1984.04.18_CEB_Minutes_RegularTOWN OF HIGHLAND BEACH, FLORIDA • CODE ENFORCEMENT BOARD _ April 18, 1984 Regular Meeting 10 00 A.M. Chairman Robert Scholz called the Regular Meeting to order at 1.0:00 A.M. In attendance were: Vice -Chairman Robert Myers; Secretary Ellen Gerber; Messers. Alfred Novak, Donald Sherbondy, Theodore Boepple, John Chironna, Andrew Bennardo (alt.); and Chairman Scholz. Also present were: Thomas E. Sliney, Town Attorney; Elaine W. Roberts, Town Manager; Anthony Abbate, Building Inspector; Lt. William Cecere; and Elizabeth L. Kolek, Recording Secretary., Mrs. Gerber read the minutes of the Regular Meeting of March 21, 1984. Pending the correction, the Regular Meeting Minutes, adding "the Board will make a recommendation regarding the parking of recreational vehicles at the next Regular Meeting on May 23 , 198411, a MOTION was made by Mr. Novak, seconded by Mrs. Gerber to accept the March 21, 1984 Minutes as read. Violation #k01153 - Mr. Harcourt Sylvester, 2445 South Ocean Boulevard, Highland Beach, Florida, barking loud dog disturbing neighbors, 3-23-84. Mr. Abbate stated that the dog is gone. Lt. Cecere verified this. No further action was necessary. Violation #k02240 - Mr. Harcourt Sylvester - Rear fence construc- tion does not comply with Town Code - Chapter 30, 5.(a) (2) and work was done without a permit. After discussion by the Board, MOTION was made by Mr. Sherbondy, seconded by Mrs. Gerber, to wait to take action until after the Board of Adjustment moves, since Mr. Sylvester has ap- plied for a variance. UNFINISHED BUSINESS: The Board discussed recreational vehicles --the parking of --within the Town. MOTION was made by Mr. Sherbondy, seconded by Mr. Novak, to recom- mend to the Town Commission that recreational vehicles be premitted to be parked at residences within the Town for a period of 24 hours for the purpose of loading and unloading. All agreed. NEW BUSINESS: • Mr. Jim Linus, Mr. Sylvester's attorney, was sworn in. He described the fence and its location; also displaying photo- graphs, white wrought iron, can only be seen from the beach over the dune and had no known complaints afout the fence. �J There was some discussion as to the location of the fence and the coastal construction line which will be checked by Mr. Abbate. Some other fences in town were discussed. Existing sales trailers (where no construction is underway) are allowed by the Town Commission if their appearance is maintained. Mowing of vacant lots was discussed. Town Manager stated the lots are cut 5 times per year and the owners are billed by the Town on a yearly basis. Discussion took place regarding the responsibility for the beach access gate and easement to the beach for the residents of Russell and Bel Air Dr. (Highland Beach Isles sub -division). Five feet easement was given by Drexel Properties in a final settlement for the exclusive use of Highland Beach Isles residents. Town Attorney Sliney stated that the Town is not responsible for the upkeep and repair and will check on whose responsibility it legally is. Since this is not a "finished side", debris accumulates there. There being no further business, MOTION to adjourn was made by Ellen Gerber, seconded by Theodore Boepple, the Regular Meeting adjourned at 1.0:50 A.M. Next meeting is scheduled for Wednesday, May 23, 1984.
