CODE ENFORCEMENT BOARD
REGULAR MEETING - Minutes
DECEMBER 18, 1985
10: 00 A.M.
The Regular Meeting of the Code Enforcement Board, Town of Highland Beach,
was called to order by Acting Chairman Robert B. Myers at 10:00 a.m.
The Recording Secretary called the roll. Present were Secretary Ellen
Gerber, Messrs. Robert Myers, Theodore Boepple, Alfred Novak, and Edward
Pearlstein. Also present were Code Enforcement Officer/Building Inspector
Anthony Abbate, Chief William Cecere, Police Officer Abraham Widelitz,
Recording Secretary Anne Kowals, and a few Town residents.
Absent were members Robert F. Scholz and Joseph W. Sieff.
Secretary Ellen Gerber read the minutes of the October 23 1985 Regular
Meeting.
Mr. Novak made a MOTION, seconded by Mr. Boepple, to accept and approve
both sets of minutes as corrected. All members agreed with the MOTION.
Acting Chairman Myers mentioned the two citations which were issued to one
defendant (Highlands Place).
CITATION #01157 - Thomas Lee Henderson - working before 8:00 a.m. at
Highlands Place construction site.
Police officer Abraham Widelitz, who issued the citation, was sworn in by
the Recording Secretary. At approximately 7:10 a.m. on Monday, November
18, 1985, explained Officer Widelitz, the defendant was observed working at
Highlands Place.
The Defendant told Officer Widelitz that permission was received from the
Building Department to permit work to commence prior to 8:00 a.m. to secure
the construction site, due to Hurricane Kate warnings.
Officer Widelitz said when the Building Department grants such permission,
they give verbal or written notice to the Police Department. There was no
such notice on record, continued officer Widelitz.

This is the first citation issued for violating the work time schedule;
however, they were previously warned, on one occassion, and told the
working hours in Highland Beach are from 8:00 A.M. to 6:00 P.M.,
continued officer Widelitz.
Acting Chairman Myers requested the gentleman who was representing
the defendant step forward.
Mr. Brian Kirk, Project Manager for Milne & Nicholls, Inc., was sworn
in by the recording secretary and stated he resides at 2565 South
Ocean Boulevard, Highland Beach.
Due to Hurricane Kate, Mr. Kirk said he was following the weather
forecast all weekend long. with a large amount of building materials
at the construction site, Mr. Kirk thought it wise to have things
secured down.
Under Mr. Kirk's instructions, Mr. Thomas Lee Henderson went to the
site to get the situation under control. Mr. Kirk said his attempt
was not a blatant crossing of the Town Codes --it was felt necessary
40 to prevent any damage.
Acting Chairman Myers said he does not take kindly to dismissing a
citation after it is issued by the police. our police mean business,
said Mr. Myers, and they need all the support they can get.
Secretary Gerber said Mr. Kirk should be commended for taking emer-
gency action; he wanted to protect surrounding buildings and resi-
dents. You can not predict what the weather will do, continued
Mrs. Gerber. We should be glad Mr. Kirk took extra precautions.
Code Enforcement officer/Building Inspector Anthony Abbate said their
working before 8:00 A.M. on this occassion had a valid excuse.
Secretary Ellen Gerber made a MOTION, seconded by Mr. Boepple, that
Citation #01157 should be dismissed in regards to starting work prior
to 8:00 A.M. If another citation for working before 8:00 A.M. is
issued, you will be fined by this board.
All members were in favor of the MOTION.
Police Chief Cecere said the people at Highlands Place did cooperate
with the Police Department in apprehending a male and female who were
40 involved in a homicide in Boynton Beach.

CITATION #01162 - Brian Kirk - Failure to clean area daily.
Acting Chairman Myers stated this citation was issued by Police Officer
Cervasio.
Police Chief Cecere said he authorized officer Cervasio to issue the
citation due to the complaints received from residents who observed
debris in the West parking lot.
At approximately 10:20 A.M., the meeting ended abruptly as Acting
Chairman Robert B. Myers fell ill.
We were saddened to learn that Mr. Myers expired shortly thereafter.
