2012.03.27_TC_Minutes_Workshop• TOWN OF HIGHLAND BEACH MINUTES OF TOWN COMMISSION MEETING WORKSHOP MEETING Tuesday, March 27, 2012 1.30 PM Mayor Bernard Featherman called the Workshop Meeting to order in Commission Chambers at 1:30 PM. CALL TO ORDER: Roll Call: Members present: Mayor Bernard Featherman; Commissioner Doris M. Trinley; Commissioner Dennis J. Sheridan; and Commissioner Louis P. Stern. Vice Mayor Ron Brown was absent. Also present: Town Attorney Glen Torcivia; Town Manager Kathleen Dailey Weiser; Town Clerk Beverly Brown; Acting Finance Director Cale Curtis; Assistant to the Manager Zoie Burgess; and members of the public. • Pledge of Allegiance: The Pledge of Allegiance was given, followed by a minute of silence. Civility Pledge: The Civility Pledge was recited by the Town Clerk. 1. ADDITIONS. DELETIONS OR ACCEPTANCE OF AGENDA Mayor Featherman asked for any additions or deletions. Receiving none, the agenda was accepted as presented. 2. PUBLIC COMMENTS AND REQUESTS Carl Feldman — 3210 S. Ocean Blvd. Congratulated Ron Brown and Lou Stern on their election, and was looking forward to the next three years. It was a good election, with the exception of an unsigned letter. Also, Commissioner Sheridan sent a letter requesting support of two candidates stating that these two candidates will support him. Does this mean you will be voting as a block? PRESENTATIONS: A) A Proclamation declaring Water Conservation month was presented to Pamela Mac'Kie, Esq. representing Southwest Florida Water Management District. Ms. Mac'Kie thanked the Commission for the proclamation and also stated that water conservation can cost as little as 6 cents to 72 cents per 1,000 gallons of water saved, while the cost of constructing alternative water supply facilities may exceed $7 per 1,000 gallons of water created B) Acknowledgement of Service to former Vice Mayor/Commissioner Miriam S. Zwick. "In Grateful Appreciation for Your Many Years of Dedicated and Loyal Service On Behalf of the Town of Highland Beach." Vice Mayor 2008-2012; Commissioner 2004-2008; Code Enforcement 2001-2004; Charter Review 2001-2002; Community Appearance 1994-2000. Former Vice Mayor/Commissioner Zwick stated it had been a privilege to be elected and enjoyed her time volunteering and serving on the Commission. 4. PROPOSED ORDINANCES AND RESOLUTIONS A) ORDINANCE NO. 12-001 O AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING CODE OF ORDINANCES, SECTION 2-46 TO EXEMPT MEMBERS OF THE CHARTER REVIEW BOARD AND OF ANY OTHER STATUTORY BOARD HAVING ONLY ADVISORY POWERS FROM THE DEFINITION OF "OFFICER" FOR PURPOSES OF THE PROHIBITION AGAINST DUAL OFFICE HOLDING; Town Commission Workshop Minutes March 27, 2012 Page 3 of 6 • PROVIDING FOR SEVERABILITY AND CONFLICTS; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. Town Clerk Brown read Ordinance No. 12-001 O, title only, into the record Town Attorney Torcivia - The way that state law reads is that "any board that is simply advisory that doesn't make a decision is not considered an "office" of the Town". For example listed in the Town's ordinances, the Financial Advisory Board is listed as an office of the Town and theoretically, the Charter Review Board would be considered an office of the Town. That would have led to dual office holding — folks that are serving on two different boards. This [ordinance] would allow people to serve on any advisory board while holding a different office in the Town. It is a matter of bringing the ordinance in compliance with state statutes. No further discussion by the Commission. Consensus to schedule for First Reading on the April 3, 2012 Agenda 6. NEW BUSINESS A) Approve the request of the Beaches & Shores Advisory Board to spend $75.00 for costs +� associated with the April 19, 2012 presentation. B) Approve the request of the Beaches & Shores Advisory Board to spend $150.00 for costs associated with the volunteer beach clean-up on April 23, 2012. Town Manager Weiser — Since Items #A and #B both relate to the Beaches & Shores Advisory Board, I will speak to both of them at the same time. The Beaches & Shores Advisory Board will be sponsoring a presentation by Dr. Kirk Rusenko, Marine Conservationist of Gumbo Limbo Nature Center on April 19, 2012 at 9:30 AM. The east coast, especially this region of Florida, boasts some of the most important nesting beaches for loggerhead sea turtles in the world, and also offers habitat for green and leatherback sea turtles. The Board would like to request funding up to $75.00 to provide coffee and muffins for the attendees. In addition, they will be conducting a volunteer beach clean-up day on April 23, 2012. In conjunction with this clean-up, they are requesting the Town supply gloves, bags and water for the volunteers for an approximate cost of up to $150.00. In addition, they are requesting that the Public Works Department remove and dispose of the accumulated trash bags. No further discussion by the Commission. Consensus to include on the April 3, 2012 Consent Agenda 0 Town Commission Workshop Minutes March 27, 2012 Page 4 of 6 • C) Authorization for the Town Manager to enter into a Contract with Bridges Marsh & Associates for Professional Services for the Town Hall facilities renovations. Town Manager Weiser — At the March 6, 2012 Town Commission Regular Meeting, the Town Commission authorized staff to begin negotiations with Bridges & Marsh & Associates as Architect of Record for the Town Hall renovations. Negotiations have been successfully completed, and the contract for professional services has been drafted and agreed upon by Town Staff, the Town Attorney and Bridges Marsh. Upon Commission approval authorizing the contract, the Town Manager will issue a Notice to Proceed permitting Bridges & Marsh to begin Phase 1 — Feasibility Analysis where they will begin to inspect and evaluate the structure and review the existing facility. All results and designs will be presented to the Commission before proceeding to additional phases. Commissioner Stern — Is this a budgeted item? Manager Weiser — Yes, this is the preliminary work prior to construction. Mayor Featherman — How much is in the budget? Manager Weiser —Forty thousand was approved in the budget to appoint an Architect of Record for the project. No further discussion by the Commission. MISCELLANEOUS — ITEMS LEFT OVER A) Minutes February 28, 2012 — Workshop Meeting Mayor Featherman — Requested that item #8C — be changed to verbatim minutes. March 6, 2012 - Regular Meeting No corrections received from Commission, March 6, 2012 minutes to be included on the April 3, 2012 Consent Agenda. B) Nomination of Mayor Featherman's Replacement Appointment to Charter Review Board Mayor Featherman — stated that his nominee was Deanna B. Kelvin of 4740 S. Ocean Boulevard. No comments received. C) Nomination of Commissioner Trinley's Replacement Appointment to Charter Review Board Commissioner Trinley — stated that her nominee was Ruth Samuels of 3700 S. Ocean Boulevard. REPORTS — TOWN COMMISSION A) Commissioner Sheridan — I had the privilege yesterday of attending a meeting with the Town Attorney, Town Manager and Acting Finance Director at the West Palm Beach City Hall to discuss the lawsuit involving the Inspector general. Many of the Mayors and Commissioner from the fifteen cities involved were in attendance. There was not a definite decision made, but progress was certainly made. I would like to take the time to refer to an article that was in today's Palm Beach Post that was very complimentary to our Town Attorney. He made a suggestion that was almost unanimous by all attending on how we are going to handle this situation. I was very proud of his performance. Our ambulance has been taken out of service and taken in for repairs. Will announce when it is returned and the actual costs of these upgrades. B) Commissioner Stern — No Report. C) Commissioner Trinley — No Report. D) Vice Mayor Brown — No Report. E) Mayor Featherman - Vice Mayor Brown is in Ireland attending a family wedding and will be in attendance next week. No Report. 9. REPORTS — TOWN ATTORNEY No Report. 10. REPORTS — TOWN MANAGER Just a reminder that the Palm Beach League of Cities monthly meeting will be hosted by the Town of Highland Beach tomorrow at St. Lucy's Parish Hall beginning at 11:30 AM. 11. CONSENT AGENDA None. 12. PUBLIC COMMENTS AND REQUESTS RELATED TO ITEMS DISCUSSED AT MEETING Ronnie Svenstrup — Chairman of the Beaches & Shores Advisory Board, would like to thank you for supporting the talk on `sea turtles' on April 19d' and the beach clean-up on April 23`d, just Town Commission Workshop Minutes March 27, 2012 Page 6 of 6 prior to the beginning of turtle nesting season. Plus, what a nice presentation to former Vice • Mayor Zwick. 13.
