1988.02.17_CEB_Minutes_RegularTOWN OF HIGHLAND BEACH, FLORIDA • CODE ENFORCEMENT BOARD REGULAR MEETING - Minutes Wednesday, February 17, 1988 10.30 A.M. A Regular Meeting of the Code Enforcement Board, Town of Highland Beach, Florida, was called to order by Chairman William E. Paul at 10:30 A.M. in the Town Commission Chambers at Town Hall. The Recording Secretary called the roll. Present were Chairman William E. Paul, Vice Chairman Joseph Boulay, Theodore Boepple, Edward Pearlstein, Pamela Perona and Lowell Blum. Absent was Joseph Sieff. Also present were Building Official/Code Enforcement Officer Bruce Sutherland, Recording Secretary Anne Kowals and members of the general public. Chairman Paul noted the Minutes of the Code Enforcement Board Regular Meeting on January 20, 1988 were submitted for approval. MOTION was made by Mr. Boulay/Mr. Boepple to accept the minutes as submitted. The MOTION carried with all favorable votes. OLD BUSINESS: is There was nothing under Old Business for discussion. NEW BUSINESS: Citation No. 2271 - BROADVIEW SAVINGS & LOAN COMPANY - NONCOMPLIANCE WITH AGREEMENT FOR PHASE II DATED AUGUST 11, 1987 REGARDING TOWN LOTS 59, 60, 62, 65, 69 WEST (HIDDEN HARBOR). Chairman Paul said the Code Enforcement Board will have to draft an ORDER regarding this matter. Members discussed a time frame and Town Attorney Sliney said it would be his suggestion that the Board issue an ORDER stating the property owner has a period of 60 days from this date to either complete the project in accordance with Phase II Permit issued by the Town previously or to come into compliance with the Town Code by the issuance of an extension of the Phase II permit. Attorney Sliney explained that in the interim, the property owner will be back to the Town Commission to attempt to get his permit reinstated. We are trying to get this going --either you complete the project or get reinstated or the Code Enforcement Board will levy a fine for noncompliance. Attorney Sliney said the Code Enforcement Board would have a time frame in the ORDER. Only the Town Commission can reinstate their permit. The • Town will allow "x" number of days if it reinstates the permit. If they do not comply with a new permit, then your Board will have jurisdiction again. Attorney Sliney asked if there was any ambiguity as to what permit is being discussed; he added that he was talking about the Town permit. Attorney Worsham noted that they have to comply with the other permits along with the Town Permit. Attorney Sliney said they have to complete the scope of work or come into compliance by getting a Town permit within 60 days. At the end of 60 days from this date, either complete the work authorized by the Town's previously issued permit or come into compliance of the Town Code by getting an extension of those permits. If you fail to do that, then you will be subject to fine authorized by this Board (a fine of up to $250/day). The Board would issue a subsequent order of noncompliance. The following MOTION BY Mr. Boepple/Mr. Pearlstein was favorably received by all. "The Code Enforcement Board issued an ORDER that the property owner has a period of 60 days from this date to either complete the project in accordance with Phase II permit issued by the Town previously, or to come into compliance with the Town Code by the issuance of an extension of Phase II permit." Chairman Paul said the next Meeting of the Code Enforcement Board will be on March 16, 1988, with the Workshop at 9:30 A.M. and the Regular at 10: 00 A.M. Upon MOTION BY Mr. Boepple/Mr. Blum, Chairman Paul adjourned the Regular Meeting at 10:45 A.M. APPROVED: William E.
