WORKSHOP MEETING
FEBRUARY 19, 1986 9.30 A.M.
Chairman Robert F. Scholz called the Workshop Meeting of the Code En-
forcement Board, Town of Highland Beach, to order at 9:30 A.M.
The recording secretary called the roll. Present were Secretary Ellen
Gerber, Messrs. Robert Scholz, Theodore Boepple, Alfred Novak, Edward
Pearlstein and Joseph Sieff. Also present were Code Enforcement Of-
ficer/Building Inspector Anthony Abbate, Chief William Cecere, Build-
ing Official Bruce Sutherland, Town Manager Hugh Williams, Town At-
torney Richard Barkin, Recording Secretary Anne Kowals and a few
Town residents.
Chairman Scholz mentioned the board is very saddened at the passing of
Robert Myers who will be very much missed. Secretary Ellen Gerber, on
behalf of the Code Enforcement Board, wrote a letter of condolence to
Mrs. -,Myers, continued Chairman Scholz.
We will have to nominate a Vice Chairman during our Regular Meeting,
• said Chairman Scholz, and I will suggest that Secretary Ellen Gerber,
the senior member of the board, be nominated Vice Chairperson.
Secretary Ellen Gerber read the minutes of the Workshop Meeting held
on December 18, 1985. Approval of these minutes was held in abeyance
until the Regular Meeting.
Chairman Scholz welcomed the newest appointee to the Code Enforcement
Board, Dr. Joseph W. Sieff.
Chairman Scholz read into the minutes Section 6.5 of Chapter 30 which
deals with 'Nonconforming Structures' which applies to the citation
that was issued to James Mac Kay. This citation, continued Mr. Scholz,
will be discussed at the Regular Meeting.
When Dr. Sieff questioned the prior citation issued to Mr. Mac Kay,
the Code Enforcement Officer/Building Inspector Anthony Abbate stated
the citation was issued by the Department of Natural Resources because
Mr. Mac Kay constructed a seawall without proper permitting. A fine
of $10,000. was imposed by the DNR.
Secretary Gerber referred to the Code Enforcement Board's "Policy re -
is garding Construction Projects in Highland Beach", dated September 22,
1982, copy of which was given to each member as it addresses the issue
of whom is to receive the citation for any violation at a construction
site.

Chairman Scholz read into the minutes a letter dated January 28, 1986,
from Town Attorney Sliney to Town Manager Williams concerning the
Attorney General's Opinions. This is important, said Chairman Scholz,
and will be discussed at the Regular Meeting under 'Old Business'.
A memorandum dated February 5, 1986, from the Town Clerk to all Town
Boards concerning Amended Policy re. Appointment to Boards was read
into the minutes by Chairman Scholz.
Chairman Scholz reminded the board members that there are four ques-
tions that are appropriate to the operation of the Code Enforcement
Board.
1. Does a violation of the Code of Highland Beach exist?
2. If so, have the violators been notified?
3. If so, have the violators been given sufficient
time to rectify the violation?
4. Has it been rectified to the satisfaction of the
Town of Highland Beach?
When Mr. Novak questioned the opinion of the Attorney General regarding

the schedule of fines after an order is issued, Chairman Scholz ex-
plained that the Code Enforcement Board can not, under any circum-
stances, devise a payment plan.

Secretary Gerber mentioned the Regular Meeting of December 18, 1985
ended abruptly and the Code Enforcement Board Members never followed
through on citation #01162. In pursuing the matter, Secretary Gerber
learned that said citation has been satisfied.
Chairman Scholz adjourned the Workshop geeting at
