1986.12.10_PB_Minutes_Regular-- TOWN OF HIGHLAND BEACH, FLORIDA PLANNING BOARD REGULAR MEETING — MINUTES DECEMBER 10, 1986 9: 30 A.M. Chairman I. S. Saunders called the Regular Meeting of the Planning Board Town of Highland Beach, Florida, to order at 9:30 A.M. in the Commission Chambers at Town Hall. The Recording Secretary called the roll. Present were Chairman I. S. Saunders, Vice Chairman Rome, M. A. Waldman, J. E. Ward, A. Leng, C. H. Bartlett (alt.) and A. Futernick (alt.). Also present were Town Attorney T. E. Sliney, Building Official B. Sutherland, Recording Secretary A. M. Kowals, P. Colman and interested residents. The members approved and accepted the Minutes of the November 12, 1986 Public Hearing and Regular Meeting of the Planning Board as submitted. NEW BUSINESS Mr. Waldman read into the minutes a memorandum dated November 18, 1986, from Mr. Williams regarding the Planning Board Resolution approved on August 13, 1986, directing the Planning Board Secretary to notify all real property owners by Certified Mail of all Planning Board Meetings at which any official actions are to be taken which will regulate the use of their property. Following discussion, Mr. Waldman made a MOTION, seconded by Vice Chairman Rome, that the Planning Board use First Class Mail instead of Certified Mail to save the Town the unnecessary expense. The Town Attorney had no problem with that MOTION as the properties under consideration had actual notice. The Certified Mail turned out to be a great administrative burden, said the Town Attorney, and he sees no problem with the use of First Class Mail. A roll call vote resulted as follows: Mrs. Leng 'aye' Mr. Ward 'aye' Mr. Saunders 'aye' Mrs. Rome 'aye' Mr. Waldman 'aye' Members acknowledged receipt of a memorandum dated December 3, 1986, from Town Manager Williams regarding the proposed Building Permit Moratorium Ordinance. According to this memo, said Mr. Waldman, the Planning Board has to go through the same process regarding the Building Permit Moratorium Ordinance as they did for the rezoning changes. We should set the dates for the Public Hearing as this is a very necessary subject, continued Mr. Waldman. V PLANNING BOARD Regular Meeting - Minutes December 10, 1986 Page 2 of 5 An article in the December 10, 1986 issue of the Miami Herald concerning saltwater intrusion into well fields was discussed. In order to cope with this situation, said Mr. Waldman, Highland Beach should have a Building Moratorium going on, at this time, to help set a plan of action. This is a universal problem, continued Mr. Waldman, South Florida will be unliveable if we continue building. Vice Chairman Rome, agreeing with Mr. Waldman, said she is concerned not only with the water problem but also the safety on A-1-A which is a disaster when we have an influx of residents. Mr. Waldman suggested that while this matter is being discussed, no new permits be issued for any building whatsoever in Town. Mrs. Leng concurred this matter should be addressed as soon as possible. Following a discussion of the notice requirements which are to be published in the newspaper, Mr. Ward stated January 14, 1987 is the next Planning Board Regular Meeting; that would allow time for preparing the necessary legal advertisements for the Public Hearing. Chairman Saunders said the water problem is throughout the State of Florida; it is an important and critical item. Mr. Ward said before the next Planning Board Meeting members would require certain information. Under the proposed Ordinance, said Mr. Ward, Highland Beach can not interconnect to Delray Beach or Boca Raton because of the different types of water treatment. Mr. Ward questioned what is meant by " Highland Beach Pump expires on February 15, 1989"; what is the relationship between solid waste disposal and water supply; what will be the duration of the moratorium? Town Attorney Sliney said the Planning Board needs to make certain findings and facts. The South Florida Water Management District determines how much water they can allocate. The permit is an allocation as to how much the Town can draw (the District has a right to review that); and, the Town has exceeded their capacity on several occasions. Vice Chairman Rome recommended a memo be forward to the Town Manager requesting he make all reports available to the Planning Board Members as soon as possible. Town Attorney Sliney stated the Town Manager should be present as he is involved with all these issues (solid waste disposal is very crucial as is the land fill issue). Those are pertinent things for the members to IDconsider. This is a Building Permit Moratorium Ordinance and will be related to other factors, continued Attorney Sliney. • 0 PLANNING BOARD Regular Meeting December 10. 1986 Paqe 3 of 5 Mr. Waldman added the moratorium is not expressly for the water although that is the main reason. There are traffic problems, solid waste problems that result from an overabundance of building and people; and, air pollution that results from too many cars, said Mr. Waldman. When Mr. Waldman stated it was a shame our predecessors did not have the same aims and objectives that we have, Mrs. Leng added they did not listen - the environmentalists were telling us but no one listened. After much discussion, Vice Chairman Rome made a M_ O___TION�, seconded by Mr. Waldman, that the Planning Board have a Public Hearing, as proposed by the Town Commission, to discuss the Building Permit Moratorium Ordinance because of the problems that the Town has regarding water, solid waste, sewage and traffic; and, we hold such Public Hearing on January 14, 1987 with due notices being placed in the paper five and fourteen days prior to the Hearing, as required by law. When Mr. Bartlett asked if any attempt was made to set a tentative limit or date in which this can be done (when this might be resolved or partially resolved), Town Attorney Sliney said that will be addressed at the Public Hearing. One recommendation will be the time which will be determined in January at the Public Hearing. There will be a place in the Ordinance that says it will expire (we renew the ordinance if necessary), continued Attorney Sliney. The Planning Board will make their recommendations to the Town Commission; the Town Commission then plugs in and goes ahead and adopts the Ordinance, said Attorney Sliney. In a brief discussion regarding the process of desalinization, Mr. Waldman said that would only solve one of the problems; we should not address ourselves to something that, at present, is impossible - the solution is to give the people breathing room. A roll call vote resulted as follows: Mrs. Rome 'aye' Mrs. Leng 'aye' Mr. Ward 'aye' Mr. Waldman 'aye' Mr. Saunders 'aye' Mr. Waldman made a MOTION, seconded by Vice Chairman Rome, to recommend to the Town Commission that no new building permits shall be issued by this Town until the "Moratorium Problem" has been discussed and resolved one way or another. A roll call vote resulted as follows: Mr. Saunders 'aye' Mr. Ward 'aye' Mrs. Rome 'aye' Mr. Waldman 'aye' Mrs. Leng 'aye' •PLANNING BOARD Regular Meeting December 10, 1986 Page 4 of 5 Vice Chairman Rome mentioned it is important that the Planning Board Members receive all correspondence, reports and information concerning the water, sewage, solid waste, traffic, etc. problems facing the Town, prior to January 14, 1987, so the members will have ample time to study the issues in advance of the scheduled Public Hearing. Town Attorney Sliney advised the Public Hearing will be set for 9:30 A.M. with the Regular Meeting convening upon adjourning of the Public Hearing. Mr. Ward referred to Town Manager Williams' memorandum of October 23, 1986 to the Mayor and Town Commission advising the Town has been allocated a sum of $11,403. for Comprehensive Plan update planning. When, asked Mr. Ward, are we going to get on with this? It is a matter of emergency and we should go on with it, continued Mr. Ward. Town Attorney Sliney informed the members that the matter is not lying dormant; at the Town Commission Regular Meeting, action was taken and the other parcels will be studied. Mr. Waldman said if the Town Commission does act on the Building Moratorium, during that period, the Planning Board would have ample time to discuss the rezoning of Milani and other properties they see fit. is The Board is on going; we will be confronted with these situations and the Town has to constantly review all parcels in Town. If we have a Moratorium, we should, in that time, review the rest of the Town to see if we can improve on the structure of the zoning, continued Mr. Waldman. Mr. Futernick inquired of the results of a meeting with the Town Manager and County Commissioner Wilkens. Town Attorney Sliney said he had no information except that Mr. Williams stated the Town's objection to the County purchasing the Milani Property. Vice Chairman Rome suggested the Planning Board Members attend the Town Commission Public Hearing scheduled for December 17, 1986 at 5:01 P.M. Town Attorney Sliney explained the Town Commission will hold a Workshop and Public Hearing to keep the process moving along. The Town Commission will hold other meetings and will make their recommendations to the State. The State will make their review; we will have other hearings; then, we will make the amendments, continued Attorney Sliney. When Chairman Saunders questioned the timetable for the recent proposals from the Planning Board to the Town Commission, the Town Attorney said the Town is trying to expedite these matters. When Mrs. Leng questioned if new officers of the Planning Board will be iselected at the January Meeting, Chairman Saunders stated the Agenda for the January meeting should include the 'Election of Officers'. n V •PLANNING BOARD Regular Meeting December 10, 1986 Page 5 of 5 OLD BUSINESS Vice Chairman Rome thanked one and all for their good wishes and cheer during her recent hospitalization. With no further discussion under Old Business, Vice Chairman Rome made a MOTION, seconded by Mr. Waldman, to adjourn the meeting.
