CODE ENFORCEMENT BOARD
WORKSHOP MEETING - MINUTES
JANUARY 21, 1987 9:30 A.M.
The Workshop Meeting of the Code Enforcement Board, Town of Highland
Beach, Florida was called to order at 9:30 A.M. by Acting Chairman
Alfred Novak.
The Recording Secretary called the roll. Present were Messrs. A. Novak,
T. Boepple, J. Sieff and D. Robinson.
Regular Member E. Pearlstein was absent.
Also present were Code Enforcement Officer A. Abbate, Town Attorney S.
Abrams and Recording Secretary/Town Clerk M. A. Mariano.
Recording Secretary Mariano read the Minutes of the December 17, 1986
Workshop Meeting. Approval of these Minutes was held in abeyance until
the Regular Meeting.
Talent Bank applicants Sheldon Blumenkrantz and Joseph Boulay introduced
themselves and expressed their desire to serve the Town on the Code
• Enforcement Board. Mr. Robinson thanked both gentlemen for their
interest in Town affairs.
Attorney Abrams reminded the Board that any decisions rendered today
would need unanimous consent as there were only four members present,
according to statute. Also noted by Attorney Abrams was the fact that
the violation necessitating the issuance of Citation No. 2264, had been
corrected and the Town Code complied with. This involved the violation
of Section 24-8, "Unlawful to obstruct or injure pavement, curbing,
gutter sidewalk or bicycle -walking path", between Coronado and
Casuarina.
Preliminary discussion took place regarding Citation No. 2265 issued to
Thomas Gullets for violation of Town Code Section 5.2 (d), "No dolphins
of freestanding moorings shall be permitted unless specifically approved
by the Planning Board". Code Enforcement Officer Abbate submitted
pictures of the violation. Attorney Abrams noted that the dolphins had
been installed without proper permit or approval from the Planning
Board. It was also noted that the dolphins were within any zoning
limitations of the Town and would have most likely been approved by the
Planning Board if proper procedure had been followed. Attorney Abrams
stated that it was the duty of the Code Enforcement Board to handle the
violation and issue an ORDER on it. There is a possibility that Mr.
Gullett might come into compliance with the Town Code prior to any time
limitation given on the correction of the violation. Testimony on this
matter and a determination will be made at the Regular Meeting.

With regard to the Knaus matter (Citation No. 2263) Town Code Section
5.2 (d) (1), Attorney Abrams gave a brief summary of the action of the
Code Enforcement Board up to this date, indicating that the matter had
been deferred from the December Meeting in order to allow Mr. Knaus
ample time to have representation present, as well as seek any other
remedies to come into compliance with the Town Code. Mr. Abbate noted
that several letters from neighbors opposing the retention of the dock
had been received, which letter will be read into the record at the
Regular Meeting. Testimony and determination will be made at the
Regular Meeting.
Former Code Enforcement Board Chairman Robert F. Scholz then addressed
the Code Enforcement Board regarding a letter dated December 31, 1986,
from Douglas G. McTaggart, owner of adjacent property to the Knaus'.
Mr. Scholz noted several portions of the letter regarding Mr.
McTaggart's dissatisfaction with the Code Enforcement Board's handling
of the Knaus matter, with particular emphasis on Mr. Scholz' participa-
tion as Chairman of the Code Enforcement Board. Mr. Scholz noted that
in his six year tenure on the Code Enforcement Board, there had never
been a blemish on his reputation, and felt that clarification of this
matter was needed on the record. Mr. Scholz stated that the action
taken by the Code Enforcement Board in the Knaus matter had been
unanimous action and was taken to assure due process of the law to the
• violator, and not taken due to any negligence on the part of the Code
Enforcement Board in the carrying out of their duties. Mr. Scholz noted
that he resented the comments made in Mr. McTaggart's letter and
considered it to be written in a threatening manner to the Code
Enforcement Board. The members of the Code Enforcement Board stated
that they felt that the Code Enforcement Board had acted properly in the
matter and were supportive of Mr. Scholz in his criticism of the letter,
with Mr. Robinson commending Mr. Scholz for his service to the Town
during his term of office on the Code Enforcement Board.
Upon proper MOTION, the Workshop Meeting was adjourned by Acting
Chairman Novak at 9:50 A.M.
