CODE ENFORCEMENT BOARD
• NOVEMBER 28, 1984 REGULAR MEETING 10:05 A.M.
The Regular Meeting of the Code Enforcement Board was called to order
by Chairman Robert Scholz at 10:05 A.M.
Other members present were Secretary Ellen Gerber, Messers. Donald
Sherbondy, John Chironna, Robert Myers, Theodore Boepple, Andrew
Bennardo (Alt. 1) and Edward J. Pearlstein (Alt. 2). Also present
were Building Inspector Tony Abbate, Recording Secretary Anne Kowals
and a few Town residents.
Mr. Alfred Novak was absent.
Secretary Ellen Gerber read the minutes of the October 17, 1984,
Regular Meeting. Mr. Boepple made a MOTION, seconded by Mr. Myers,
to accept and approve the minutes of the Workshop Meeting and the
Regular Meeting as read. All members agreed.
Chairman Robert Scholz requested Building Inspector Tony Abbate ex-
plain the status of the Bonar citation. Mr. Abbate informed the
Board Members that Mr. Bonar had the bolts cut off. The Building
isInspector Tony Abbate advised Mr. Bonar that if he were to use any
other device on the pad to lift the boat into or out of the water,
he would be in violation and would then have to remove the concrete
pad. Mr. Tony Abbate will check the property periodically. All
Board Members agreed the citation was satisfied with the removal of
the bolts.
Chairman Scholz informed the members that the terms of the Code En-
forcement Board Secretary Ellen Gerber and Alternate #1 Andrew
Bennardo are expiring in December. Both members advised Chairman
Scholz they would like to continue serving on the Code Enforcement
Board.
A MOTION by Mr. Chironna, seconded by Mr. Myers, to reappoint Secre-
tary Ellen Gerber as a regular member for a two year term was car-
ried unanimously.
A MOTION by Secretary Ellen Gerber, seconded by Mr. Boepple, to re-
appoint Andrew Bennardo as alternate #1 for a one year term was
unanimously carried.
Chairman Robert Scholz submitted a memorandum to the Town Commission
on November 28, 1984, recommending the reappointment of both members.

A memorandum from Acting Town Manager Mary Ann Whaley, dated Novem-
ber 27, 1984, with a letter from Town Attorney Tom Sliney and a draft
of proposed ordinance regarding seawall nuisances attached, was
handed to each Board Member during the Regular Meeting of the Code
Enforcement Board.
At the request of the Code Enforcement Board Members, Acting Town
Manager Mary Ann Whaley attended the discussion of the proposed
ordinance regarding sewall nuisances. After careful, lengthy study,
all the members agreed the proposed ordinance should be abandoned.
A MOTION by Mr. Donald Sherbondy, seconded by Mr. Theodore Boepple,
to advise the Town Commission that the Code Enforcement Board does
not recommend any change in the existing ordinance in respect to sea-
walls, bulkheads and retaining walls was carried unanimously.
Chairman Robert Scholz submitted a memorandum to the Acting Town
Manager Mary Ann Whaley, on November 28, 1984, reading as follows:
"At the Regular Meeting of the Code Enforcement
Board on November 28, 1984, the members agreed
• to advise the Town Commission that the Code En-
forcement Board does not recommend any change
in the existing ordinance in respect to seawalls,
bulkheads and retaining walls. Also, no change
in the existing procedure of the Code Enforce-
ment Board regarding the ordinance."
The next Code Enforcement Board meeting is scheduled for Wednesday,
December 19, 1984, at 9:30 A.M. the Workshop Meeting. The Regular
Meeting will follow at 10:00 A.M.
Having no further business to discuss, a MOTION was made by Secre-
tary Ellen Gerber, seconded by Mr. Donald Sherbondy, to adjourn the
Regular Meeting. The MOTION carried unanimously.
At 11:15 A.M., Chairman Robert Scholz adjourned the Regular Meeting.
