WORKSHOP MEETING - MINUTES
May 20, 1987 9.30 A.M.
Chairman Paul called the Workshop Meeting of the Code Enforcement
Board, Town of Highland Beach, Florida to order at 9:30 a.m. in the
Town Commission Chambers at Town Hall.
The Recording Secretary called the roll. Present were Messrs. W.
Paul, A. Novak, T. Boepple, E. Pearlstein, E. Snyder and J. Boulay.
Absent was J. Sieff.
Also present were Code Enforcement Officer A. Abbate, Town Attorney S.
Abrams, T. Clerk Mary Ann Mariano and members of the general public.
The Recording Secretary read the Minutes of the April 15, 1987 Work-
shop Meeting, the April 15, 1987 Regular Meeting and the April 29,
1987 Special Meeting of the Code Enforcement Board. Approval of these
Minutes were deferred until the Regular Meeting.
Chairman Paul noted that the matter to be taken up at the Regular
Meeting was Citation No. 2269, issued to Loretta Masciarella for vio-
lation of Town Code Section 27-1, Florida Uniform Traffic Control Law
and 316.2045, Obstruction of Public Streets, Highways and Roads.

Chairman Paul read Section 316-2045 into the record as follows:
"It is unlawful for any person or persons willfully to
obstruct the free, conveneient and normal use of any public
street, highway or road, by impeding, hindering, stifling,
retarding or restraining traffic or passage thereon, or by
endangering the safe movement of vehicles or pedestrians
travelling thereon..."
Code Enforcement Officer Abbate gave the Board a brief history on the
issuance of the Citation, noting that four illegal posts had been in-
stalled on the right-of-way of the property. Mr. Abbate noted that
the posts had been filled with concrete and were secured by a 2' in
diameter concrete base in the ground. The posts were installed in
early April, with the Citation issued on April 8, 1987 and subsequent
issuance of the Notice of Hearing and Subpoena on April 16, 1987. Mr.
Abbate then noted that mailboxes had been placed on top of the posts
on Friday, May 15, 1987. Chairman Paul cited a memorandum from the
Town Manager in which it was noted that Postal Regulations required
that any buildings with three or more units have mailboxes in one cen-
tral location. Code Enforcement Officer Abbate contended that the
posts as installed are illegal barricades which are dangerously situ-
ated endangering the safe movement of traffic. Mr. Abbate also noted
that the Department of Transportation had expressed concern over the
•illegal posts and were awaiting the Town's action on the matter. If
the Town is unable to resolve the matter, the DOT will remove the

illegal posts and bill the owner of the property. Mr. Abbate noted
that he had attempted to work the problem out with the Masciarella's
to no avail. Mr. Boulay pointed out that the posts were originally
either red or orange, and had only been painted white when the mail-
boxes were placed on top of the posts. Testimony in this matter and a
determination will be made at the Regular Meeting.
This Workshop Meeting was then adjourned at 9:55 a.m.
