1985.07.24_PB_Minutes_Specialv TOWN OF HIGHLAND BEACH, FLORIDA • PLANNING BOARD PUBLIC HEARING JULY 24, 1985 9:30 A.M. The Public Hearing was called to order by Irving S. Saunders, Chairman of the Planning Board Town of Highland Beach, Florida, at 9:30 A.M. Present at this hearing were Chairman I.S. Saunders, Vice Chairman D.R. Rome, M.A. Waldman, J.E. Ward and second alternate C.H. Bartlett. Absent from this hearing was first alternate A. Leng. The Public Hearing was scheduled to examine a request for a Special Exception under Section 4.6 (e)(6) of Chapter 30 of the Code of Ordi- nances of Highland Beach for Seagate of Highland, 3212 South Ocean Boulevard, Town Lots 98 and 99 West, requesting reduction of rear yard setback for installation of ground mounted satellite dish antenna. This Public Hearing was legally advertised and the site was properly posted. •SEAGATE OF HIGHLAND, MRS. JANE RAYNER, PRESIDENT - REPRESENTATIVE: MR. DAN VARGAS, VICE PRESIDENT OF EMPIRE GROUP, INC., PRESENT - SATELLITE T.V. ANTENNA. The President of Seagate Condominium Association, Mrs. Jane Rayner, ad- dressing the Planning Board members stated Seagate of Highland would like to place a satellite dish on the ground next to the air condition- ing room which is attached to the back of Building A. Mrs. Rayner said the dish antenna will be ground mounted and fastened to the wall of the air conditioning room. The Community Appearance Board recommended a chain link fence be erected around the dish and the area be concealed with shrubbery and plantings. As the installation does not comply with the rear yard setback require- ments, it is necessary for Seagate to apply for a Special Exception prior to appearing before the Town Commission. In discussing this application with the Building Official, Chairman Saunders said he was advised that Mr. Sutherland sees no objection to this ground mounting, he is satisfied with the way the satellite dish will be fastened --only the setbacks have to be approved. • d -I 'PLANNING BOARD Public Hearing July 24, 1985 Page 2 of 5 Chairman Saunders informed Mrs. Rayner that Seagate of Highland would have to execute a 'Hold Harmless Agreement' between the Condominium Association and the Town of Highland Beach regarding the dish antenna. A request for the engineer to step forward, identify himself and ex- plain how the satellite dish antenna will be fastened and what precau- tions are being taken was made by Chairman Saunders. Mr. Dan Vargas, Vice President of Empire Group, Inc., explained the proposed installation for the ground mounted satellite dish antenna at Seagate and discussed the plans fully with the members. The satellite dish will be erected on a concrete platform set in the ground, said Mr. Vargas. An expanded bracket will connect to the base of the dish and will be anchored to the wall to provide stability. Mr. Vargas said the satellite dish will not protrude beyond the wall so there will be a natural wind block. The dish antenna will be anodized aluminum requiring minimum mainten- ance, continued Mr. Vargas. All the devices would be protected with a rustoleum coat at the completion of installation, requiring futur- istic maintenance, said Mr. Vargas. Vice Chairman Doris Rome made a MOTION, seconded by Mr. Ward, that the satellite dish for Seagate of Highland Condominium as outlined on plan submitted by Weyant & Associates, Inc., dated 3/21/85 for ground mounted T.V. dish antenna anchor (stamped... by Mr. Jeff R. Irovani and there is a red date on the seal itself which says 5/31/85 in the lower right hand corner of sheet no. 2 of 2) which is on page 2 of 2, be approved by this board and that the setback requirement be waived, and that Seagate of Highland Condominium be required to sign a 'Hold Harmless Agreement' between the Town and Seagate of Highland Condominium; and, that we then forward this MOTION to the Town Commission for their approval. A roll call vote resulted as follows: Mr. Ward 'aye' Mr. Waldman 'aye' Mr. Saunders 'aye' Mrs. Rome 'aye' Mr. Bartlett 'aye' After the adjournment of the Public Hearing at 10:00 A.M., the members of the Planning Board continued in session for the purpose of discussing matters concerning the Town. 0 ,PLANNING BOARD Public Hearing • July 24, 1985 Paste 3 of 5 The members discussed drafting a reply to Raymond F. Blosser's letter of resignation. After reviewing the matter, the members agreed a response signed by Chairman Saunders should be addressed to Mayor Edward J. Sullivan with copies sent to Town Commission members. Vice Chairman Doris Rome suggested the members of the Planning Board back up the Town Commission regarding their resolution submitted to Palm Beach County stating we are against public parks and public beaches in the Town of Highland Beach. Attorney Tom Sliney advised the members that Mayor Sullivan and the Town Commissioners went to Palm Beach to meet with County Commissioner Owens regarding this matter and a referendum relating to public parks and public beaches will be on the November ballot. The Planning Board members, after much discussion, agreed to draft a memorandum in support of the Town Commission and Resolution No. 476 adopted at their Regular Meeting held on July 2, 1985. Vice Chairman Doris Rome made the following MOTION which was seconded • by Mr. M.A. Waldman: "Be it resolved at the Planning Board meeting session on July 24, 1985, the Planning Board goes on record in support of the Town Resolution No. 476 directed to the County of Palm Beach opposing acquisition by the County of Real Estate within the Town limits of Highland Beach for the purpose of public parks and public beaches for the reasons stated in Town Resolution No. 476." A roll call vote resulted as follows: Mr. Bartlett 'aye' Mr. Ward 'aye' Mr. Saunders 'aye' Mr. Waldman 'aye' Mrs. Rome 'aye' After a brief recess, Chairman Saunders reconvened the meeting at 11:10 A.M. Chairman Saunders stated he was disturbed with the enclosures at pro- jects under construction. Many areas are protected by fences made of old lumber and are most unattractive, continued Mr. Saunders. While these fences are temporary structures, the members feel they can be painted to look presentable. The members referred to Section 7-2.2 of the Highland Beach Code regarding construction fences that are to properly screen the area and be firmly secured. eLANNING BOARD Public Hearing • July 24, 1985 Page 4 of 5 Chairman Saunders said he will contact the Boca Raton Building Depart- ment to see what they do regarding construction fences. Mr. Ward questioned the responsibility of the cleaning and preservation of the beaches. The individual owner of the oceanfront property is responsible for cleaning the beach. Mrs. Rome said most condominiums have beach cleaning services for that purpose. Mr. Bartlett said that as far as beaches are concerned, the high water line is actually public therefore oceanfront owners are nbt responsible for the beach as it is not their property. Mr. Waldman said the Planning Board has been requested by the Town Com- mission to give any ideas they may have on the zoning in the Town at the present time. Consideration should be given to down -zoning all available property West of AlA from 15 to 12 units per acre, said Mr. Waldman, which would bring us in line with neighboring cities. Any property West of AlA should be allowed a maximum of 12 units per acre, continued Mr. Waldman. • Vice Chairman Doris Rome said the Planning Board wrote to the Town Com- mission to advise that this board felt the RPUD was dead and buried; however, the density was never lowered. When dealing with down -zoning, continued Mrs. Rome, you go from the top and work down. You have to take each district and reduce it, said Mrs. Rome — Mr. Ward said the Planning Board would have to go through the entire zoning book before making recommendations. Mr. Waldman said some areas are zoned for 8 units per acre and they would be left alone. It is necessary to down -zone the property West of AlA, continued Mr. Waldman. Vice Chairman Doris Rome said you cannot down -zone the West side and not change the East. You cannot spot zone --it must be a blanket re- view, stated Mr. Rome. Referring to Section 4.3(e) (1) of Chapter 30 of the Town Code, Vice Chairman Rome said the more families you have, the less land you need. The Planning Board has to cover all the side yard, front yard and rear yard setbacks. The Planning Board would recommend changing that to 10 units per acre with the width, front yard, side yard, rear yard and height changed ac- cordingly. Chairman Saunders suggested a cut-off point: cut 18 to 15; 15 to 12; 12 to 10; 10 to 8. The Planning Board will send its recommendations to the Town Commission and if they look favorably on it, said Chairman Saunders, we can go further. Mr. Ward volunteered to review the zoning between now and the next regular meeting at which time he will submit a prepared memorandum for approval by the Planning Board members.
