2000.05.01_TC_Minutes_SpecialTOWN OF HIGHLAND BEACH MINUTES OF TOWN COMMISSION MINUTES SPECIAL MEETING Tuesday, May 01, 2000 11: 15 A.M. Note: This was to be the Special Meeting before Session 2 of an advertised Attorney -Client Private Session. Mayor Thomas J. Reid called the Special Meeting to order in Commission Chambers at 11:15 A.M. Town Clerk Doris Trinley called the roll. The Mayor, Vice Mayor Michael W. Hill„ and Commissioners John J. Sorrelli, Paul R. Kane and Robert L. Lowe were present. Town Attorney Thomas E. Sliney and Town Manager Ben Saag were present, as were Attorney Larry Corman, Attorney Debra B. Potter and members of the general public. After roll call, the Pledge of Allegiance was given. • Attorney Sliney advised that there was a difference of legal opinion between the Town's attorneys and attorneys representing The Sun Sentinel regarding the Attorney -Client Session which was to follow, because no actual litigation had commenced. Mr. Sliney further advised that, after conferring with the Town Manager, it was agreed that, rather than argue the point, an Attorney -Client Session would not be held; rather the Special Meeting now underway would be the vehicle wherein strategy regarding the Hoffmann property would be discussed. By way of background it was noted that attorneys for Camille Hoffmann had presented a petition to the Town wherein vested rights were claimed for the Hoffmann property (7+ acres) as part of an original RPUD, along with a proposal to build a 150 -unit adult congregate living facility (ACLF). It was further noted that attorneys for the Omega Group, whose property is immediately to the north, and Jeffrey Pechter, a resident whose property is immediately to the south, had addressed the Commission in opposition to the Hoffmann petition. Therefore, it was advised by the Town's attorneys that it would be in the best interests of the Town to file a Complaint for Declaratory Relief with the Court, thereby asking the Court to decide the issue. After some discussion, the Commission agreed to this filing, and also to include in its language that the Commission favored the current zoning density (6 units per acre), and also current land use, i.e., there is no section of the current zoning code which addresses ACLF's. MOTION to this effect was made by COMMISSIONER KANEXOMMISSIONER SORRELLI, followed by unanimous favorable roll call vote. • Minutes of Town Commission Special Meeting May 1, 2000 Page 2 of 2 Attorney Larry Corman advised that the Complaint for Declaratory Relief would be filed this date.
