1984.01.06_CEB_Minutes_Special• TOWN OF HIGHLAND BEACH, FLORIDA CODE ENFORCEMENT BOARD January 6, 1984 Special Meeting 2:30 P.M. Chairman Scholz called the Special Meeting to order at 2:30 P.M. Those in attendance were: Chairman Robert Scholz, Vice -Chairman Robert Myers, John Chironna, Alfred Novak, Donald Sherbondy, Theodore Boepple and Andrew Bennardo (Alternate). Ellen Gerber, secretary was absent. Also present were: Elaine W. Roberts, Town Manager; Tom Sliney, Town Attorney, Tony Abbate and Dr. A. Tomeski. The purpose of this special meeting was to discuss Citations #k02227 - -2234 which were issued to Mr. James D'Amore, 4207 Tranquility Drive for violation of the Town of Highland Beach Code of Ordinances, Section 21-4 Maintenance. "All seawalls, bulkheads and retaining walls now existing or hereinafter erected, constructed or built shall be maintained and kept in good repair by the owner or owners thereof. Chapter 17, Section 2, 3a,b,d(3); Chapter 17-4 Enforcement; and Chapter 17-5 Penalties. • After a great deal of discussion, a Motion was made, seconded and passed unanimously to issue the following Order: 1. The defendants are to take immediate measures to prevent further deterioration of the seawall located at 4207 Tranquility Drive, Highland Beach, Florida, legally described as Lot 13, Block 5, Bel Lido, as recorded in Plate Book 25, Page 97 of the Public Records of Palm Beach County, Florida; such measures shall be approved by a qualified engineer and shall be completed by Janaury 13, 1984. 2. The Defendants shall by January 16, 1984 execute a contract with a qualified state licensed seawall contractor for the repair of said seawall in accordance with Chapter 21, of the Code of Ordinances of the Town of Highland Beach, the Standard Building Code, Section 108 and approved by the Town of Highland Beach Building Department and shall obtain by January 16, 1984 all necessary permits for the repair of said seawall. 3. The Defendants shall by February 28, 1984 complete the repair of said seawall in accordance with the standards set forth • in paragraph two. 10 Code Enforcement Board Special Meeting January 6, 1984 Page 2 of 2 Failure to comply with the provisions of paragraphs 1, 2, and 3 above, will subject the Defendants to a fine of $250.00 per day while violation of this order continues.
