1990.12.12_PB_Minutes_Special6 TOWN OF HIGHLAND BEACH PLANNING BOARD PUBLIC HEARING/SPECIAL MEETING - MINUTES Wednesday, December 12, 1990 10:10 A.M. This Public Hearing/Special Meeting of the Planning Board was convened by Chairman John E. Ward at 10:10 A.M. in Commission Chambers. Present were the Chairman, Regular Members Amelie Leng, Helene Harris, Arthur R. Keller and Harold Hagelmann and Alternate Members Abraham Futernick and Paul R. Kane, Sr. Also present were Town Attorney Ken Zeilberger, Building Official Harry Heithaus and Deputy Town Clerk Doris Trinley. Chairman Ward then announced the purpose of this advertised Public Hearing/Special Meeting, i.e., to receive and consider public comments, and make a recommendation to the Town Commission, on a proposal to amend Section 8.1 of Chapter 30 of the Town Code of Ordinances to include the following: DEMOLITION PERMITS WILL NOT BE CONSTRUED AS BUILDING • PERMITS FOR PURPOSES OF THIS SECTION. The Chairman then asked Mr. Keller to read into the record the proposed ordinance amendment to Section 8.1 of Chapter 30 submitted by the Town Attorney's office; in turn, the Chairman read into the record Section 8.1 of Ordinance 574 (Chapter 30), which was adopted by the Town Com- mission in January 1989. Since demolition permits were covered in Section 8.1 of this ordinance, Mr. Ward noted, it would appear the proposed amendment from the Attorney's office was incorrect and it would be proper to amend Section 8.1 of Chapter 30 as encoded in Ordinance 574 instead, by the simple addition of the above referenced sentence. (A copy of the Attorney's proposed amendment and a copy of Ordinance 574 are attached to and made part of these minutes.) Asked for his opinion of this reasoning, Attorney Zeilberger said he had no comments; the consideration was simple and clear. When asked to explain why it was not necessary for the Board to have two Public Hearings (as originally scheduled) on this issue, Attorney Zeilberger said it was because the Board was not enacting any changes to the Code; it was only making a recommendation to the Town Commission. After some further discussion, during which it was noted for the record that no members of the public were present, a MOTION was made by Mr. Hagelmann/Mrs. Leng, which carried with unanimous vote, as follows: W1 e Planning Board Public Hearing/Special Meeting - Minutes • December 12, 1990 Page 2 of 2 THE PLANNING BOARD RECOMMENDS TO THE TOWN COMMISSION THAT SECTION 8.1 OF CHAPTER 30 (ORDINANCE 574) BE AMENDED TO INCLUDE THE FOLLOWING SENTENCE AT THE END OF THE FIRST PARAGRAPH OF SAID SECTION: DEMOLITION PERMITS WILL NOT BE CONSTRUED AS BUILDING PERMITS FOR PURPOSES OF THIS SECTION. It was noted that this recommendation will be transmitted to the Town Commission.
