1986.12.17_CEB_Minutes_Workshop0 0 TOWN OF HIGHLAND BEACH, FLORIDA CODE ENFORCEMENT BOARD WORKSHOP MEETING - MINUTES DECEMBER 17, 1986 9:30 A.M. Chairman Robert F. Scholz called the Workshop Meeting of the Code Enforce- ment Board, Town of Highland Beach, Florida, to order at 9:30 A.M. The Recording Secretary called the roll. Present were E. Gerber, Messrs. R. Scholz, A. Novak, T. Boepple, E. Pearlstein, J. Sieff and D. Robinson. Also present were Board Attorney Stephen Abrams, Code Enforcement Officer Anthony Abbate and Recording Secretary Mary Ann Mariano. Secretary/Vice Chairperson Gerber read the Minutes of the November 19, 1986 Workshop Meeting. Approval of these minutes was held in abeyance until the Regular Meeting. Preliminary discussion took place regarding a citation which was the sub- ject of the Regular Meeting. It was noted that a question exists as to whether a boat dock had in fact existed on the site at the time the pro- perty was purchased by the present owner, being the violator in this issue. It was the contention of Code Enforcement Officer Abbate that a current survey of the property would show whether the boat dock existed at the time of purchase. Attorney Abrams indicated that if the purchaser had used any financial institution to obtain a mortgage on the property, a new survey would have been required. It was noted that if the circum- stances warranted, neighbors would be subpoenaed to testify as to their knowledge of the timing of the construction of the dock. Chairman Scholz thanked the Board Attorney and the Recording Secretary for their work in preparing forms for use by the Code Enforcement Board. Chairman Scholz went through each form summarizing the information con- tained. The only question which arose was one involving the length of time a violator would be given to comply with a 'Notice of Violation' upon issuance by the Code Enforcement officer. It was determined that this would be discretionary on the part of the Code Enforcement Officer depending on the extent of the violation and whether the violation constituted a safety hazard to the welfare of the public.
