PLANNING BOARD
REGULAR MEETING - MINUTES
Wednesday, September 11, 1991 9:30 A.M.
Chairman Harold R. Hagelmann called the Regular Meeting of the Planning
Board to order in Commission Chambers at 9:30 A.M.
Deputy Town Clerk Doris Trinley called the roll. Present were the
Chairman, Vice Chairman Arthur R. Keller, Regular Members Helene
Harris, Leonard D. Bell and Paul R. Kane, Sr. and Alternate Members
Frank Colarullo and Robert L. Lowe.
Also present were Town Attorney Kenneth E. Zeilberger, Building Of-
ficial Harry Heithaus and members of the general public.
Upon MOTION by Mr. Kane/Mr. Keller, the minutes of the Regular Meeting
Of August 14 were unanimously approved.
On behalf of the Board, Chairman Hagelmann welcomed Mr. Colarullo and
Mr. Lowe, who were recently appointed by the Town Commission.
OLD BUSINESS
None.
NEW BUSINESS
Preliminary Review for Additions, Remodeling and Partial Demolition of
Existing Single Family Home at 2624 S. Ocean Blvd., Lot 122W. Submitted
by Arthur Kaye, Owner.
Mr. Kaye was invited to address the Board regarding his project and he
summarized the work to be done, saying the existing one-story residence
would be remodeled into a two-story, with an additional extension of 5'
to the rear, resulting in an increase of 927 square feet.
Building Official Heithaus was asked to comment and he noted that Mr.
Kaye had recently received a variance from the Board of Adjustment to
extend 5' in the rear using original side setbacks, 5' being the limit
of extension in order to comply with the existing 20' Intracoastal set-
back.
Substantial discussion then ensued regarding the proposed 5' rear ex-
tension meeting the required 20' Intrascoastal setback based on infor-
mation attested to in the survey of the property. This distance had
been measured by Chairman Hagelmann during a physical inspection of the
property and his measurements showed that one side of the property only
measured 19' from the Intracoastal setback when the 5' extension was
considered.

Mr. Kaye replied this was the first he had heard of a survey discrep-
ancy, saying the property had been surveyed in 1989, with an update in
1991. However, he added that should the survey be incorrect in this
regard, he would do whatever necessary to comply with the 20' Intra-
coastal setback, extending only 4' if need be.
Upon advice from Attorney Zeilberger, it was noted for the record that
at the appropriate time in the course of the project, Building Official
Heithaus would check to determine if the 20' Intracoastal setback had
been complied with; if it had not, then all work would be stopped. It
was also noted for the record that this proviso was understood, and
agreed to, by the members, the Building Official and Mr. Kaye.
The members then convened to the table to review the plans, with the
Building Official advising that final approval could be given today if
the members so agreed. After review and further discussion, the
following MOTION was made on advice of counsel by Mr. Kane/Mr. Bell:
THE PLANNING BOARD GIVES PRELIMINARY AND FINAL APPROVAL TO
PLANS SUBMITTED FOR ADDITIONS, REMODELING AND PARTIAL DEMO-
LITION OF EXISTING SINGLE FAMILY RESIDENCE AT 2624 SOUTH
OCEAN BLVD., LOT 122W, WITH THE UNDERSTANDING THAT A QUESTION
HAS ARISEN TO THE ACCURACY OF A SURVEY DONE IN 1989 AND UP-
DATED IN 1991, SPECIFICALLY WITH RESPECT TO THE REAR SETBACK
INDICATED THEREIN. THEREFORE, APPROVALS TODAY ARE GRANTED
WITH THE EXPRESS UNDERSTANDING BY THE BOARD AND BY THE APPLI-
CANT THAT NOTWITHSTANDING THE QUESTION THAT HAS ARISEN, THE
PROJECT WILL BE CONSTRUCTED PURSUANT TO THE 20'REAR SETBACK
REQUIREMENT AND THE BUILDING OFFICIAL WILL BE GIVEN THE OP-
PORTUNITY TO INSPECT AS CONSTRUCTION PROGRESSES. IF HE DIS-
COVERS THAT THE SETBACK IS LESS THAN 20' THEN CONSTRUCTION
WILL BE STOPPED IMMEDIATELY.

The Motion carried unanimously,
Amended Site Plan Review for Driveway, Rear Roofline and Front Retain-
ing Wall for Structure at 4221 S. Ocean Blvd., Lot 31E. Submitted by
James Drago, Contractor, for Scoroposki (Owner).
Addressing the Board, Mr. Drago explained the changes to be reviewed
today. He said the driveway was being changed from circular to a ser-
pentine design in order to provide more privacy; in this regard a front
retaining wall was necessary. He also advised that the change to the
rear roofline involved a 4' extension in order to "straighten" the
roofline, as well as provide an overhang for patio use.

Mr. Heithaus advised that the amendments met all Code requirements.

After discussion and review of the plans, the following MOTION was made
by Mr. Keller/Mrs. Harris:
THE PLANNING BOARD APPROVES AMENDED SITE PLAN FOR DRIVEWAY,
REAR ROOFLINE AND FRONT RETAINING WALL FOR STRUCTURE AT
4221 S. OCEAN BLVD., LOT 31E, SUBMITTED BY JAMES DRAGO,
CONTRACTOR, FOR SCOROPOSKI (OWNER), PROJECT NO. 9066, SHEET
1 OF 1, AMENDED 8/26/91.
The Motion carried unanimously.
OTHER
Attorney Zeilberger asked the status of the Construction Trailer ap-
plication at Lot 2 A-N (B & C Sites), Development Lot 18, 1018 Royal
Cove Drive, which was an amendment to the August agenda, but was not
reviewed since no representative was present. He was advised that the
applicant had decided not to put the trailer in and had asked to be de-
leted from both Planning Board and Community Appearance Board agendas.
There being no further business to come before the Board, the meeting
was adjourned upon MOTION by Mrs. Harris/Mr. Kane at 10:10 A.M.
