The Special Meeting of the Planning Board of the Town of Highland Beach, Florida, was called to order by Chairman I. S. Saunders at 9:30 A.M. The recording secretary called the roll. Present were Chairman I. S. Saunders, Vice Chairman D. R. Rome, M. A. Waldman, J. E. Ward, A. Leng and A. Futernick (alt.). Also present at the Special Meeting were Town Attorney T. E. Sliney, Building Official B. Sutherland, Recording Secretary A. M. Kowals, J. Toshner of Gee & Jensen, Attorneys K. Slinkman, A. Ciklin, B. Taub and A. Kramer representing property owners and interested residents of Highland Beach. Absent from this Special Meeting was C. H. Bartlett (alt.). Town Attorney Sliney advised the purpose of this Special Meeting was to discuss the proposed changes on the Comprehensive Plan regarding land uses from a designation of MFM to MFLM. Lots 133 through 137 are proposed to be changed from an RS zoning designation to RE, said Town Attorney Sliney. Notices were sent to all owners, via Certified Mail, regarding the proposed changes and the Special Meeting. The proposed resolutions, continued Attorney Sliney, would recommend the adoption of the future land use changes for zoning changes and suggests public hearing dates for those matters. Continuing, Attorney Sliney suggested one public hearing for Boca Hi include the Enclaves and Boca Cove. The second public hearing should be for Hoffman/Broadview, Regency, Connaught, Slagle and Deganahl. The third public hearing would be for Frederick/Sunrise Property. When Mr. Ward questioned why the Milani Property was not included in this study, he was informed that property was not reviewed by the Town Planner. When Mr. Ward asked why only the Boca Hi and Hoffman Parcels were reviewed by the planner, Attorney Sliney replied those are the two largest parcels in Town that are former RPUD Sites; and Vice Chairman Rome stated that this board determined the RPUD's were dead and the Town had property without zoning. Town Attorney Sliney stated they are two large parcels that are zoned RMM--you are considering a different designation for those properties. 0 7 PLANNING BOARD Special Meeting Aftiuly 25, 1986 Page 2 of 6 When Mr. Waldman said the board should recommend the Town Commission engage Mr. Toshner to review the Milani Property, Vice Chairman Rome added it is a good idea to consider that parcel for rezoning on the West side. Vice Chairman Rome stated it would be in order to review the Steinhardt Property which is another large parcel. Town Attorney Sliney commented the board will have a number of public hearing on properties they will group; they will have one amendment to put them together. The Milani and Steinhardt Properties should be included in the MOTION requesting a review by a planner, continued the Town Attorney. Mr. Waldman made a MOTION that we recommend to the Town Commission that they employ John Toshner to review the Milani and Steinhardt. Property for future rezoning, as soon as possible. Vice Chairman Rome seconded the MOTION. A roll call vote resulted as follows: Mrs. Leng 'aye' Mr. Ward 'aye' Mrs. Rome 'aye' Mr. Saunders 'aye' 0 Mr. Waldman 'aye' Mr. Toshner of Gee & Jensen addressed the board stating he was pleased to be back. He has been working off and on with the Town Manager, Town Attorney and Building Official and they have put together a preliminary planning report of the parcels in question. Basic information necessary for the board to make a decision concerning key issues was included in the report, continued Mr. Toshner. At this point, Chairman Saunders said while this is not a public hearing, the board is asking for short comments from representatives of properties being discussed. Mr. Digby Bridges, representing Connaught Parcel, said all they ask is that they be notified when all meetings be held; notices should be sent to the owners. When Vice Chairman Rome stated the office should be advised where notices should be sent, Town Attorney Sliney requested Mr. Bridges submit something in writing regarding the notices. Attorney Ciklin, representing Broadview Savings & Loan and the owners of Boca Hi, addressed the board and asked who made the proposal to change the Comprehensive Plan from MFM to MFL at properties owned by both of his clients. �Town Attorney Sliney stated it came through discussion at Planning Board Ieetings, in periodic review of the Comprehensive Plan and engaging of John Toshner to review these parcels. We are here to advise you and your clients of changes so a public hearing can be held. J •PLANNING BOARD Regular Meeting July 25, 1986 Page 3 of 6 Town Attorney Sliney said resolutions were prepared in draft form --in order to have a public hearing, we would have to have a proposal. Attorney Ciklin stated he received notice of this Special Meeting on July 22. When dealing with a great deal of money and two RPUD's that are duly vested, active RPUD's, three days notice is not sufficient. Town Attorney Sliney said approximately two months ago, Attorney Slinkman was here pursuant to notice on this matter. This is really not a required step in the procedure. We are notifying people of what the Town is considering doing. We are giving adequate opportunity to all. You have to have a recommendation for a public hearing --we are doing that, continued Town Attorney Sliney. Attorney Ciklin said the March 26, 1986, meeting was not for the purpose of amending the Comprehensive Plan; it was for the proposal to rezone the sites. Rather than deal with a review of these particular properties, you will be asking for approval of a resolution for these two parcels. You have no in -put from us; we have not been able to become part of the process, continued Attorney Ciklin. Vice Chairman Rome said Attorney Ciklin was present on March 26; Mr. .Delaney was also present. Many spoke at that meeting. A public hearing was called to solicit public comments regarding RPUD 1 and RPUD 2. We are starting a review of the Comprehensive Plan because of all recommendations from Town residents, stated Mrs. Rome. When Attorney Ciklin said certain legal requirements must be met before you take anything away from a property owner, Vice Chairman Rome stated we are not taking anything away --we are starting the process. Attorney Slinkman stated he has been here about ten years as a representative of Hoffman who owns part of that RPUD known as the Hoffman Property. The Hoffmans transferred part of the property to Attorney Ciklin's clients. At the March 26, meeting, continued Attorney Slinkman, we were advised the Town's position is that the RPUD lapsed; the Town did not know what category we were in. There would be further meetings to rezone to an appropriate category. Continuing, Attorney Slinkman said they want to work this matter out. They feel they have an RPUD and they are willing to give a little. Three days notice to talk about a parcel seems inadequate. We want to hear what the board has to say and we would like to have a copy of the Gee & Jensen Report. Attorney Slinkman requested a continuance. 0 PLANNING BOARD Special Meeting July 25, 1986 Page 4 of 6 Town Attorney Sliney said he does not necessarily agree with Attorney Slinkman concerning the notice. There is no objection to having a Workshop Meeting. Mr. Toshner will discuss any proposal with the representatives of the property owners, continued Attorney Sliney. The Planning Board, said Town Attorney Sliney, will schedule a Workshop Meeting. The purpose will be a preview to the public hearing. When Vice Chairman Rome inquired of Attorney Slinkman how large the Hoffman Property is, he replied that it consists of 24.8 acres; Attorney Ciklin's clients own 17 acres and the Hoffmans own approximately 8 acres. Attorney Slinkman said before any resolution or proposal is passed, we should have a Workshop Meeting; let's sit down and work it out. Attorney Ciklin will submit a survey showing who owns what, added Attorney Slinkman. Chairman Saunders stated we are the Planning Board and we see things in an objective way. You may have some ideas as to the purpose and end result of the Planning Board --we consider the developer and the Town. Town Attorney Sliney said Attorney Ciklin had submitted a survey but we . are not sure what it includes; is it the entire RPUD? If it does not include the Hoffman portion, we would like one on that; we need a survey of the entire parcel, continued Town Attorney Sliney. Chairman Saunders requested Attorney Slinkman confer with the Building Official and give him the exact parcel that his clients (the Hoffmans) own. When Vice Chairman Rome questioned who the associates in Hidden Harbor Development were, Attorney Slinkman said Broadview Savings & Loan (they have taken over Wally Zaremba's interest). When Vice Chairman Rome said she can not find the Town Commission ever giving the Hoffmans permission to transfer any of the property, Attorney Slinkman said they contacted Town Attorney Sliney to see what the Town's position was regarding this conveyance. Chairman Saunders requested the Building Official mark the plan to show the exact portion of the property owned by the parties for the forthcoming public hearing. When Mrs. Leng asked what date would be convenient for all to have the Workshop Meeting, Town Attorney Sliney said all parcels should be included on that agenda and anybody can attend. • PLANNING BOARD •Special Meeting July 25, 1986 Page 5 of 6 Town Attorney Sliney said today we were telling what we were planning to do. Giving the benefit of doubt, we will have a Workshop Meeting and they will have actual notice of same. We will send a written agenda. All agreed August 20, 1986, at 9:30 A.M., was convenient for the Workshop Meeting. Town Attorney Sliney added if the representatives of the property owners wished to confer with Mr. Toshner, they should do so as soon as possible. Attorney Kramer, representing Mr. William Frederick, said he will be at the Workshop Meeting on August 20. When Mr. Ward asked Town Attorney Sliney why the Milani Property was not included in this study, Mr. Sliney said the parcels should be separated and Mr. Toshner should have the opportunity to review the parcel. When Vice Chairman Rome mentioned the new State ruling allowing the Comprehensive Plan to be changed just twice a year, Town Attorney Sliney said separate public hearings on parcels that are similar would be held; then an adoption process would be done at the end. Chairman Saunders instructed the recording secretary to forward the Planning Board's MOTION regarding the Milani and Steinhardt Properties to • the Town Commission by Monday (July 28). When Mr. Gilbert Lorenz, a resident at the Regency Highland, asked what is the actual effect of the zoning from MFM to MFLM, Town Attorney Sliney replied it is a lower land use in density designation. Mr. Ward, referring to Mr. Toshner's preliminary report stating the current water system has been operating at or near capacity (1.8 MGD), commented the Town already reach that several weeks ago. Mr. Toshner said they wanted to point out factual information and that has to be an issue to be considered for future projection. Vice Chairman Rome commented that the traffic impact which is at a D & E Level of Service is a big problem in Town and a concern of this board. Mr. Toshner said it is something that warrants further investigation; a detailed traffic study has not been completed. It should be a definite consideration on the part of everyone involved --the Planning Board, the Town Commission and future developers. Town Attorney Sliney stated a copy of the preliminary report by Gee & Jensen will be distributed to all property owners. And, the sooner Attorneys Slinkman and Ciklin get together with Mr. Toshner to discuss the issues, the better off we will be. There is some room for • compromise, said Town Attorney Sliney. R` 1 r� PLANNING BOARD .Special Meeting July 25, 1986 Page 6 of 6 Chairman Saunders said each would welcome the opportunity of sitting down with Mr. Toshner who worked with the Town for a long time. The sooner the better, so we will all have an understanding at the time this public hearing comes about. The next Regular Meeting of the Planning Board was scheduled for Wednesday, August 13, 1986, at 9:30 A.M. by Chairman Saunders. The Planning Board Workshop Meeting was set for Wednesday, August 20, 1986, at 9:30 A.M. At this point, said Town Attorney Sliney, we do not want to set dates for the public hearing as we do not know if we will need more than one Workshop Meeting.
