MINUTES OF TOWN COMMISSION MEETING
REGULAR MEETING
Tuesday, December 6, 2011 1.30 PM
Mayor Bernard Featherman called the Regular Meeting to order in Commission Chambers at 1:30 PM.
CALL TO ORDER:
Roll Call: Members present: Mayor Bernard Featherman, Vice Mayor Miriam S. Zwick; Commissioner
Doris M. Trinley; Commissioner John J. Pagliaro; and Commissioner Dennis J. Sheridan. Also present:
Town Attorney Tom Sliney; Town Manager Kathleen D. Weiser, Town Clerk Beverly M. Brown; Chief
of Police Craig Hartmann; Acting Finance Director Cale Curtis; Assistant to the Town Manager Zoie
Burgess; and members of the public.
Pledge of Alliance: The Pledge of Allegiance was given, followed by a minute of silence.
Civility Pledge: The Civility Pledge was recited by the Town Clerk.
1. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA
Mayor Featherman asked for any additions or deletions. Receiving none, the agenda was accepted
as presented.
2. PUBLIC COMMENTS AND REQUESTS
Carl Feldman — 3210 S. Ocean Blvd.
On Thursday, the Town Commission will be interviewing four law firms to replace our current Town
Attorney. In Highland Beach, we have two former Supreme Court judges and three attorneys that are
instructors at law schools. I am sure they would be willing to donate their services pro-bono to assist
the Commission with the interview and selection process. The Town Manager and her committee
shortened the list of potential candidates to four. Now you are going to interview them for ten minutes.
What information can you possibly get in 10 minutes?
Commissioner Pagliaro — I would like the Town Manager to answer the misinformation that was just
stated.

Town Manager Weiser — Only four firms' submitted proposals in response to our RFQ. Each one of
these four firms will be interviewed by each Commissioner for a total of twenty minutes.
George Kelvin — 4740 S. Ocean Blvd.
I agree with Mr. Feldman. We have a lot of professionals in the legal field that can give the
Commission advice and we should appeal to their expertise. Driving here today, I noticed some of the
palm trees along the walking path have coconuts ready to fall down and some of the trees have brown
fronds. Do not know who should be taking care of them, but the Commission should address it.
Mike Ferrara — Boca Highlands
I have been a practicing attorney with 32 years of municipal government experience. It is up to the
Commission to decide what they want the Town Attorney, Town Clerk and Town Manager to do.
Until the Commission decides what duties they are going to assign to the Town Attorney, they must use
the professional staff that they have hired.
3. PRESENTATIONS
• Special Presentation to Town Attorney Thomas E. Sliney, Esq. on his Retirement as Town
Attorney.
Mayor Featherman presented a plaque to Town Attorney that read as follows: In Grateful
Appreciation for your many years of Dedicated and Loyal Service to the Town of Highland Beach.
Highland Beach Town Attorney —1973 - 2011.
Town Attorney SUM - stated he appreciated the plaque; and representing the Town of Highland
Beach was the highlight of his legal career.
• Presentation of "Certificate of Completion" 2011 Institute for Elected Municipal Officials
Town MgWegr Weiser, on behalf of the Florida League of Cities and the Florida Institute of
Government presented a "Certificate of Completion" to Commissioner Sheridan for the completion
of the 2011 Institute for Elected Municipal Officials held October 14-16, 2011 in Tampa.
Commissioner Sheridan thanked the Town Commission for giving him the opportunity to attend this
worthwhile education experience.

A) Commissioner Dennis J. Sheridan — Since this is Town Attorney Sliney's last meeting, I would
like to thank him for his thirty years of service and devotion to the Town of Highland Beach.
Wish him health and happiness.
B) Commissioner John J. Pagliaro, — Would also like to thank Town Attorney Sliney for his
attention to the Town.
C) Commissioner Doris M. Trinlev — Attorney Sliney — it has been a pleasure working with you
all these years. Thank you for the many years of professionalism you have given the Town.
Wish you well.
D) Vice Mayor Miriam S. Zwick — Concur with my fellow Commissioners. It has been a pleasure
working with him.
I have been approached by a number of residents about the trees planted on A1A. Who is
responsible? Supposedly two of the newly planted trees are dead. Town Manager Weiser —
Will check, but believe it is the responsibility of the property owner. Town Attorney —
It depends on where the trees are located.
E) Mayor Bernard Featherman — Compliment the Town Attorney on the exemplary job he has
done for the Town.
Bicyclists riding four abreast are a constant traffic problem. Would like to see the Town make

a code amendment addressing this problem to protect our residents. Comm. Pagliaro — Since
A I A is a state road, is it in our purview? Town Attorney Sliney — Yes it is a state road.
Special tax to clean the beaches — resident survey indicates 4-1 against.
Sidewalks — Would like to have the staff review the condition of the sidewalks and determine
if we can repair them.

Town Attorney Sliney — Wish you the best, have enjoyed working with you.
Flag etiquette —We have received conflicting information received from the state. Have received an
email from the State requesting that we hold off adopting a policy until they revisit this subject.
11. CONSENT AGENDA
Mayor Featherman asked if any item needed to be removed from the Consent Agenda.
Comm. Sheridan — On the application of Michael Kravit, question #6 was not completed Even
though he is more than qualified, I would like to see a completed application.
Vice Mayor Zwick — The Town Clerk can contact him and request that the application be completed,
without the Commission holding up the application.
Town Clerk Brown read the Consent Agenda into the record.
A) Appointment of Elyse Riesa to the Beaches & Shores Advisory Board for a two-year
term.
B) Appointment of Michael Kravit to the Code Enforcement Board for a term ending May
2014.
C) Adoption of RESOLUTION 11-011 R
A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING
RESOLUTION NO. 10-013 R WHICH APPROPRIATED FUNDS FOR THE 2010-2011
FISCAL YEAR BUDGET WHICH BEGAN OCTOBER 1, 2010 AND ENDS
SEPTEMBER 30, 2011.
D) Authorization for the Mayor to sign Drinking Water State Revolving Fund Amendment 1

E) Approval of Contract with Engenuity Group, Inc. to serve as Engineer of Record for
General Engineering Services for the Town.
F) Setting December 8h at 1:30 pm as a Special Meeting date for the Selection of a Firm to

H) Authorization to fiord the Town joining the Boca Raton Chamber of Commerce and the
Delray Beach Chamber of Commerce.

12. PUBLIC COMMENTS AND REQUESTS RELATED TO ITEMS DISCUSSED AT
MEETING
Arlin Voress — 4403 Intracoastal Drive
I worked with Tom Sliney when he first came to the Commission. Want to thank him for all the
work he has done for the Town. A number of years ago, the Town received a judgment against
them for 36 million dollars and Tom was able to negotiate it down to 5 million.
George Kevin — 4740 S. Ocean Blvd.
Vice Mayor Zwick alluded to the palm tree situation. Do not know if it is the Town or property
owner that needs to maintain the trees in front of residents. Suggest that the Town maintain the
trees and then bill the property owners.

I would like to remind everyone that tomorrow is December 7t' — Pearl Harbor Day. Let us not
forget the troops that lost their lives. Also would like to wish everyone a Merry Christmas and a
Happy Hanukkah.

Would like to thank the Commission for allowing us to return to Highland Beach and help you
maintain the quality of life that you are comfortable with.
Harold Hagelmann — 4740 S. Ocean Blvd.
I have worked with Tom Sliney, and he is an excellent attorney. I know about the palm trees on
A 1 A as I obtained the grant. When the trees were bought, they were guaranteed for one year. We
do not have all Royal Palms due to FDOT being afraid of disease. It is the Town's
responsibility to take care of the trees.

There being no further business to come before the Commission, Mayor Featherman adjourned the
Regular Meeting at 2:10 PM upon a MOTION by Commissioner Sheridan seconded by Vice
Mayor Zwick.
