Special conditions and circumstances exist which are peculiar to the land, structure or building involved, and which are not applicable to other lands, structures or buildings in the same district. 2. The special conditions and circumstances do not result from the action of the applicant. 3. Granting the variance requested will not confer on the applicant any special privilege that is denied by the ordinance to other lands, structures or buildings in the same district. 4. Literal interpretation of the provisions of this ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of the ordinance, and would work unnecessary and undue hardship on the applicant. 5. The reasons set forth in the applicant's petition justify the granting of the variance, and the variance granted is the minimum reasonable variance that will make possible the reasonable use of land, structure or building. 6. Granting of the variance will be in harmony with the general purpose and intent of the ordinance, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Chapter 30, Zoning Code/Article III; Sec. 30-40(h): A variance, when implemented in accordance with the approval granted by the Board of Adjustment and Appeals, shall run with the land in perpetuity. Unless a lesser time is approved by the Board of Adjustment and Appeals, a variance that is not implemented shall expire eighteen (18) months following approval. Extensions of variance approvals shall not be granted by the Board of Adjustment and Appeals. After each paragraph, state fully your reasons justifying the granting of this variance. (a) That special conditions and circumstances exist which are peculiar to the land, structure,or building involved and which are not applicable to other`.ands, structures or buildings in the same district; The house is within all setbacks required and the remaining area to locate the swimming pool results in a pool of eight foot in width with the pool jammed tight to the rear supporting columns of the house. With a variance of five feet to allow the pool to utilize some of the rear pool patio area that has previously been approved, the pool can be thirteen feet in width. This is still a minimum size pool for a house of this size. The use of the approved pool deck area for a portion of the pool itself does not change the visual aesthetics of the rear patio area of the house to any neighbor. The pool deck will extend to the outer edge of the concrete slab of the dock. The dock is five feet seaward of the four foot width seawall and thus there will be fourteen feet west of the pool edge to the waters edge of the deck of the dock. This in effect exceeds the the ten foot original intent of the rear yard set back ordinance. Soil conditions on this lot were extremely poor and necessitated over 141 pilings for all of the house and pilings for the structural supports for the rear balconies and the pool. This required pilings in the rear yard that encroached on the pool area resulting in an eight foot wide pool. (b) That the special conditions and circumstances do not . result from the actions of the applicant; The conditions of the size of this lot are not the result of the owner nor were the unsuitable soil conditions necessitating an excessive number of support pilings. (c) That granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands,buildings or structures in the same district. This same relief would be available to others upon application. Similar variances were granted to 1087 Bel Lido Dr on July 11, 2005 and 43071ntracoastal Drive on March 1,2005. The granting of this variance will have no effect on any neighbor. The visual aesthetics of the property will be virtually identical to the look of the smaller pool. (d) That the literal interpretation of the provisions of this ordinance would deprive the applicant of the rights commonly enjoyed by other properties in the same district under the terms of this ordinance and would work unnecessary and undue hardship on the applicant. The literal interpretation of the ordinance would deprive the applicant of an adequate size pool for a house in this neighborhood.
