• CODE ENFORCEMENT BOARD
March 21, 1984 Regular Meeting 10:00 A.M.
Chairman Robert Scholz called the Regular Meeting to order at 10:00 A.M.
In attendance were: Vice -Chairman Robert Myers; Secretary Ellen Gerber;
Alfred Novak, Donald Sherbondy, Theodore Boepple and Andrew Bennardo (Alt.)
Mr. John Chironna was absent. Mrs. Roberts, Town Manager; Tony Abbate,
Code Enforcement Officer; Tom Sliney, Attorney; Chief Jones and Rita
Ebersole, Recording Secretary were also present.
Mrs. Gerber read the minutes of the Regular meeting of January 18, 1984.
MOTION was made by Mr. Novak, seconded by Mr. Sherbondy and approved by
all to accept the Workshop and Regular minutes of January 18, 1984.
Violation ##01137 - LaCroix Construction (Milord Development Site) - left
bobcat bulldozer on bike path from 2/27/84 to 2/28/84
in violation of Town Ordinance 27-3.
Mrs. Cathleen LaCroix appeared and was sworn in. She
explained that the bobcat broke down on the bike path
and would not start to be loaded onto a trailer. It
• was removed the following morning when help was
available.
Mr. Milord -explained there was no damage to the bike
path and when the project is completed they will
raise the elevation and install a new bike path.
MOTION by Mrs. Berber, seconded by Mr. Boepple to
dismiss the case. An ORDER will be issued to Mr.
Milord, copy to LaCroix Construction stating any
further violations on this site will result in a fine
not to exceed $250. per day.
Violation ##01156 - Chairman Scholz read a letter dated March 20, 1984
from Mr. Sylvester requesting a continuance on this
violation vaa well as violation ##02240. After some
discussion, the Board felt immediate action should
be taken on Violation #k01156 - Doberman dog barking
excessively, causing disturbance to his neighbors.
Mr. Gerald Marcy appeared and was sworn in. He stated
that Mr. Sylvester's Doberman dog is kept in an
enclosure which is approximately 20 feet from his
bedroom window and said dog usually starts barking
at 6:30 a.m. each day. This is very upsetting to
him and his wife. Another neighbor, Mr. Brandt also
has a complaint but was not available to appear today.

Mrs. Roberts advised the Board that she had written
two letters to Mr. Sylvester regarding this matter.
After much discussion, the Board decided to issue
an ORDER to Mr. Sylvester - "The Defendant, Harcourt
Sylvester, is ordered to abate the excessive barking
of his black Doberman dog and to prevent further
disturbances by said dog. Violations of this order
shall subject the defendant to a fine not to exceed
$250.00 per day."
Violation #02240 - Harcourt Sylvester - Rear fence construction does not
comply with Town Code - Chapter 30, 5.(a)(2) and work
was done without permit.
MOTION by Mr. Sherbondy, seconded by Mrs. Gerber,
to grant a continuance on this violation. It will be
heard at the next regular meeting of April 18, 1984
at 10:00 a.m. All agreed.
There was some discussion by the Board regarding the parking of
recreational vehicles within the Town. The Board decided that it will
make a recommendation regarding the parking of recreational vehicles
at the next regular meeting on April 18, 1984.
• MOTION by Mr. Boepple, seconded by Mrs. Gerber, for adjournment. All
agreed and the meeting adjourned at 11:15 a.m.
