Knight, Board Member Max Angel, Board Member Peter Corrales, Board Member Paul Resnick, and Board Member Carol Stern. Members Absent: Board Member Dennis Sheridan (excused) Also Attending: Building Official Michael Desorcy, Town Attorney Tom Sliney, Deputy Town Clerk Valerie Oakes and members of the public. CALL TO ORDER: Vice Chair Knight called the Special Meeting to order at 9:30 AM. Roll call was taken by Deputy Town Clerk Oakes. The Pledge of Allegiance followed. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA: MOTION: Board Member Angel moved to accept the agenda as presented. Board Member Stern seconded the motion, which passed unanimously. PUBLIC COMMENTS AND REOUESTS: None. PRESENTATIONS: Announcement: Welcome Peter Corrales and Carol Stern as the newest members of the Board. Vice Chair Knight welcomed Peter Corrales and Carol Stern as the newest members of the Board. There is currently one (1) vacancy on the Board, if interested, contact the Town Clerk's Office and fill out a Talent Bank Application. Furthermore, an election will be held for the position of Chair at the next meeting. Planning Board Special Meeting 08/04/10 Page 1 of 4 APPROVAL OF MINUTES: • March 10, 2010 — Regular Meeting MOTION: Board Member Resnick moved to approve the minutes from the March 10, 2010, Regular meeting. Board Member Angel seconded the motion, which passed unanimously. • March 25, 2010 —Special Meeting MOTION: Board Member Resnick moved to approve the minutes from the March 25, 2010, Special meeting. Board Member Angel seconded the motion, which passed unanimously. OLD BUSINESS• None. NEW BUSINESS: A. Application # 26720 - 4216 Intracoastal Drive; 881 Appleby Street, LLC PRELIMINARY REVIEW FOR THE CONSTRUCTION OF A SINGLE-FAMILY RESIDENCE; APPLICANT: ALBANESE HOME BUILDERS, INC. Vice Chair Knight read aloud the title of the application. Members of the Board were asked to disclose ex-parte communication. Vice Chair Knight disclosed that she was the representative for the seller in the transaction of Doris Canova. Had spoken to the contractor regarding concerns of the neighbors. Town Attorney Slim stated that it is not a problem. Ex-parte communication is disclosing any conversation with the applicant. Michael Desorcy, Building Official — The matter before you is a preliminary review for the construction of a single-family residence at the property located at 4216 Intracoastal Drive. The plans meet the Town of Highland Beach Code of Ordinances; therefore, it is my recommendation that the plans be approved as submitted. Vice Ch. Knight — What is the final height of the home? Bldg. Official Desorcy — Code only requires that the plans only disclose a mean height. In the review process, it is not relevant. Vice Ch. Knight — In Chapter 30, Table 30-2, Property Development Regulations, shows a maximum building height. Can that be added to the plans? Bldg. Official Desorcy — Did not think that was relevant. Member Resnick — That should be included on the plans. Member Stern — Is there a height limit? Vice Ch. Knight — 35 feet. Bldg. Official Desorcy — The definition of building height is in the back of the chapter. Chapter 30-124, Figure 30-8 should be amended down the line. Town Attorney Sliney — The Building Official stated the plans meet code. Steve Albanese, General Contractor_ of Albanese Home Builders, Inc — At this point, we cannot determine the Planning Board Special Meeting 08/04/10 Page 2 of 4 exact height of the roof because we do not know the profile of the tiles.. We met the code requirement by providing the mean building height, which is a predetermined height. Bldg. Official Desorcy — The final survey would reflect that at the conclusion of construction. Vice Ch. Knight — Sheet A3 has been clarified. Sheets D1, S2 and S4 are missing dimensions, which need to be filled in on the plans. Bldg. Official Desorcy — Okay. Vice Ch. Knight called for an affirmative or negative motion to approve the construction of a single-family residence for the property located at 4216 Intracoastal Drive. MOTION: Member Resnick moved to approve it. Member Stern seconded the motion. Discussion: Vice Chair Knight — Would like to amend the motion with the condition to include that the missing dimensions be filled in. Bldg. Official Desorcy — I will get a list of those. AMENDED MOTION: Member Resnick moved to approve the amendment as proposed. Member Stern seconded the motion. Town Attorney Sliney — Is this a preliminary or final review? Vice Ch. Knight — The application states that this is a preliminary review; however, it will be approved as a final review. Town Attorney Sliney — The motion needs to be clarified by stating whether this is a preliminary or final review. Steve Albanese — Detail takes precedence over the schedule, which is generic. Those numbers cannot be specific. Bldg. Official Desorcy — The sizes are specified on sheet Al; they are on the architectural and/or structural drawings. Member Angel — Because you are so concerned with these missing numbers, I fear signing the plans. Vice Ch. Knight — The only condition is to submit specifications that are on the plans. Perhaps submit a memorandum confirming that the interior wood does not exist, which is why there are no dimensions. Bldg. Official Desorcy — There is no need for a memo; the plans are self-explanatory. Member Corrales — Leave this up to the Building Official. Bldg. Official Desorcv — My recommendation is to approve the plans for final review as submitted. Member Angel — Why are we here if we are passing it on to the Building Official? Member Corrales — What is the role of the Planning Board? Town Attorney Sliney — The Board is here to review the site plan. It is the Building Official's responsibility to make sure the plans meet code. If the plans meet the code, then the Planning Board has an obligation to approve the plans. Vice Ch. Knight — There is no reason to amend the main motion Planning Board Special Meeting 08/04/10 Page 3 of 4 MOTION: Member Resnick moved to approve the plan as submitted subject to the Building Official obtaining whatever else is needed if there is anything else needed. Member Corrales seconded the motion. Member Angel — What is our function? Town Attorney Sling y — To look and review site plans. The Board gives comments on the plans, but if the plans meet the code, it is the Board's function to approve them. The code states the Planning Board must review site plan applications. Member Resnick — Are we rubber-stamping the Building Official? Town Attorney — There are two reasons for the Board to review plans: 1. the citizens have the right to know and hear about the application, and 2. there may be something that catches your eye.
