1990.04.11_PB_Minutes_RegularTOWN OF HIGHLAND BEACH dbPLANNING BOARD PUBLIC HEARING - MINUTES Wednesday, April 11, 1990 10:40 A.M. At 10:40 A.M., Chairman John E. Ward called this Public Hearing to or- der in Commission Chambers. Those present, who had also attended the previous two meetings this date, were Chairman Ward, Vice Chairman A.M. Fox, Jr., Regular Members Amelie Leng and Arthur R. Keller, and Alternate Members Arthur J. Kiefer and Abraham Futernick. Also in attendance were Town Attorney David Friedman, Senior Land Plan- ner Jim Park of Gee and Jensen, and Recording Secretary Doris Trinley. Chairman Ward noted that the purpose of today's advertised Public Hear- ing was for the purpose of receiving and considering public comments on a proposal to amend land development regulations/zoning re multi -family zoning, consistency and concurrency provisions re service standards and resource protection standards re environmentally sensitive lands. . The incorporation of Xeriscape into Code was first addressed. Mr. Park presented the members with handouts and reiterated what he had related to them at the March Regular Meeting, i.e., some parts of the Xeriscape Code seemed to be in conflict. Specifically, it covered too broad a subject matter, he said, with the effect being that the determination of landscape requirements necessitates referring not only to Chapter 28-1/2, but also to Chapter 30 and the Xeriscape Manual. He suggested that the Chapter itself be renamed "Xeriscape-Landscape Requirements, Installation and Maintenance" and be defined by a whole number rather than the current half number. Mr. Park also separated the Xeriscape Manual and renamed it "Xeriscape Plant Guide and Pruning Manual," which would provide a list of plants and trees and their requirements and characteristics, as well as set forth pruning standards of the National Arborist Association. Other discussion took place regarding the following: 1) Permitting - It was the CONSENSUS of the members that the Community Appearance Board should be the gov- erning authority; Mr. Park will re -write to reflect same. 2) Sec. 5.8 and 5.9 - To be removed from Chapter 30 and included in Chapter 28-1/2. These sections are complete except for a revision regarding covering of garage roofs with artificial turf, which will be changed to include multi -family dwellings only. i Planning Board April 11, 1990 Public Hearing Page 2 of 3) Vested Rights - The word "approved" shall be added to the language referring to site development plan and building permit, i.e., "approved and valid site development plan," etc. Finally, on the recommendation of Mr. Park, it was the CONSENSUS of the members that Chapter 28-1/2 be renumbered Chapter 31. Resource Pro- tection Standards will become Chapter 32 and Consistency and Concurren- cy Requirements will become Chapter 33. The Board next directed their attention to multi -family zoning. No discussion was necessary in this regard and Mr. Park pointed out that the materials presented today represented the information previously given in graphic form being put into language. A typographical omis- sion from the material will be corrected by Mr. Park. Chairman Ward then requested that Attorney Friedman prepare the neces- sary paperwork so these elements can be transmitted to the Town Commis- sion. A MOTION was then made by Mr. Fox/Mrs. Leng that this Public Hearing be • recessed and continued on May 9 at 10:30 A.M. The Motion carried unan- imously and the Hearing recessed at 11:55 A.M. Before the members left the dais, Mr. Park told them that he would be preparing a report, which he will send to the Town Manager by the end of April, regarding the Town's contract with the Department of Communi- ty Affairs, which will verify that the Town has completed its obliga- tion.
