1985.09.18_CEB_Minutes_RegularI I [A TOWN OF HIGHLAND BEACH, FLORIDA CODE ENFORCEMENT BOARD SEPTEMBER 18, 1985 REGULAR MEETING 10:00 A.M. Chairman Robert F. Scholz called the Regular Meeting of the Code Enforcement Board to order at 10:05 A.M. Other members present were Secretary Ellen Gerber,Messrs. John Chironna, Theodore Boepple, Alfred Novak, and Edward J. Pearl - stein. Also present were Code Enforcement Officer/Building Inspector Anthony Abbate, Town Attorney Richard Barkin, Recording Secretary Anne Kowals, Mr. Jerry Johnson representing Dr. Alvin Jarrett, Mr. Jeff Hackman and a few Town residents. Absent from this meeting was Vice Chairman Robert Myers. Secretary Ellen Gerber read the minutes of the May 15, 1985, Regular Meeting. A MOTION was made by Secretary Ellen Gerber, seconded by Mr. Alfred Novak, to approve the Workshop and Regular Meeting Minutes of May 15, 1985. All members were in favor of the MOTION. OLD BUSINESS • EMERGENCY GENERATOR EMISSION - It is the consensus of the Code Enforcement Board that they have no jurisdiction in a situation like this as it is an internal condominium problem. NEW BUSINESS CITATION #2253 - JEFF HACKMAN - FOUR OPEN HOUSE SIGNS POSTED ILLEGALLY. After several verbal warnings, Code Enforcement Officer Anthony Abbate issued Citation #2253 to Jeff Hackman of 3012 South Ocean Boulevard for violating Town Code Chapter 23, Section 23-7. Code Enforcement Officer Anthony Abbate said the Town Ordinance does not permit "open house" signs on multiple family homes. An "open house" pendant is permitted on permanent signs at high-rise condominiums after approval by the Community Appearance Board and payment of $100.00 fee. Under oath, Mr. Hackman stated that he hired Trade Winds Realty to sell his Edgewater Townhouse and they put up the "open house" signs. Mr. Hackman said he related previous warnings to the realtor therefore the citation should have been issued to the Trade Winds Realty. • Mr. Hackman questioned how he is to sell his home if he is not permitted to put up a sign on his property. r CODE ENFORCEMENT BOARD Regular Meeting September 18, 1985 Page 2 of 4 Chairman Scholz said it was Mr. Hackman's obligation to see to it that the realtor obeyed the Town Ordinance. Mr. Hackman said the Town must redefine a multiple area and revise the sign ordinance. To satisfy the citation issued, Mr. Hackman must remove the four "open house" signs and the two American Flags. Code Enforcement Officer Abbate said one regular real estate "for sale" sign (less than 3 sq. ft.) is allowed at Mr. Hackman's Townhouse. Mr. Hackman explained that there are three different driveways at the Edgewater Townhouses and he would like to use one little sign to show a prospective buyer where to go in the complex. Secretary Ellen Gerber said Mr. Hackman should abide by our Town Code with one sign and apprise Trade Winds of the Town Ordinance. The next time this occurs, said Mrs. Gerber, Mr. Hackman will be subject to a fine. Mr. Hackman said he will request permission from the Town Commission to put up a little sign on his property. • Chairman Scholz said Mr. Hackman and the Trade Winds Realty had been warned; the next violation will carry a fine. CITATION #2252 - ALVIN JARRETT - POOL AND SEAWALL IN NEED OF REPAIR. Chairman Scholz said this situation has been going on since February 28, 1985. A number of citations were issued and letters from our Town Attorneys were sent to Dr. Jarrett regarding this matter. This morning, Chairman Scholz, Code Enforcement Officer/Building Inspector Anthony Abbate and Town Attorney Richard Barkin spoke with Dr. Jarrett by phone. There has been much procrastination and the Code Enforcement Board has been delayed in getting action from Dr. Jarrett and the people hired to correct the situation. Members viewed photos of the pool and seawall taken by Mr. Abbate. Under oath, Chairman Scholz said he personally inspected the area with Mr. Abbate and the property is in a deplorable state. The open trench around the pool and the depressions at the seawall create a very hazardous condition. E r CODE ENFORCEMENT BOARD • Regular Meeting September 18, 1985 Page 3 of 4 Code Enforcement Officer Abbate said conditions at 1100A Highland Beach Drive have not changed since the last inspection. A barricade of red plastic ribbon, 1 ft. above the ground, was placed around the pool area, continued Mr. Abbate. The seawall, said Officer Abbate, must be repaired by a 'marine' company with sheeting and batter piling because it is caving in against the wall. Mr. Jerry Johnson, representing Dr. Jarrett, stated under oath that he owns the property connected to Dr. Jarrett's property on the North side. A pool company was contracted to complete the pool and Broward Piling Company was hired to repair the seawall. Mr. Johnson said they will also have a pool deck and sprinkler system installed and landscaping done upon completion of pool and seawall repairs. Chairman Scholz suggested the Code Enforcement Board establish a completion date on the repair of the pool and seawall --any day after the completion date would be subject to a per diem fine. Attorney Barkin said an ORDER should be issued indicating a time • limit (no less than reasonable --no more than thirty days) as to when work should be complied with. Failure to comply with the completion date will mean assessing a fine, not to exceed $250.00 per day, at the next Code Enforcement Board Meeting. The Code Enforcement Board Members agreed that two separate ORDERS (one for pool violation - one for seawall violation) should be issued to Dr. Jarrett. A MOTION by Secretary Ellen Gerber was made to have individual ORDERS issued for the seawall and the pool. Work to repair the pool is to commence by September 23, 1985, and must be completed by October 7, 1985. Failure to comply with the above ORDER will result in a fine not to exceed $250.00 per day beyond the completion date of October 7, 1985. Regarding the seawall, you are to have a barricade placed around the deteriorating seawall within 24 hours. Repairs to the seawall must be completed no later than October 16, 1985. Failure to comply with the above ORDER will result in a fine not to exceed $250.00 per each day beyond the completion date of October 16, 1985. �i F- • • CODE ENFORCEMENT BOARD Regular Meeting September 18. 1985 Paqe 4 of 4 The MOTION was seconded by Mr. Edward Pearlstein. All members were in favor of the MOTION. Chairman Scholz said the ORDERS, with a cover letter, will be sent Certified Mail, Return Receipt Requested, to Dr. Jarrett with a copy of same forwarded to Mr. Jerry Johnson. Mr. Jerry Johnson assured the board members he would fill in Dr. Jarrett of what transpired at this Code Enforcement Board Meeting. Members of the Code Enforcement Board agreed the sign code of Highland Beach should be revised. Secretary Ellen Gerber will research the matter. Chairman Scholz and members welcomed Mr. Edward Pearlstein who was appointed Regular Member of the Code Enforcement Board in June, 1985. The next meeting of the Code Enforcement Board is scheduled for Wednesday, October 23, 1985 (Workshop Meeting at 9:30 A.M. - Regular Meeting at 10:00 A.M.). There being no further business to discuss, Secretary Ellen Gerber made a MOTION, seconded by Mr. Boepple, to adjourn the Regular Meeting.
