PLANNING BOARD
SPECIAL MEETING - MINUTES
Monday, August 2, 1993 9:30 A.M.
Chairman Robert L. Lowe called this Special. Meeting to order in Com-
mission Chambers at 9:30 A.M.. Also present were Members Frank L.
Colarullo, James F. Morrill, William Maltz and Felix R. Goldenson.
Member Leonard D. Bell was absent.
Others in attendance were Building Official Lee Leffingwell, Town
Attorney Thomas E. Sliney, Deputy Town Clerk Doris Trinley and members
of the general public.
Chairman Lowe advised the purpose of the meeting was a preliminary
review of plans for the following:
Single Family Residence at 2434 S. Ocean Blvd., Lot 129 West
(NORTH). Submitted by Guy Flora for Lahage (Owner).
and
Single Family Residence at 2444 S. Ocean Blvd., Lot 129 West
(SOUTH). Submitted by Guy Flora for Rudnick (Owner).
Guy Flora identified himself as the General Contractor for both pro-
jects and noted that John D. Conway, architect for the residences, was
also in attendance.
Building Official Lee Leffingwell advised the plans met all Code re-
quirements.
After substantial review and discussion, Attorney Sliney advised that
any approval given today would be strictly for plans for the
residences and would not in any way include approval for a possible
beach access easement relative to the adjoining property on the east
side (Lots 129 EAST North and South), as was recently mentioned to the
Town Commission by Attorney Robert Eisen, but about which the Commis-
sion had received no further information or request for approval. He
stressed the fact that such an easement could only be approved by the
Town Commission, but no action taken today should be miscontrued as
representation that the Commission would approve such a request if
and when it was presented to them. Mr. Flora acknowledged Mr.
Sliney's statements and agreed with them, saying it was understood
that the possibility of a beach access easement on Lots 129 East
(North & South) would have to be presented to, and requested of, the
Town Commission as a separate issue; he assured the panel that only
approval for the residences was sought today and asked if final
approval might be considered since the plans met all Code requirements
•In view of the foregoing exchange, Ms. Leffingwell said she would have
no objection if the members deemed a final approval could be given at
this time; Mr Sliney concurred.

MOTION was then made by MR. MALTZ/MR. MORRILL as follows:

AND

MOTION met with unanimous favorable vote.
For the record, Chairman Lowe acknowledged the presence of Mayor
Arlin Voress, Vice Mayor Bill Paul and Town Manager Mary Ann Mariano.
A brief discussion followed Mr. Goldenson's question as to why plans
would be sent through for "preliminary" approval when they had been
cleared by the Building Official as meeting all Code requirements and
could, therefore, be submitted for "final" approval, as was the case
• today. It was noted that submitting plans for review in this way was
standard procedure; even though the Building Official finds no Code
infringements, the "preliminary" status allows for any valid reasons
the Board may find during the course of review to require the appli-
cant to appear again for a "final" review.
There being no further business to come before the Board at this time,
the meeting was adjourned upon MOTION by MR. MORRILL/MR. GOLDENSON at
9:45 A.M.
