99) There was no discussion of this ordinance; it will be considered for adoption at the December 7 Regular Meeting. 5. NEW BUSINESS 1. Review Winter Edition of Community Newsletter With some minor changes agreed upon, it was the consensus that this edition of the Newsletter be sent to the printer and readied for distribution/mailing. 2. Discussion re Purchase of Beach Access Vehicle for Police Police Chief Tony Cervasio said no choice of vehicle style had yet been made. Commissioner Lowe advised discussions were taking place regarding the prospect of housing the proposed vehicle on Ambassador East Condominium property (3301 S. Ocean Blvd.) In • response to former Mayor Arlin Voress' concern that the vehicle be represented as a "rescue" vehicle, the Commissioner advised that Fire Chief Bob Rehr was aware the proposed project. • Minutes of Town Commission Workshop Meeting November 30. 1999 Paae 3 of'~ 6. MISCELLANEOUS - ITEMS LEFT OVER The following sets of Minutes were moved to the December 7 Regular Agenda for further consideration and possible approval: October 26, 1999 - Workshop Meeting October 26, 1999 - Public Hearing (Zoning) November 02, 1999 - Regular Meeting November 23, 1999 - Special Meeting 7. REPORTS - TOWN COMMISSION Commissioner Robert L. Lowe had no report. Commissioner Paul R. Kane advised that Channel 20 now exhibits the correctlexact time. Commissioner John J. Sorrelli questioned if a response to the Town Manager's letter to the "Toscana" project regarding unacceptable construction conditions had been received. Because Mr. Snag was not in attendance, it was noted that the answer would not be forthcoming until the December 07 Regular Meeting. • The Commissioner also suggested that the Town advertisements for Talent Bank Applicants be given a hiatus, as there were currently over 30 applicants, and no Board openings until April 2000. It was the consensus to agree with this suggestion. Vice Mayor Michael W. Hill referred to the Winter issue of the Newsletter, suggesting that a message regarding Town Code not allowing dogs to run loose on the beach be included, which was agreed to by consensus. Mayor Thomas J. Reid advised he will address the Palm Beach County Commission in West Palm Beach on Tuesday, December 07, at 2:15 PM to offer alternative suggestions to that Commission's plan to build a county park in the south end of Town. Because the regularly scheduled meeting of the Town Commission is also December 07 at 1:30 PM, it was the consensus that advice from the Town Attorney would be sought regarding moving the time of the Town Commission Meeting to 4:30 PM instead of 1:30 PM. Mayor Reid also advised he will be working with resident Lezley Garrett to expand the public relations capabilities of Channel 20. 8. REPORTS - TOWN ATTORNEY Deferred to December 07 Regular Meeting. REPORTS - TOWN MANAGER In Mr. Saag's absence, Mayor Reid asked Chief Cervasio to comment on the request for possible transfer of funds to the Police Department for the purchase of a Ford "Expedition" Sport Utility Vehicle rather than a Ford "Crown Victoria" Sedan, and a computer program and laptop computers for the police vehicles. Chief Cervasio said the "Expedition" was being requested in case there was any necessity to assist residents regarding flood conditions caused by a storm. It was the consensus that this and the laptop computer request be moved to the December 07 Regular Agenda for further discussion. 10. CONSENT AGENDA None. 11.
