MINUTES OF TOWN COMMISSION MEETING
WORKSHOP MEETING
Tuesday, April 24. 2001 1.30 P M
Mayor Thomas J. Reid called the Workshop Meeting to order in Commission Chambers
at 1:30 P.M.
Town Clerk Doris Trinley called the roll. The Mayor, Vice Mayor Michael W. Hill and
Commissioners John J. Sorrelli, Robert L. Lowe and Rachael Scala-Pistone were
present.
Town Attorney Thomas E. Sliney and Town Manager Ben Saag were also present, as
were members of the general public.
After roll call, the Pledge of Allegiance was given.
1. ADDITIONS. DELETIONS OR ACCEPTANCE OF AGENDA
• At the Town Manager's request and with no objection, the Agenda was amended to
include a brief update on the R.O. test/production well by CH2M HILL.
2. PUBLIC COMMENTS AND REQUESTS
Lena Yacoub, a recent resident of the Clarendon Condominium, 3407 S. Ocean
Boulevard, advised her father was the victim of an accidental ocean drowning in
February, and suggested that signs be posted warning of ocean currents/riptides, as well
as reminding those using the beach not to swim alone. After expressing condolences
on behalf of the Commission, Mayor Reid suggested Ms. Yacoub meet with the Town
Manager to discuss her ideas.
AI Bresnahan, 3310 S. Ocean Boulevard, commented on what he perceived as
misleading advertising by the "AZURE" condominium developers in print and on T.V.
Town Manager Ben Saag advised that a letter had been sent instructing the developers
not to include the words "now under construction" in their print ads, as this was not the
case. Building Official Bob Dawson reminded that the site was a Settlement of Litigation
property and permits would be issued only on what was approved by the Commission.
Town Attorney Sliney also noted that prospective buyers should rely on their own due
diligence to ensure the integrity of any purchase. At Commissioner Scala-Pistone's
request, Mr. Dawson will make available those plans previously approved by the
Commission.

2. PUBLIC COMMENTS AND REQUESTS (continued)
Harold Hagelmann, 4748 S.Ocean Boulevard, asked that the Commission consider doing
a Proclamation in honor of the Humanitarian Society. Commissioner Sorrelli requested
that Mr. Hagelmann supply the Commission with resumes of the people who headed up
the organization.
3. PRESENTATIONS
CH2M HILL -UPDATE ON STATUS OF R.O. TEST/PRODUCTION WELL
Mark Schilling, CH2M HILL full-time resident inspector for the project, gave a technical
report on the status of the R.O test/production well situated behind Town Hall. Mr.
Schilling advised the job was on schedule and a depth of 1100 feet had been reached
thus far. Mr. Saag invited the Commission members to arrange a visit to the site at their
convenience.
4. BOARDS AND COMMITTEES
• A) BOARD CORRESPONDENCE: Regarding the Planning Board's memorandum
recommending amendment of the Sign Ordinance (Chapter 23) to include
changes suggested by developer Frank LaHage as to temporary construction
signs, it was the consensus to place this item on the May Workshop Agenda for
further discussion.
B) BOARD VACANCIES: The one (1) vacancy on the Code Enforcement Board
was discussed briefly and moved to the May Regular Meeting for further
consideration.
C) BOARD ACTION REPORT: None.
D) MONTHLY BOARD MEETINGS: Previously Submitted.
5. PROPOSED ORDINANCES AND RESOLUTIONS
A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF HIGHLAND
BEACH, FLORIDA, REQUESTING A PORTION OF THE COUNTY EMERGENCY
MEDICAL SERVICE GRANT AWARD PROGRAM FUNDS.
Mr. Saag advised that the Town honors this annual request as part of its contract with
Delray Fire/Rescue. After brief discussion, it was moved to the May Regular Meeting
Consent Agenda.

7. MISCELLANEOUS -ITEMS LEFT OVER
The following sets of Minutes were moved to the May Regular Agenda for further
consideration and possible approval:

8. REPORTS -TOWN COMMISSION
Commissioner Rachael Scala-Pistons reported that she should have an answer to the
possibility of volunteer FAU students committing to an ongoing clean-up of the Town's
beaches by the May Regular Meeting.
Commissioner Robert L. Lowe had no report.
• Commissioner John J. Sorrelli asked for an update on the sewer force main project.
Mr. Saag advised that the contractor had been suspended from the job at this time; he
also noted the issue would be an agenda item under his report for the May Regular
Meeting.
Vice Mayor Michael W. Hill requested that the developers of the Toscana project
complete the work recently done on the permanent wall, i.e., take down fence, put down
sod and paint the wall.
Also regarding the Toscana project, Mayor Thomas J. Reid suggested some kind of
apparatus that would dampen the A1A area during necessary frequent clean-ups be
considered to eliminate swirling dust that causes a safety hazard to motorists.
9. REPORTS -TOWN ATTORNEY
As requested at the April 3 Regular Meeting, Town Attorney Thomas E. Sliney advised
he had researched resident Beatrice Papera's (1008 Bel Air Drive) request for the
Town's assistance in her efforts to have wheelchair access to the beach. Mr. Sliney said
a representative of the ADA (Americans with Disabilities Act)) had informed that their
jurisdiction applies only to public accommodations; since the land and the easement on
which Ms. Papera's beach access exists is private property not owned by the Town, the
Town has no legal ability to make it ADA compliant.

However, Mr. Sliney further noted that the proposed County Park will be developed in
accordance with ADA requirements as it will be considered a public accommodation.
10. REPORTS -TOWN MANAGER
Town Manager Ben Saag reminded that the first of the Library Lecture Series funded
by Palm Beach County would take place Thursday, April 26 at 1:30 P.M., with author Les
Standiford as the guest speaker.
11. CONSENT AGENDA
NONE.
12. ADJOURNMENT
There being no further business to come before the Commission at this time, Mayor Reid
adjourned the Workshop Meeting at 2:10 P.M. upon MOTION by COMMISSIONER
