1984.09.19_CEB_Minutes_Regularr • TOWN OF HIGHLAND BEACH, FLORIDA CODE ENFORCEMENT BOARD September 19, 1984 Regular Meeting 10:15 A.M. Chairman Robert Scholz called the Regular Meeting to order at 10:15 A.M. Other members present were Secretary Ellen Gerber, Messers. Donald Sherbondy, John Chironna, Robert Myers and Alfred Novak. Also present were Town Manager Elaine W. Roberts, Building Inspector Tony Abbate, Town Attorney Tom Sliney, Recording Secretary Anne Kowals and a few town residents. Secretary Ellen Gerber read the minutes of the June 20, 1984 Regular Meeting. Chairman Scholz asked the members if they accept and approve the minutes of the June 20, 1984 Workshop and Regular Meeting and the minutes of the Special Meeting held on July 11, 1984 as read by Secretary Gerber. All members agreed to accept and approve the above mentioned minutes as read. • NEW BUSINESS: Citation #2243 - Braemer Isle Townhouses - Places Construction Co. Planting trees without C.A.B. approved plans. Tony Abbate stated a citation was issued because he received a complaint regarding tree planting without C.A.B. approval. Investigation indi- cated no planting was done --trees were just delivered. A citation was issued as a warning, not a violation. A letter from the Code En- forcement Board was sent to Braemer Isle Town- houses stating the citation was dismissed for 'no cause'. Citation #2244 - James Raisin - illegal garbage station instal- led on the right of way without permit. Mr. Abbate spoke with Mr. Raisin regarding the above citation. The garbage station was re- moved. Mr. Raisin applied for a permit and in - isstalled the station in a different location. A letter from the Code Enforcement Board has been sent to Mr. Raisin advising the citation has been satisfied because a permit was obtained and garbage station relocated. 4 • CODE ENFORCEMENT BOARD Regular Meeting September 19, 1984 Page 2 of 3 is 0 The Board Members discussed the issuance and enforcement of citations at length with the Town Manager, Town Attorney and Building Inspector. It was agreed that each citation should be treated independently. OLD BUSINESS• Citation #2245 - A. J. Bonar for illegal installation of davits. Chairman Scholz asked Tony Abbate to explain Citation #2245. Mr. Abbate said the situation has been in existence since 1980. Davits were installed illegally without permit. Mr. Bonar, a resident of Canada, contacted Mr. Abbate by phone on September 18, 1984, to advise he would be unable to appear before the Board. Secretary Gerber requested this matter be postponed until the new zoning is clarified. Town Attorney Sliney said it is okay to hold this matter in abeyance to allow Mr. Bonar to file a petition for a Variance. Mr. Sherbondy made a MOTION that the Board suspend action in this matter until the individual is notified by Registered Mail, Return Receipt Requested, that he has 30 days from receipt of such letter to apply for a Variance in this matter. If he does not apply within 30 days, he will be subject to a fine by this Board. After action is taken upon his ap- plication, the Code Enforcement Board will de- cide what further action will be taken in this case. All the Board A brief discussion regarding marina slip rentals followed. • CODE ENFORCEMENT BOARD Regular Meeting September 19, 1984 Page 3 of 3 The members discussed the Town Commission's request that they review information and data concerning seawalls and inspection of seawalls in the town. After reviewing this information, the Town Commission would like the members to make recommenda- tions. It was agreed by all members that more time was neces- sary to study the matter further. Seawall inspection will be placed on the agenda, under old business, for the October 17, 1984 meeting. The next meeting date is scheduled for Wednesday October 17, 1984. The Workshop Meeting will be at 9:30 A.M.; the Regular Meeting at 10:00 A.M. Chairman Scholz adjourned the Regular Meeting at 11:40 A.M.
