1988.01.20_CEB_Minutes_Regular• TOWN OF HIGHLAND BEACH, FLORIDA CODE ENFORCEMENT BOARD REGULAR MEETING - Minutes Wednesday, January 20, 1988 10.00 A.M. A Regular Meeting of the Code Enforcement Board, Town of Highland Beach, Florida, was called to order by Chairman William E. Paul at 10:00 a.m. in the Town Commission Chambers at Town Hall. (Note: There was no Workshop Meeting held today.) The Recording Secretary called the roll. Present were: Chairman William E. Paul, Vice Chairman Joseph Boulay, Theodore Boepple, and Edward Pearlstein. Joseph Sieff and Pamela Perona were absent. Also present were: Building Official/Code Enforcement Officer Bruce Sutherland, Acting Town Manager Mary Ann Mariano, Deputy Town Clerk/Recording Secretary Elizabeth L. Kolek, and members of the public. Minutes of the Workshop Meeting and the Regular Meeting of • October 21, 1987, were read and approved as submitted, with no objection. MOTION was made by Edward Pearlstein/Theodore Boepple to nominate William E. Paul as Chairman and Joseph Boulay as Vice Chairman. The MOTION carried with favorable votes. OLD BUSINESS: There was no old business to discuss. NEW BUSINESS: Chairman Paul noted a Regular Member vacancy (due to the recent death of Eugene Snyder) and introduced Mrs. Jane Rayner as a prospective member of the Code Enforcement Board. Mrs. Rayner had previously served 6 years on the Financial Advisory Board. Acting Town Manager Mrs. Mariano stated, in reply to Chairman Paul's question, that the Board could send a memo to the Town Commission with a recommendation. The Recording Secretary was directed to compose a Memorandum to the TownCommission recommending that Jane Rayner be appointed to the Code Enforcement Board. Joseph Boulay stated that he has noticed some violations around Town and wondered why there were no recent Citations to come before the Board. Building Official Sutherland stated that a Citation has just been issued to the Hidden Harbor property relative to non -completion, etc., which matter may come before the Code Enforcement Board for action. Bruce Sutherland explained the procedures of the Building Official/Code Enforcement Officer and stated that his work involves Town Code compliance relative to new Code Enforcement Board Regular Meeting - Minutes January 18, 1988 Page 2 of 2 • construction of buildings. He also explained that he personally tries to get any problems corrected before a Notice of Violation is issued. If the problem still exists at the expiration of the Notice of Violation, a Citation is issued. If the problem is not corrected or resolved, the matter is then heard by the Code Enforcement Board, who can take action. Mr. Boulay cited a business truck that had been parked on the canal side (rear of property, which only neighbors could see) instead of the street side of a house under construction in the Bel Lido area. Mr. Sutherland stated that type of matter is usually handled by the Police Dept. if it occurs after working hours and that business trucks & vehicles are not normally checked for infractions during working hours. Mr. Sutherland stated that he has also issued Notices of Violation to Boca Hi and Enclaves of Boca Cove, who may comply before a Citation is necessary. Mr. Boulay stated that during a recent Planning Board Meeting a new application for five dolphins on Russell Drive was discussed and the Planning Board based part of their reason for possible acceptance on the action taken by the Code Enforcement Board in a similar matter that involved Tom Gullett installing two offshore • dolphins (for one boat) before asking for permission, which Code was adhered to after the fact. Mr. Boulay felt the Board should be careful in setting precedents and that the Board should watch what is happening in that area of the canal. • Chairman Paul stated that the next Meeting will be held on Wednesday, February 17, 1988, with a Workshop Meeting at 9:30 a.m. and a Regular Meeting at 10:00 a.m. MOTION to adjourn the meeting was made by Mr. Boepple/Mr. Pearlstein, at 10:20 a.m. All v Jed Aye.
