0 CODE ENFORCEMENT BOARD
Regular Meeting
March 9, 1983 10:05 A.M.
Chairman Roehner called the Regular Meeting to order at 10:05 A.M.
Those in attendance were: Soll Roehner, Chairman; Ellen Gerber,
Secretary; Robert Scholz, John Chironna, Albert Approbato, Robert
Myers and Donald Sherbondy. Mr. Novak was absent.
Also present were: Elaine W. Roberts, Town Manager; Tony Abbate,
Code Enforcement Inspector; Chief Jones and Rita Ebersole, Deputy
Town Clerk. Tom Sliney, Town Attorney arrived at 10:25 A.M.
Mrs. Gerber read the minutes of the Regular meeting of January 19, 1983.
MOTION was made by Mr. Scholz, seconded by Mrs. Gerber to approve
minutes of the Regular Meeting and the Workshop Meeting as read. All
agreed.
OLD BUSINESS
• Citation ##02198 - Third Wind, 4217 S. Ocean Blvd.
Mrs. Roberts advised the Board that the Town Commission
had sent a "Letter of Objection" to the Department of
Natural Resources regarding the seawall and stairs
which were constructed without a permit. No response
has been received to date.
Mr. Scholz MOVED to hold this violation in abeyance
until we hear from the Department of Natural Resources.
Mrs. Gerber seconded the motion and all agreed.
Citation #02199 - Thomas L. Delaney, Vice President - Evanton Baye.
This project has been inspected and approved to receive
their final Certificate of Occupancy.
Citation #02200 - Thomas L. Delaney, Vice President - Braemer Isle.
After some discussion a MOTION was made by Mrs. Gerber,
seconded by Mr. Scholz and all agreed to recommend to
the Town Commission that they have the Community
Appearance Board call a special meeting to satisfy the
Temporary Certificate of Occupancy at Braemer Isle
garage and if they do not wish to do so the Town should
follow the Temporary Occupancy Code in Section 109.3
• and complete the project.

NEW BUSINESS
Citation #02201
- Clarendon Inc. - Digby Bridges.
Mr. Bridges addressed the Board stating he needs extra
time in order to reestablish plants and trees. After
discussion, a MOTION was made by Mrs. Gerber, seconded
by Mr. Scholz, all in favor, to send the following
letter to the Town Commission - "Mr. Digby Bridges
appeared before the Board explaining the situation and
is making every effort to complete the project. We,
therefore, recommend he be granted an extension to allow
landscaping to firm and if they fail to complete on the
extension, the Town should follow the Temporary
Occupancy Code in Section 109.3 and complete the
project."
Citation #02202
- Thomas L. Delaney (Carron House)
Mr. Delaney explained that the Community Appearance
Board disapproved the project for final Certificate of
Occupancy and listed several items to be corrected. All

of the items should be corrected shortly. He will then
request another review. On a MOTION by Mr. Scholz,
seconded by Mrs. Gerber, and agreed to by all, the Board
decided to table this citation until the C.A.B. has
reached their decision. They also requested the C.A.B.
to inform of their decision.
Citation #01152 -
Cam -An Tile Co. (Ferdinano DeCiddo) Installing marble
in lobby of Coronado after 6 p.m. on 2/22/83.
Mr. Claude Ferland, owner of the Tile Co. appeared
before the Board and was sworn in. He said he and his
workman, Mr. DeCicco, were familar with the working hours
in Highland Beach, but his workman did not have a watch
and didn't realize it was after 6 p.m. A. MOTION by
Mr. Scholz, seconded by Mrs. Gerber and all agreed that
this was a legitimate excuse and dismissed the case with
a warning stating any further violation on the site would
result in a substantial fine.
Citation #02205 -
Trafalgar Developers - Roger Zona, Construction Manager.
General Contractor held responsible for violation of
sub -contractor, Cam -An Tile Co. Citation #01152.

Mr. Zona appeared before the Board and was sworn in.
When Mr. Zona explained that it was his guard who
reported the violation of the Cam -An Tile Co., Mrs.
Gerber MOVED to dismiss the case because Mr. Zona did
take precautions to uphold the Town's Ordinance. MOTION
was seconded by Mr. Myers and all agreed.
Discussion continued with Mr. Zona regarding the Fire Alarm system at
the Coronado. It has been going off night and day disturbing the
neighbors and causing the Fire truck and paramedics to make unnecessary
trips. Mrs. Roberts felt something must be done to correct the situation.
Mr. Zona explained that the system is very sensitive and reacts to
dust and humidity. He has had it checked numerous times. When the
air conditioning is working, he felt the problem would be eliminated.
Mr. Sliney said it should be determined whether the system is defective
or not. He advised Mr. Zona to check with the Fire Marshall and if the
system is bad replace it, otherwise the Town will issue citations for
false alarms as a nuisance.
Mrs. Gerber suggested some form of adjustment could probably be made.
It was the consensus of the Board that something be done immediately
and Mr. Zona agreed.
Citation #02203 - Rainbow Signs - Installing sign without permit at
Sunny Surf.
After discussion a MOTION was made by Mr. Scholz,
seconded by Mr. Myers to hold this citation in abeyance
until the Town Manager supplies further details.
All agreed.
Citation #02204 - Mapleleaf Developers Inc. - David Gustfrand - Finish
installing shingles or remove from roof.
Mr. Gustfrand appeared and was sworn in. He said the
job was 95/ complete. Mr. Abbate explained that the
roofer was leaving loose tiles on the roof which were
falling into his neighbors pool creating a safety
hazard. On a MOTION by Mr. Scholz, seconded by Mrs.
Gerber, Mr. Gustfrand was ordered to bundle loose tiles
immediately. If this is not done today another Citation
will be issued and substantial fines will result. Any
further violations at this site will result in
substantial fines. All agreed.

Mrs. Gerber MOVED to recommend the appointment of Mr. Novak to fill
the unexpired term of Mr. Paul and recommended that Mr. Sherbondy be
appointed Alternate ##1. MOTION was seconded by Mr. Scholz and all
agreed. -
Mr. Sliney said he would advise the Town Commission that it is his
feeling that the Code Enforcement Board should not be involved with
violations of Temporary Certificates of Occupancy. The Town Commission
should make this decision.
Mr. Chironna MOVED for adjournment, seconded by Mrs. Gerber. All agreed.
Meeting adjourned at 12:15 P.M.
