PLANNING BOARD
REGULAR MEETING - MINUTES
Wednesdav, June 10, 1992 9:30 A.M.
Chairman Robert L. Lowe called the Regular Meeting to order in Commis-
sion Chambers at 9:30 A.M.
Deputy Town Clerk Doris Trinley called the roll. Present were the
Chairman, Vice Chairman Arthur R. Keller and Members, Paul R. Kane,Sr.,
Leonard D. Bell and Frank L. Colarullo. Members James F. Morrill and
William Maltz were absent.
Also present were Town Attorney Thomas E. Sliney, Building Official
Harry Heithaus and members of the general public.
Upon MOTION by Mr. Kane/Mr. Colarullo, the Minutes of the May 11
Special Meeting and May 13 Regular Meeting were unanimously approved.
NEW BUSINESS
Preliminary Review for 4-Unit Condominium at 3425 S. Ocean Blvd., Lot
90E. Submitted by Highland Park Associates (Owner)
is Building Official Heithaus told the Board that the plans as submitted
met all Code requirements.
Mark Rothenberg and Guido Brito, project architect, represented High-
land Park Associates.
Using artist's drawings, Mr. Rothenberg explained the project and
answered members' questions satisfactorily. Mr. Rothenberg noted the
variance granted by the Board of Adjustment regarding side setbacks for
the underground parking garage. He said each of the four (4) units
would occupy an entire floor, with square footage varying from
approximately 2800 to 5300. It was also noted that the mechanical
accommodations above the fourth floor were within Code requirements and
did not constitute a fifth floor; this was corroborated by the Building
Official.
Dominic Marino, a resident of the Casuarina Condominium, expressed dis-
appointment that the project was allowed to come under review, saying
he was of the opinion that the lot was zoned for single family only,
since that is what was built on it when he moved into the Casuarina.
In response, Attorney Sliney advised the property under review had
always been zoned for multi -family; however, he did note that in the
past some single family residences had been built on properties zoned
for multi -family and, in fact, some existing single family residences
are built on properties zoned for multi -family. Mr. Rothenberg added
that although six (6) units are allowed on 90E, his project would be
four (4) only.

Because actual plans had been reviewed by individual members previous
to this meeting, the members dispensed with any further review. Before
the project was put to Motion, Mr. Rothenberg asked if the members
would consider giving final instead of preliminary approval today,
explaining time was of the essence because of the proposed change in
the Coastal Construction Control Line. Mr. Heithaus said since the
plans met all Code requirements, he would have no objection, but the
decision to do so would be at the Board's discretion.
Mr. Kane/Mr. Bell then made the following MOTION:
THE PLANNING BOARD GIVES FINAL APPROVAL TO PLANS FOR A
4-UNIT CONDOMINIUM AT 3425 S. OCEAN BLVD., LOT 90E, SUB-
MITTED BY HIGHLAND PARK ASSOCIATES (OWNER); BRITO, COHAN
AND ASSOCIATES, ARCHITECTS, COMMISSION NO. 9202-00 DATED
5/18/92, SHEETS 1 THROUGH 10.
Motion met with unanimous favorable vote.
There being no further business to come before the Board at this time,
the meeting was adjourned upon MOTION by Mr. Colarullo/Mr. Kane at
10: 05 AM.
