Rome called the Workshop Meeting of the Planning Board of the Town of Highland Beach, Florida to order at 9:30 A.M. Present at this meeting were Vice Chairman D. Rome, M. A. Waldman, J. E. Ward, A. Leng and A. Futernick (alt.). Also present were Town Attorney T. E. Sliney, J. Toshner of Gee and Jensen, Recording Secretary A. M. Kowals, Attorneys B. Taub, R. Cook, A. Ciklin, R. Eisen and J. Corbett (representing the various property owners) and many interested Town residents. Absent from this Workshop Meeting were Chairman I. S. Saunders and C. H. Bartlett (alt.). Vice Chairman Rome stated this Planning Board Workshop Meeting was called to have discussion about amending the future land use plan of the Town's Comprehensive Plan. The first agenda item, said Vice Chairman Rome, is the Hoffman/Broadview Parcel. ottorney A. Ciklin addressed the board members and identified himself as the representative of the Broadview Savings & Loan who has a major interest in the Hoffman Property. He is here to listen, answer any questions and participate, if there is any participation to be had. Vice Chairman Rome advised the Planning Board is workshoping this. We intend to amend the future land use plan and we want in -put from you so we know what your feelings are, continued Mrs. Rome. Attorney Ciklin responded they do not know in which direction this is going; we are here to participate - we want to help in any way we can. Mr. Paul Hoffman addressed the board and stated he and his wife own a portion of the property known as the Hoffman Tract which presently is approved for 300 and some units; we have a substantial interest in the property that Broadview has an interest in. When Vice Chairman Rome questioned Mr. Hoffman's statement regarding approval for 300 plus units, Mr. Hoffman informed the members that approval applies to just the South 300 feet of the property (under the RPUD) which he owns. Continuing, Mr. Hoffman said their position is that the RPUD granted in 1980 is still in existence; we are here to listen and we're agreeable to discussing reduction of density on this property. 0 0 • PLANNING BOARD Workshop Meeting August 20, 1986 Page 2 of 6 Obviously, said Mr. Hoffman, the Planning Board has something in mind; we are happy to listen and give our in -put later. Vice Chairman Rome advised this meeting is not being conducted to determine when the RPUD expires --there are no more viable RPUD's in Town. This meeting is to discuss the amendments to the future land use plan, continued Mrs. Rome, the RPUD parcels have no zoning on them. The Planning Board, said Vice Chairman Rome, knows the Town is 'over -built' and there are problems with water, sewage and traffic. This is the reason for amending the future land use plan, stated Mrs. Rome. Town Attorney Sliney said he recognizes the fact that Attorney Ciklin, Mr. Hoffman, and others have different points of view. We have a position which is well taken, continued Attorney Sliney, and we are here to change the land use plan. The next agenda item, said Vice Chairman Rome, is the Boca Hi Parcel (B and C Sites of RPUD-1) the North portion of the Boca Hi Complex. Attorney Ciklin identified himself as the representative of Boca Hi and stated they are here to listen and participate in the program. At this point, Vice Chairman Rome asked if any person in the audience or resident of Boca Hi wished to be heard. Mr. Gerard Stevens, resident/owner at Braemer Isles Condominium, said he feels he is speaking for all people in Boca Highland where there is the greatest number of people per acre in Highland Beach. The great density and over -population, continued Mr. Stevens, is causing problems with traffic, inadequate parking, creating a safety factor on the bike path and a great demand on utilities (water, sewer, etc). We should be concerned with the hurricane season as we are in a high risk area that has a limited escape route along A-1-A, said Mr. Stevens. Vice Chairman Rome noted there were no representatives from the Enclaves of Boca Cove and Boca Cove Parcels or the Regency Parcel. Representing the Connaught Parcel (Lot 71W) was J. Corbett, an attorney with the law firm of Gunster, Yoakley, Criser & Stewart, who stated the owners of the Connaught Parcel feel they have a site plan that was approved by the Town. If the intent of the amendment to the comprehensive plan is to modify the existing approval, continued Attorney Corbett, the property owner would strongly object. Attorney Corbett stated the Town never notified the owner of any determination made by the Town that he could not build pursuant to his approved site plan. PLANNING BOARD Workshop Meeting August 20, 1986 Page 3 of 6 is The owner feels it would be unfair for the Town to amend the comprehensive plan in a way that would be inconsistent with the approved site plan for this parcel, in view of the written assurances received from Town personnel, said Attorney Corbett. It is suggested, continued Attorney Corbett, the property be left as designated; or incorporate language in the comprehensive plan to recognize the validity of the approved site plan. When Vice Chairman Rome mentioned Connaught Property was included in this agenda because, according to the town planner, you do not leave one parcel out when it is within a certain zoning district, Attorney Corbett stated the realities of approvals must be recognized. Town Planner J. Toshner stated he has not looked at any site plan or been aware of any correspondence over the past few years regarding the Connaught Parcel; it is a valid concern, we need to look at it in greater depth and we must evaluate the situation. When Vice Chairman Rome said the Planning Board does not intend to take any action today and she was not aware of any correspondence regarding this matter, Town Attorney Sliney stated Architect Digby Bridges appeared before us on a number of occasions regarding this piece of property. Town Attorney Sliney said the situation has been dormant; they had a site plan from some time in the past. When Town Attorney Sliney questioned the status of the property, Attorney Corbett stated Connaught is not ready to pull a permit tomorrow. Town Attorney Sliney noted he has not received any recent correspondence on this property. Mr. Waldman commented the duty and purpose of this Planning Board is to maintain a certain lifestyle --review what was done in the past and what we want done in the future to improve things for residents of Town. And, we want all the in -put we can get. Vice Chairman Rome said the Town has problems regarding water, sewer, traffic, etc. We have a responsibility to the people who live here. The Town is "over -built". We have to know, continued Mrs. Rome, how your client feels, how the residents fell; and then, we have to come to some conclusion regarding the comprehensive land use plan of the Town. Vice Chairman Rome noted there was no representative from the Slagle Parcel. Representing Mrs. August Buschette, owner of the Deganahl Parcel (Lot 57W) was Mr. Dave Evans of Boca Raton who advised the members that Mrs. Buschette is in favor of down zoning and density control in Town. • PLANNING BOARD Workshop Meeting August 20, 1986 Page 4 of 6 • Vice Chairman Rome said the next matter to be discussed is the proposal to rezone Lots 133 thru 137 East and West of A-1-A from RS to RE. Attorney Robert Eisen of Boca Raton identified himself as the representative of Joseph Atwell, the trustee contract purchaser of that property. Attorney Eisen said they are here to listen to what is discussed; it is my client's intention to develop the property with five estate type homes. We have no objection to the RE zoning as long as we could build those five homes. Continuing, Attorney Eisen said they understand they will have to go through an approval process that involves the Town Commission. Vice Chairman Rome said the board is happy that Attorney Eisen and his client agree with the Planning Board Members. The Byrd Beach area is a beautiful part of Town and it is important to keep it in harmony with that neighborhood, continued Mrs. Rome. Town Attorney Sliney commented the Town Manager had written a letter to Attorney Eisen concerning submission of conceptual plans for the Byrd Beach Parcel. When Attorney Eisen stated he has plans showing what his client wishes to • construct on that Byrd Beach Property, Town Attorney Sliney said there is no problem with the Planning Board looking at them --they are not going for approval. The Planning Board is considering changing the land use plan; Attorney Eisen is proposing what is consistent with what the Planning Board wants to do, continued Town Attorney Sliney. Vice Chairman Rome said members would like to look at the plans so they can be more informed. Attorney Eisen explained there are five plotted lots and they would like to build a home of substantial size on each plotted lot. The West part of the lot would have an entrance feature with landscaping that would be an extended driveway to each residence, said Attorney Eisen. When Mrs. Leng questioned if Mr. Atwell was also purchasing the West side, Attorney Eisen replied they have contracted for the purchase of the East side only. Mr. Toshner said he met with Mr. Woolsey, Mr. Frederick's representative, who showed a plan indicating their intention is to construct three or four single family homes on the West side parcels. Mr. Woolsey gave the impression they would be satisfied with estate type homes, continued Mr. Toshner, and would be willing to present a site plan showing what they want to do. • V PLANNING BOARD Workshop Meeting August 20, 1986 Page 5 of 6 Vice Chairman Rome acknowledged receipt of a memorandum from the Building Official, dated August 1, 1986, to the Planning Board advising the area on the West side (Frederick's Property) does not meet the requirements for RE zoning. The Vice Chairman asked what does or does not meet the 30,000 sq. ft. requirement. Mr. Toshner said in speaking with Mr. Sutherland, he was informed there is a possibility that something under the required 30,000 sq. ft. might be appropriate. We should consider that before any final decision is made, continued Mr. Toshner. Mrs. Leng inquired if there was any communication between Mr. Frederick and Attorney Eisen's client as to how the people on the West side would get to the beach on the East side. Mr. Toshner said that matter was not discussed at all; Mr. Woolsey wanted to emphasize they are not involved on the East side at all. Vice Chairman Rome said she is concerned with the 'motel' on the West side. When "Unity of Title" regarding the East and West side was discussed, Attorney Eisen said they will separate the "Unity of Title". Attorney Eisen said it is their current desire to disassociate themselves from the • West side --we will discuss that to reach that goal. When Town Attorney Sliney said the Planning Board is here for in -put from anyone who wishes to be heard, Attorney Ciklin replied they are interested in participating in the Town's process, if there is one to participate in. Mr. Toshner said he wants to indicate that he met with Attorney Ciklin, Mr. Delaney and Mr. Glyman and discussed the preliminaries --the various issues compatible to land uses. Continuing, Mr. Toshner said he indicated they were going to have to take an in-depth look at the water and traffic matters. No traffic evaluation was prepared, said Mr. Toshner. City engineers did a report of the water. These matters were discussed and they are aware of the issues, stated Mr. Toshner. Mr. Toshner said there may be room for further discussion and information the Town may want to provide to help with the changes to the land use plan. At this point, Town Attorney Sliney said if there are no further comments, one more meeting should be scheduled to discuss these matters again. Then, the board would prepare a resolution on the proposed changes. Public hearings would be scheduled to go through the process, continued Attorney Sliney. 0 PLANNING BOARD Workshop Meeting August 20, 1986 Page 6 of 6 Vice Chairman Rome scheduled the next Regular/Workshop Meeting of the Planning Board for September 10, 1986, at 9:30 A.M. with the agenda for said meeting closing on August 26, 1986, at noon. Any written comments to the Planning Board from Town residents would be appreciated, said Vice Chairman Rome. We want people in Town to be interested in what is going on --a Town functions well when citizens are interested, continued Mrs. Rome. When Attorney Ciklin commented they have received no planning reports from the Town, Town Attorney Sliney said they are available at Town Hall. Continuing, Attorney Ciklin said if the Town is taking action regarding these properties, the Town should be responsible for letting the property owners know what that entails; it is government responsibility to notify citizens what is going on. Town Attorney Sliney said he wasn't aware there was a problem obtaining any reports; they're in the Town records and available to anyone who wishes a copy. Mr. Toshner said he, in the preliminary letter report, identified what had to be investigated at great length. In the best interest of the Town and in fairness to affected parties, Mr. Toshner said he feels it would be advisable to prepare final comments regarding the land use, traffic and water. Those issues, continued Mr. Toshner, were addressed in their June 9, 1986, report to the Town. Mr. Toshner said they looked at those issues as they related to Boca Hi and Hoffman Properties; more information would be appropriate and this is the recommendation I am making today. Mr. Futernick commented that information is available in Town Hall --it is not the Planning Board's duty to force people to get involved in changes or to put the information in their hands. Vice Chairman Rome mentioned anyone wanting a copy of the Gee & Jensen report can obtain same from the staff at Town Hall. Mr. Toshner said he is still available for discussion regarding these issues. Vice Chairman Rome adjourned the Workshop Meeting of the Planni g Board, Town of Highland Beach, Florida at 10:30 A.M.
