PLANNING BOARD
SPECIAL MEETING - MINUTES
Thursday, October 22, 1992 9:30 A.M.
Chairman Robert L. Lowe called this Special Meeting to order in Com-
mission Chambers at 9:30 A.M., advising its purpose was as follows:
PRELIMINARY REVIEW FOR SINGLE FAMILY RESIDENCE AT
2445 S. OCEAN BLVD., LOT 129E (SOUTH). SUBMITTED
BY HIGHLAND BEACH ASSOCIATES, OWNER.
Deputy Town Clerk Doris Trinley called the roll. Present were the
Chairman, Vice Chairman Arthur R. Keller and Members Paul R. Kane, Jr.,
Leonard D. Bell, James F. Morrill, Frank L. CoIaru110 and William
Maltz.
Building Official Lee Leffingwell and members of the general public
were also present.
Chairman Lowe noted that the plans submitted for review had been pre-
viously approved by the Board at a Special Meeting held May 11, 1992,
at which time they were submitted for Lot 129 (North).
Building Official Leffingwell said all necessary information, including
site plan, had been submitted and met all Code requirments.
Mr. Bell questioned the Declaration of Unity of Title papers which were
part of the second application for site and plan review for Lot 129E
(North), which plans were approved at the October 14 Regular Meeting.
He noted the absence of a date in that portion of the Declaration
subscribed to by the Notary, while the date "24th of September"
appeared in the same section of the Declaration of Unity of Title for
Lot 129E (South), which plans were to be considered today. Peter Ince,
representing the project, studied the two copies referred to and
concluded the absence of the date for Lot 129E (North) was a mistake on
the Notary's part. Mr. Bell suggested a letter to that effect be
submitted to ensure that all pertinent information was correct and Mr.
Ince agreed.
Substantial discussion took place regarding the outcome of the October
14 Regular Meeting, wherein it was ascertained through the Town
Attorney that an applicant could have any number of plans approved for
a site specific; when a permit was pulled for a specific set of plans,
approval of all others for that site would be negated. In this regard,
and also at that meeting, it was noted that plan approval is for one
year only and if a permit is not pulled during that time, approval is
auotmatically null and void. (See Minutes of October 14 Regular

Following discussion, it was the Consensus of the Board that a final
review could be given at this time and the following MOTION was made by
MR. KANE/MR. COLARULLO; after which members convened to the table for
review.
THE PLANNING BOARD GIVES FINAL APPROVAL TO PLANS FOR
A SINGLE FAMILY RESIDENCE AT 2445 S. OCEAN BLVD., LOT
129E (SOUTH). SUBMITTED BY HIGHLAND BEACH ASSOCIATES,
OWNER; NEW SITE PLAN INFORMATION PROVIDED BY JOHN D.
CONWAY, ARCHITECT, COMMISSION 1092125, DATED 10/16/92.
The members voted unanimously in favor of the MOTION.
There being no further business to come before the Board and upon
MOTION by MR. MORRILL/MR. COLARULLO, the meeting was adjourned at 9:55
A.M.
