• CODE ENFORCEMENT BOARD WORKSHOP MEETING - MINUTES
October 23, 1985 9:30 A.M.
Chairman Robert F. Scholz called the Workshop Meeting of the Code Enforce-
ment Board, Town of Highland Beach, to order at 9:30 a.m.
Other Members present were Secretary Ellen Gerber, Messrs. Theodore
Boepple, Alfred Novak, Robert Myers, and Edward Pearlstein. Also present
were Code Enforcement Officer/Building Inspector Anthony Abbate, Town
Attorney Richard Barkin, Recording Secretary Anne Kowals, and a few Town
residents.
Secretary Ellen Gerber read the minutes of the Code Enforcement Board
Workshop Meeting of September 18, 1985.
Chairman Scholz said the roll call and approval of these minutes will be
held in abeyance until the Regular Meeting.
A letter of resignation, dated September 22, 1985, received from Mr. John
Chironna was acknowledged with a letter from Chairman Scholz, dated
September 24, 1985.
Chairman Scholz advised the Board members that he sent a memorandum to the
Town Commission on October 18, 1985, to recommend the reappointment of
Regular Members Robert Myers and Alfred Novak whose terms expire in
. November, 1985.
With the resignation of Mr. Chironna, said Chairman Scholz, a vacancy
exists on the Code Enforcement Board.
Chairman Scholz and the Board members discussed the situation at Dr. Alvin
Jarrett's property with Town Attorney Richard Barkin.
Attorney Barkin said that ORDERS regarding pool and seawall violations were
issued to Dr. Alvin Jarrett following the Code Enforcement Board Meeting of
September 18, 1985. Mr. Jerry Johnson, representing Dr. Jarrett at that
meeting, assured the Board members that the ORDERS would be complied with
and he had no objection to the time frame stipulated in the ORDERS.
At the Regular Meeting, after sworn testimony from the Code Enforcement
Officer/Building Inspector, the Code Enforcement Board is entitled to
impose a daily fine (not to exceed $250.00 per day), if it finds the ORDERS
have been violated, continued Attorney Barkin.
Code Enforcement Officer/Building Inspector Anthony Abbate stated a hazard-
ous condition exists at the site as the trenches around the pool and
seawall have not been remedied.
Members viewed photos of the pool and seawall areas which were taken by
Code Enforcement Officer/Building Inspector Abbate.

Vice Chairman Myers questioned if Code Enforcement Board Members are
covered under a policy called "Public Official Liability Policy".
Chairman Scholz adjourned the Workshop Meeting at 10:10 A.M.
