PUBLIC HEARING MINUTES
Wednesday, August 11, 1993 9:30 A.M.
Acting Chairman James F. Morrill called the Public Hearing to order in
Commission Chambers at 9:30 A.M., noting its purpose was to examine an
application, receive public comments, and make a recommendation to the
Town Commission regarding a Special Exception request submitted by
Delray Marine for Aldo Ruscito (owner) relative to the installation of
two davits (boat lifting device) at 4229 Intracoastal Drive [Town Code
of Ordinances Chapter 30, Section 5.2(D)(2) and Section 10 (A), (B)
and (C)].
Deputy Town Clerk Doris Trinley called the roll. Others present were
Members Frank L. Colarullo, William Maltz and Felix R. Goldenson.
Chairman Robert L. Lowe and Member Leonard D. Bell were absent.
Also present were Town Attorney Thomas E. Sliney, Building Official
Lee Leffingwell and members of the general public.
When Mr Morrill asked for a representative of the project to address
the Board, it was advised that Mr. Howard Montgomery of Delray Marine
had been delayed. Accordingly, Mr. Morrill recessed the Public
Hearing at 9:35 A.M., without objection, to await Mr. Montgomery's
arrival.
Mr. Morrill reconvened the Public Hearing at 9:40 A.M. at which time
Mr. Montgomery produced required receipts from certified mailings to
residents within 1000 feet of the property. He then explained the
type of device proposed for installation, saying the davits would be
mounted directly on the seawall and would accommodate a 18-20' boat.
For the record, Ms. Leffingwell noted that Mr. Ruscito's lot had less
than 50' water frontage, which had placed the proposal in the Special
Exception category according to Code.
Under the Public Comments portion of the meeting, Town Commissioner
John F. Rand of 4211 Intracoastal Drive and Leon Canova of 4216 Intra-
coastal Drive spoke in favor of the Special Exception being recom-
mended to the Town Commission. These were the only residents to ad-
dress the Board.
During subsequent ,discussion, Town Attorney Sliney referred to the ap-
plicable Codes, reading pertinent portions into the record. He
reminded the members that only the Town Commission could approve or
disapprove the Special Exception and then only after holding their own
Public Hearing on the matter; today the Board could only transmit its
recommendation to the Commission.

In conclusion, upon MOTION by MR. MALTZ/ MR. GOLDENSON, the panel
unanimously voted to transmit to the Town Commission their recommen-
dation that the Special Exception request be approved. (A copy of the
tranmittal memorandum is attached to and made part of these Minutes.)
There being no further business to come before the Board at this time,
Mr. Morrill adjourned the Public Hearing at 9:50 A.M., upon MOTION by
MR. GOLDENSON/MR. COLARULLO.

4229 INTRACOASTAL DRIVE
Please be advised that at the conclusion of a Public Hearing on the
above referenced Special Exception request held this date, the Plan-
ning Board unanimously moved to recommend approval of same to the Town
Commission [Town Code of Ordinances Chapter 30, Section 5.2(d)(2) and
Section 10 (a) ,(b) and (c)].
