2000.05.09_TC_Minutes_Special0 TOWN OF HIGHLAND BEACH MINUTES OF TOWN COMMISSION MEETING SPECIAL WORKSHOP MEETING Tuesday, May 09., 2000 1.00 P.M. Mayor Thomas J. Reid called the Special Workshop to order in Commission Chambers qt 1:00 P.M., advising its purpose was to continue review of revised Chapter 30 (Zoning Code). Town Clerk Doris Trinley called the roll. The Mayor, Vice Mayor Michael W. Hill, and Commissioners John J. Sorrelli, Paul R. Kane and Robert L. Lowe were present. Town Attorney Thomas E. Sliney and Town Manager Ben Saag were also present, as were Planning Consultant Marty Hodgkins, Building Official Bob Dawson and members of the general public. After roll call, the Pledge of Allegiance was given. Having been advised that Dr. James Conlen (4317 Intracoastal Drive) wished to address • the Commission on a section of the revised code not yet reviewed, it was the consensus to accommodate him before returning to the order of review previously agreed upon. Review was started at Section 8-G Accessory Marine Facilities [page 53]. Lengthy discussion took place regarding G (1)b as to language identifying who would have the right to dock a boat on a given property and for how long a time, if a guest of the owner. It was advised that the Planning Board had given this issue serious attention, even to the point of considering boat registration, which idea was discarded for numerous reasons, including that policing the issue would be prohibitive. Concluding discussion, the Commission agreed with the Planning Board's reasoning, including that policing the issue would be prohibitive in many ways; rather, the Town would rely on residents of neighboring properties to register any legitimate complaint in a specific instance on which the Town might legally take action. Dr. Conlen's issue was next addressed. He advised he was seeking relief from the requirements of Section 8-G (6)d(i) [page 55], as there was no revision in the proposed code in the side setback requirements for docks, i.e., 25' for lots 70' or more; 15' for lots 70'or less. Dr. Conlen explained his lot is 77' with 15' side setbacks as required by a previous code; he advised a barge had recently destroyed one of the pilings and requested he be allowed to replace it in its previous 15' setback. After extensive discussion, it was the consensus that this section of Code be left in tact and Dr. Conlen petition the Board of Adjustment for a variance. • Minutes of Town Commission Special Workshop Meeting May 09, 2000 Page 2 of 2 After completing review of Section 8-G, Mayor Reid called for a 10 -minute recess at 2:45 P.M.; the meeting reconvened at 2:55 P.M. with all present as noted at the start of these Minutes. Review of Sections 13 through 15 (Zoning Text Amendments/pages 35 through 38) and Article 4 (Zoning Districts/pages 39 through 46) took place. Questions were answered to the Commission's satisfaction; suggestions/additions/revisions to text and tables, which were made by the Commission and Town Manager, were noted by Mr. Hodgkins for inclusion in the final draft. Likewise, the tables referred to within these sections will also be identified and placed correctly within the text. At 4:05 P.M., it was agreed to conclude this review session, and it was the consensus to continue on Tuesday, May 23, 2000 at 1:00 P.M.
