2001.02.06_TC_Minutes_Regular~s ~' • TOWN OF HIGHLAND BEACH MINUTES OF TOWN COMMISSION MEETING REGULAR MEETING Tuesday, February 6, 2001 1:30 P.M. Mayor Thomas J. Reid called the Regular Meeting to order in Commission Chambers at 1;30 P.M. Town Clerk Doris Trinley called the roll. The Mayor, Vice Mayor Michael W. Hill, and Commissioners John J. Sorrelli, Paul R. Kane and Robert L. Lowe were present. Town Attorney Thomas E. Sliney and Town Manager Ben Saag were also present, a were members of the general public. After roll call, the Pledge of Allegiance was given. 1. ADDITIONS. DELETIONS OR ACCEPTANCE OF AGENDA Hearing no objection, Mayor Reid declared the Agenda accepted as presented. 2. PUBLIC COMMENTS AND REQUESTS Jean Ellis, 4205 S. Ocean Blvd., expressed concern that professional beach cleaning equipment disturbed the natural environment of the beachfront; she suggested if such equipment was used, that the sand be pushed back toward the dune. 3. PRESENTATIONS Mayor Reid presented members of the Delray Beach Fire/Rescue Dive Team with a proclamation acknowledging their accomplishments in competition held in Orlando in October 2000. (copy attached and made part of these Minutes) 4. BOARDS AND COMMITTEES a) BOARD CORRESPONDENCE: NONE. B) BOARD VACANCIES: Victor Hadeed was unanimously appointed to the one (1) vacancy on the Planning Board, upon MOTION by COMMISSIONER SORRELLI/ COMMISSIONER LOWE. BOARDS AND COMMITTEES (continued) B) BOARD VACANCIES (continued) John DeMarco was unanimously appointed to one (1) of two (2) vacancies on the Board of Adjustment, upon MOTION by COMMISSIONER LOWE/ COMMISSIONER SORRELLI. It was the consensus to postpone filling the second vacancy at this time. C) BOARD ACTION REPORT: Mayor Reid read BAR report for the month of January into the record. D) MONTHLY BOARD MEETINGS: The schedule of meetings for the month of February was also read into the record by the Mayor. 5. PROPOSED ORDINANCES AND RESOLUTIONS (1) AN AMENDMENT TO THE TOWN OF HIGHLAND BEACH, FLORIDA, ADOPTING AN AMENDMENT TO THE INTERGOVERNMENTAL • COORDINATION ELEMENT OF THE TOWN OF HIGHLAND BEACH, FLORIDA, COMPREHENSIVE PLAN. (first reading 8/2/00; published 8/17/00; DCA approval 12/21/00) Upon MOTION by COMMISSIONER LOWE/COMMISSIONER SORRELLI, this amendment to the Comprehensive Plan was unanimously adopted by roll call vote; copies of the adopting ordinance, as well as the amendments, will be forwarded to the Department of Community Affairs per their instruction. (2) AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING ORDINANCE N0.680, WHICH APPROPRIATED FUNDS FOR THE FISCAL YEAR 1999-2000, WHICH BEGAN OCTOBER 1, 1999 AND ENDED SEPTEMBER 30, 2000. (first reading) (3) A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING RESOLUTION N0.594, PROVIDING FORWATERCONSERVATION RESTRICTIONS, EXCEPTIONS AND PENALTIES: N0.3 (PENALTIES) AND NO. 4 (IMPLEMENTATION). This Resolution was unanimously approved upon MOTION by COMMISSIONER SORRELLINICE MAYOR HILL. n LJ Minutes of Town Commission Meeting • February 6, 2001 Page 3 of 5 (4) A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING RESOLUTION 641, PERTAINING TO ADMINISTRATIVE FEES: NO. 24 (FALSE ALARMS). This resolution was unanimously approved upon MOTION by VICE MAYOR HILL/COMMISSIONER LOWE. (5) A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, REQUESTING THAT THE UNITED STATES CONGRESS AND THE FEDERAL AVIATION ADMINISTRATION (FAA) ADOPT AN AMENDMENT TO THE AIRPORT NOISE AND CAPACITY ACT OF 1990 TO PROVIDE THAT ALL NON-STAGE 3 DOMESTIC AND FOREIGN SUBSONIC TURBOJET AIRPLANES, INCLUDING THOSE WEIGHING LESS THAN 75,000 POUNDS, BE PHASED OUT OF SERVICE COMPLETELY BY JANUARY 1, 2005, OR AS SOON AS REASONABLY POSSIBLE ON AN AGGRESSIVELY ACCELERATED SCHEDULE; PROVIDING FOR SEVERABILITY, PROVIDING FOR A REPEALER CLAUSE AND AN EFFECTIVE DATE. • This resolution was unanimously approved upon MOTION by COMMISSIONER LOWE/COMMISSIONER KANE; copies will be sent to neighboring communities, as well pertinent county, state and federal agencies. (6) A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, APPOINTING PALM BEACH COUNTY SUPERVISOR OF ELECTIONS THERESA LE PORE TO REPRESENT THE TOWN CANVASSING BOARD IN CERTAIN ELECTION FUNCTIONS. Wth the Commission's approval, this Resolution was signed and transmitted to the Supervisor of Elections on January 17 because of Palm Beach County Elections Office time constraints, it was ratified this date upon MOTION by COMMISSIONER SORRELLI/COMMISSIONER iKANE. 6. NEW BUSINESS None. 7. MISCELLANEOUS -ITEMS LEFT OVER Upon MOTION by VICE MAYOR HILL/COMMISSIONER SORRELLI, the Minutes of the • January 2, 2001 Workshop Meeting were unanimously approved: • Minutes of Town Commission Regular Meeting February 6, 2001 page 4 of 5 8. REPORTS -TOWN COMMISSION Commissioner Robert L.Lowe noted that a new Police Officer started work today (Jeff Famiglietti); he further noted that all police shifts are now covered due to the volunteer services of the officers. Commissioner Paul R. Kane had no report. Commissioner John J. Sorrelli had no report. Vice Mayor Michael W. Hill referred to a recent Sun Sentinel editorial on changing voting structure in Florida. In this regard the Vice Mayor suggested that in the future Commission positions up for voting be identified as "Seat 1" and "Seat 2" to avoid confusion and allow the voter to cast a ballot for one candidate to fill each seat. Vice Mayor Hill further noted that the editorial suggested that the month of November be considered for municipal elections, as turnout has historically beeen stronger in November due to absentee ballots. Mr Saag responded that these possibilities will be reported on at the February Workshop. • Mayor Thomas J. Reid advised of a meeting with Sandy Simon, author of the book Remembering - A History of South Palm Beach County, noting that Mr. Simon had agreed to assist with the work of the Town's Historic Society. 9. REPORTS -TOWN ATTORNEY Town Attorney Thomas E Sliney had no report. 10. REPORTS -TOWN MANAGER Town Manager Ben Saag referred to a January 25 article in The Palm Beach Post which noted that the Highland Beach Police Department will receive federal grant money to hire two (2) new officers through the COPS program. Mr. Saag noted for the record that only 11 departments out of 400 that applied were successful, which meant the HBPD was in the top 3% of applicants. The Town Manager also advised that CH2M HILL will give an update on the status of the R.O. plant at the February 27 Workshop Meeting. 11.
