1992.09.09_PB_Minutes_Regularr TOWN OF HIGHLAND BEACH PLANNING BOARD REGULAR MEETING - MINUTES Wednesday, September 9, 1992 9:30 A.M. Vice Chairman Arthur R. Keller called the Regular Meeting to order in Commission Chambers at 9:30 A.M. Deputy Town Clerk Doris Trinley called the roll. Present were the Vice Chairman and Members Paul R. Kane, Jr., Leonard D. Bell, Frank L. Colarullo and James F. Morrill. Chairman Robert L. Lowe and Member William Maltz were absent. Also present were Town Attorney Thomas E. Sliney, Building Official Lee Leffingwell and members of the general public. Upon MOTION by MR. KANE/MR. COLARULLO, the Minutes of the June 10, 1992 Regular Meeting were unanimously approved. NEW BUSINESS Final Review for Two (2) Dolphins at 1008 Bel Air Drive, Lots 1, 2 and 3 Highland Beach Isles. Submitted by Boca Dock & Seawall for Flammia (Owner) . Shelley Bodnik of Boca Dock & Seawall addressed the panel on behalf of the owner, explaining that the location requested for the dolphins was at the mouth of the canal, where any boat docked would take the first brunt of wave action from the Intracoastal. He also submitted pictures of other dolphins in the same canal. It was determined during review of the survey drawing that the canal in question was the largest in Town, approximately 155' wide. Mr. Flammia joined Mr. Bodnik at this time and told the members he planned to parallel park a 36' "day" boat that had no cabin and only a "pipe" tower; he also referred to the lo- cation of his dock and wave action from the Intracoastal. A copy of a letter from the management company for the condominium stating approval for installation of the dolphins, as well as a copy of the Meeting Minutes where this approval was determined, were submitted to the Members (attached to and made part of these Minutes). Boulay, President Eldorado Condominium Association (All members received an individual copy of each letter of opposition; originals are attached to and made part of these Minutes,) In response to the Chairman's invitation to members of the audience to voice their opinions on the project, Mr. Byron McKinley, Vice President of Bel Lido Property Owner's Association, spoke against it. No others came forward. Lengthy discussion followed during which Mr. Kane advised he had physically inspected the site and noted five (5) dolphins now existing in the canal. Regarding interference of view, he said only the other residents of the condominium would be affected. Upon questioning Mr. McKinley, it was determined that the boundaries of the Bel Lido Property Owner's Association did not lie within the confines of where the dolphins were being requested. Referring to Town Code Chapter 30, Section 5.2(d)(1) (copy attached to and made part of these Minutes), the members sought Mr. Sliney's ad- vice regarding that section specifically referring to dolphins, particularly as some of the opposition centered around a boat being parked perpendicular rather than parallel and thus creating a naviga- tional hazard. It was the Town Attorney's judgment that the Code was very discretionary, and would allow the panel to stipulate conditions in their Motion, should they choose to approve the project. Concluding discussion, MR. KANE/MR. COLARULLO made the following MOTION: THE PLANNING BOARD APPROVES THE INSTALLATION OF TWO (2) DOLPHINS AT 1008 BEL AIR DR., LOTS 1, 2, & 3 HIGHLAND BEACH ISLES; SUBMITTED BY BOCA DOCK & SEAWALL FOR FLAMMIA (OWNER); AS PER DOCK & SEAWALL SURVEY BY GENTRY ENGINEERS AND LAND SURVEYORS, INC., PROJECT 9-90-41d, DRAWING 206, REVISED 2/92; WITH THE CONDITION THAT ONLY PARALLEL PARKING BE ALLOWED AND ANY VIOLATION OF THE PARALLEL PARKING CONDITION WILL BE SUBJECT TO ACTION BY THE CODE ENFORCEMENT•BOARD. Lee Leffingwell, recently hired as Building Official/Code Enforcement Officer, was asked to give a brief description of her professional qualifications and did so. Preliminary Review for Single Family at 4019 S. Ocean Blvd., Lot 48E. Submitted by John D. Conway, Architect, for Haronian (Owner). John Conway respresented the owner and told the members the house would be two-story, CBS construction, approximately 4800 sq.ft, with a 3-care garage and an elevator. Members convened to the table to review plans at which time Mr. Conway answered questions to their satisfaction. The Building Official advised that should the Board deem appropriate, the project could be given final approval at this time. The following MOTION was then made by MR. BELL/MR. MORRILL and received unanimous approval: THE PLANNING BOARD GIVES FINAL APPROVAL TO PLANS FOR A SINGLE FAMILY STRUCTURE AT 4019 S. OCEAN BLVD., LOT 48E; SUBMITTED BY JOHN D. CONWAY, ARCHITECT, FOR HARONIAN (OWNER), COMMISSION NO. 0692112 DATED 8/17/92, SHEETS 1, 2, 3, 4, 7 AND 8. Preliminary Review for Addition to Second Floor Bedroom in Existing Single Family Structure at 3921 S. Ocean Blvd., Lot 55E. Submitted by Trottco Enterprises, Inc. for Geller (Owner). Michael Trotto identified himself as the general contractor for the project and Mr. Geller's agent. He explained that the project en- tails an addition to an existing second -story bedroom to accommodate an exercise room for Mr. Geller. He also noted the addition will ex- tend eastward of the Coastal Construction Control Line, but is exempt from approval of Department of Natural Resources because it does not disturb the existing footprint. Mr. Trotto advised that extension beyond the CCCL made this a non -conforming structure as regards Town Code, which necessitated his going before the Board of Adjustment to seek a variance, which was granted. The Deputy Town Clerk attested the Board of Adjustment had decided in favor of Mr. Trotto's petition for variance; however, all papers pertaining to same were filed in Town Hall and were not available to the members at this time. The members convened to the table for plan review where Mr. Trotto answered questions to members' satisfaction. An assessment of $500.00 per unit payable before May 15 to replace the monies taken out of the general operating fund to install the new pool heater. 2. Replace outdated exterior light bulbs with more cost efficient - ones. Also to replace globes with frosted glass. 3. Approval for the Flammia's to install two pilings at their dock space to protect their boat. 4. To send City Hall a letter of concern of the dog leash laws not being obeyed both on the streets, as well as on the beaches. Also Susan Groeniger was instructed to call the Health Depart- ment if any dogs are found in the pool. At that time, the dog.. owners name will be turned over to the Health Department and if so ordered, the pool will be drained at pet owners expense. On more than one occasion dog feces has been found in the pool. 5. Lowe and Members of the Board, I am President of the Bel Lido Property Owner's Association. The Association's boundaries are from the South Side of Highland Beach Drive to the North Side of Bel Air Drive. . Many of our members are sailors, and as such, we are vitally concerned with the introduction of pilings or dolphin pins in the waterways controlled by our Town. Not only are they an eyesore but since they are unlighted, they are also a hazard to navigation. The canals interwoven throughout Highland Beach are difficult enough to maneuver in without further projections in the waterway that are added by dolphin pin installations. Another, and more serious aspect is that, although the boat owner who installs dolphins says "he wants to lay along side the dock", if you are permitting installation of dolphin pins, it will allow boats to tie-up perpendicular to the dock, such as you now have on the extreme east end of this same canal Even if the owner "does lay along side", what prevents future buyers from docking perpendicular to the dock? If a boater decides to tie up in such as manner he will project 40-50 feet in to the waterway. Imagine if you allowed both sides of the canal this privilege,you could possibly make the canal so narrow as to be all but impassible Since this request is from a 4 or 6 plex condo, I suspect, that if allowed, many of the other condos in Highland Beach will want the same.
