• CODE ENFORCEMENT BOARD
November 16, 1983 Regular Meeting 10:00 A.M.
Chairman Scholz called the Regular meeting to order at 10:00 A.M.
Those in attendance were: Chairman Robert Scholz, Vice -Chairman
Robert Myers, Secretary Ellen Gerber, John Chironna, Alfred Novak
and Donald Sherbondy. Also present were Elaine W. Roberts, Town
Manager; Chief Jones, Attorney Tom Sliney and Rita Ebersole.
Mrs. Gerber read the minutes of September 21, 1983, regular meeting.
Motion by Mrs. Gerber, seconded by Mr. Myers to approve the minutes
of meeting, September 21, 1983, Workshop and Regular. All agreed.
Several letters were read by Chairman Scholz regarding the historic
tree located on the Edgewater building site. The matter is now in
abeyance and the Town Commission will decide whether or not their
$2,000 bond will be forfeited.
Citation ##01144 - Mr. Browning - Recreational vehicle parked between
6PM and 8 AM. Chairman Scholz read a letter from Mr. Browning dated
• September 12, 1983. Mr. Browning appeared before the Board and was
sworn in. He felt the Town should allow a reasonalbe time of 48 hours
to let recreational vehicle owners load and/or unload.
Mrs. Gerber felt this citation should be deferred until the Board has
time to work out a revision to recommend to theTown Commission.
Mr. Scholz MOVED that there be no fine for this citation but citations
will continue to be given as long as our Code is as it is, and the
Chief will advise his patrolmen to continue to give citations. An
Order was issued to Mr. Browning (copy enclosed). Motion was seconded
by Mr. Myers. After further discussion, this Motion was carried.
Several residents in the audience requested to be heard. They were
advised to speak at the Town Commission meeting. Mrs. Gerber said the
Town Commission represents the people, while the Code Enforcement Board
represents only the Town Codes.
Mr. Sliney explained a recent opinion of the Attorney General regarding
Code Enforcement Boards. He further stated that Code Enforcement
Boards do not have jurisdiction over Motor Vehicles and this would
include the Browning case. Copies of the Attorney General's opinion
• will be distributed to all Board members. After they have time to read
and study same, it will be discussed again.

Mrs. Gerber pointed out that the Board has one vacancy (regular
member) and two alternate vacancies. She also said the Chairman's
term expires December 1983 and made a Motion that the Board
recommend the reappointment of Mr. Scholz to the Town Commission.
Motion was seconded and all agreed.
Members will be advised regarding the date of the next meeting.
